HomeMy WebLinkAboutORD 77-80ORDINANCE NO. 7 / _ 90 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, PAID IN PARTICULAR TFEE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING A 1.771 ACRE TRACT OF LAND OUT OF THE D. E. SPELL HOI�ESTEAD TRACT, W. B. DYCHES LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "R-1", TO "LR --1"; PROVIDING FOR SEVEWILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof_, is hereby amended by changing the zoning classification of the following -described tract of land, presently zoned "R-1", Single -Family Dwellina District, to "LR -1", Local Retail District, to wit: BEING a 1.771 acre tract of land out of the D. E. Spell Homestead Tract, in the W. B. Dvches League, Beaumont, Jefferson County, Texas, and being more particularly described as follows: BEGINNING at a two inch (2") iron pipe in the Eas- terly right-of-way of U. S. Highway 69, 96 and 287 (naw Eastex.Freewav) which bears N. 460 52' W.165.65 feet from the point of intersection of the Easterly line of said highway with the Northerly line of Cas- well Road; THENCE N. 461 52' E. 265 feet along the Easterly right-of-way line of said highway to an angle of 14° 30' right and the beginning of a 0.1 acre tri- angle of land as surveyed by the Texas Highway De- partment; THENCE N. 320 22' along the now existing highway right-of-way line to a 3/4" iron pipe for corner; THENCE N. 430 0.5' E. 68.4 feet to a steel shaft for corner; THI S. 62° 48' E., at the dividing line of.the French property, a distance of 290.3 feet to a point for corner in the T9esterly .line of G. S. U. Trans- former Station; THENCE S. 0° 03' W., 24.0 feet to the Southwest cor- ner of the G. S. U. tract of land; THENCE N. 83° 03' E., 35.3 feet along the G. S. U. property line to its intersection with the boundary line of Spell Cemetery; THENCE S'. 20 OT E. 177 feet to the Southwest cor- ner of said cemetery; THENCE S. 430 0.5' W., 79.0feet to the POINT OF BE- GINNING, and containing 1.771 acres of land, more or less, and the official Zoning Map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of tie Code of Ordinances of Beaumont, Texas.
