HomeMy WebLinkAboutORD 77-120� J J ORDINANCE NO. 6) ENTITLED AN ORDINANCE MENDING CHAPTER.3, ARTICLE I, SECTION 3-4 EXEMPTING STATE SUPPORTED COLLEGES AND UNIVERSITIES FROM THE DISTANCE REGULATIONS APPLICABLE TO THE SALE OF ALCOHOLIC BEVERAGES NEAR PUB- LIC SCHOOLS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT Chapter 3, Article I, Section 3-4 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby, amended to read as follows: Section 3-4 - Proximity of dealer to schools or churches. It shall be unlawful for any person to sell, offer for sale, or possess for the purpose of sale, any alcholic beverages, where the establishment or place of business of any dealer is within three hundred feet (300') of any church or public school, the measure- ments to be along the property lines of the street fronts and from front door to front door and in direct line across intersections where they occur. The term "public school" shall not .include State supported colleges or universities. This ordinance shall be and become effective upon receipt by the City Clerk of the City of Beaumont of a certified copy of a resolution of the Board of Regents of Lamar University, in a form acceptable to the City Attorney, certifying that the Board of Regents conducted a public hearing after the adoption of this ordinance on the.. sale of alcoholic beverages at the University, and that said Board of Regents has authorized the sale of alcoholic beverages at the University. 7. -/Ow 7 -,/ .. " .. feI14-j That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and.to such end the various portions and provisions of this ordinance are declared to be severable. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. PASSED BY THE CITY CM\TCIL of the City of Beaumont this the V'V day of��� �� , 1977. -2- RESOLUTION Whereas the Board of Regents did on this tenth day -of November, 1977, conduct an open and public hearing on the sale of alcohol beverages on property owned and/or controlled by Lamar University; and Whereas the Board of Regents did on this date by majority vote approve the following policy, to wit: "The manufacture of alcohol.or malt: beverages on property owned or controlled by Lamar University is. prohibited. The sale of alcohol beverages on property owned or controlled by Lamar University is approved, but only as specifically permitted by the President of Lamar University or his designate. The possession or consumption of alcohol beverages at any athletic event or in any area utilized for instruction during a period of regularly scheduled instruction is prohibited. Policies with regard to alcohol beverages in the dormitories.and at university social events on campus will continue to be determined by the Vice President for Student Affairs with the approval of the President." ad*,o Otho Plummer Chairman of the Board of Regents I, Andrew J.
