BE IT OR'DAIRED by the City Council -of the City of Beaumont. SECTION ONE'. In, order to..'onab.le__the. Beaumont -Traction Company to extend its lines,of railway and improve its service the City of Beaumont hereby grants tothe said Beaumont Traction Company for itself and .its assigns the right .of way for an electric railway upon, over and long the following streets.in the City of Beaumont and across all streets intersecting such streets, to -wit: . Calder. Street, from the present terminus .of -said -railway. on said street at or near its intersection with Gulf Street westward- ly to the western boundary line of the city. Liberty.Street, fro± Orleans. Street westwardly to Magnolia Avenue. Magnolia Avenue, From Liberty Street northwardly to Calder Avenue, Ninth Street, from Magnolia Avenue eastwardly to Collier's Ferry Road. Collier's Ferry Road, northwardly to Tenth Street, Tenth Street, westwardly to Texas Avenue, Texas Avenue, southwardly toisinth Street,, Twelfth Street, in -Herring Addition from Fifth Street to the east- ern line of Herring$ Addition, and thence along a private -2- right of way to G. A. Burt Refinery.' Buford Street, from Sabine Pass Avenue to Carroll. Avenue.. Carroll Avenue, from Buford Street to the southern limit of the City. Cartwright Avenue, from South.Park Street eastwardly to Sabine Pass Avenue Sabine Pass Avenue to Railroad Avenue, Doucette Street from Railroad Avenue to Fifth. Street in Herring Addi- tion, and on Fifth Street in Herring Addition to Tenth Street in Herring .Addition 0 and permission and authority,is-also hereby given and con ferred upon said.Beaumont Traction Company to build, construct, maintain and operate an' electric -railway -Orm .tkR for the carriage of passengers upon, over and along and across all the streets aforesaid, with all necessary switches, turn -outs and turn -tables; and also to erect, construct and.maintain all necessary electrical superstructures and substructures apper- taining to and necessary for the operation of said electric railway including poles, wires and other. -devices for the trans- mission or management or control of .electrical currents to propel the cars,:: of said railway. .Permission and authority is also hereby granted to said Beaunont Traction Company as part of the _right of way herein given to connect the tracks of the lines of railway now operated by -It .with the lines of railway that, shall be constructed .hereunder at an; convenient points of intersection with the lines_ at .present operated. SECTION TWO. The said Beaumont Traction Company and its assigns shall be entitled to have, use and enjoy the rights and privileges of this Ordinance granted for'the term of fifty ('50) years after the date When this Ordinance shall'be approved and go into 'effect;' but this grant and authority and all rights of said Beaumont Traction Company and.its assigns under and in virtue .of this Ordinance shall be at all times subject to all of the terms, conditions, limitations and restrictions LTccN..I, lcio3 -3 contained in an Ordinance of the City of Beaumont heretofore enacted, numbered 81 and entitled, "An Ordinance Granting to Wm. L.. Thomp son of Beaumont. -Texas, Harry K. - Johnson, R. Fol Learned, George IV, Koontz of Natchez, Mississippi, and their associates and assigns the right, privilege and franchise to construct, maintain and operate a line or lines of electric railway upon, over and along certain streets., avenues.and pub - lie bridges in the City of Beaumont, Texas." Approved Oct. 17th, A.D,1902; ' and all of the provisions of. the Ordi-' nance just mentioned prescribing limitations conditions and. restrictions with respect to the grant and franchise therein given and conferred ,are hereby expressly referred to and shall, apply to the right of way herein granted and to all the rights, privileges and authority herein given, granted to or conferred upon said Beaumont Traction Company as fully and entirely as if the provisions of said Ordinance No.81 referred -to, were contained herein and expressed fully and at large in this Ordinance. SECTION Tom, The assent of the City of Beaumont is hereby given to all the transfers, assignments and conveyances by, through and under which the said Beaumont Traction Company has acquired and now owns and claims the rights, privileges and franchises heretofore given, -granted and conferred upon VPm. L. Thompson and others in and by the Ordinance of the City of Beatunont, numbered Eighty One. and mentioned and. referred to in _ the -preceding -section of -this -Or dinance; and the assent of the City of Beaumont is .also hereby given to all, the transfers, assignments and conveyances by, through and under which said Beaumont Traction Company has acquired and now owns and claims the several rights of way, franchises, authority and privileges heretofore by the City of Beaumont given, granted to and con— ferred onferred . upon John H. Kirby of Houston, Texas, n I. D, Poly and others, by an.Ordinance numbered Thirty, approved November 15th, A.D. 1900, and also by an Ordinance entitled 0A)a 17-2 1Q03 -4-, 4-. "An Ordinance approving route of line of street railway to be built by the Beaumont Xtreet Railway Company under Ordinance approved November 15th, 1900, and granting said Company an extension of time until October lst, 1902, to complete same". Approved March 29th, 1902; and the right and -title of said Beaumont Traction Company to the several rights of way granted by said ordinances respectively, and the right of said Beaumont Traction Company to have, use and enjoy the benefits and advantage of all the rights, privileges and franchises in and by the several ordinances in this section, particularly mentioned, given, granted -and conferred, is hereby ratified and confirmed, subject, however, - to all of the conditions, res- trictions, limitations. and provisions of said several ordinance appertaining. to the grants, , rights, franchises and privileges in the same severally contained. SECTION FOUR. Nothing in this Ordinance contained shall author- ize the construction of .said railway upon that part .of any street or avenue already occupied by the tracks .of any other street railway company except. for the purpose of crossing the same.
