TO BE A MEDIUM DENSITY MULTIPLE DWELLING DISTRICT; PROVIDING ITS PURPOSE; PROVIDING USE REGULATION; PROVIDING AREA REGULATIONS; PROVIDING PARKING . REGULATIONS; PROVIDING HEIGHT REGULATIONS; PROVID- ING A .STAT rte' ; PROVIDING FOR SEVERABILITY; AND RE- PEALING ALL ORDINANCES IN CONFLICT HERE1gITH. BE IT ORDAINED BY THE CITY OF BE_AUMONT: co..+=; .,,; - i THAT Chapter 42 of the Code of Ordinances of the City of Beaumont is hereby amended by adding thereto Section.42-12.21 to read as follows: Section'42"12:2c Classes of Districts, Additional. The following class of district is hereby.added to those enumerated in Section 42-12 and Section 42-12..1 of the.Code of Ordinances and the city, hereto- fore divided into nine (9) classes of districts, shall. hereafter be divided -into ten (10) classes of districts. The use and area regulations are uniform in each class of district, and the said additional district shall be ]mown as: P'-a.w (10)-R-3MMedium Density Multiple -Dwelling District. Chapter 42 of the Code of Ordinances of the. City 'of.,Beatmlont is hereby aimnded by adding thereto Section 42-14.1; to read as follows: Section 42=14.1: Medium 'Density Multiple=DwEilling.'District. The regulations set forth in this section, or set forth elsewhere in this �-�PA article, when referred to in this section, are the ?1M, medium density multiple- a'mlling district regulations.. (A). "PURPOSE. _The purpose of this section is to encourage medium den- sity residential, development to allow more efficient land use. (B) " 'U.SE.'REGULATIONS. (1) Any use permitted in the R-lA or R-1 Districts, but not includ- ing garage apartments, which.are specifically prohibited from this District. —17-7;7 (2) Two Family Dwellings and Multiple Dwelling units. (3) Accessory buildings such as a garage, or those customary to residential use. (C) AREA REGCTTATIONS . (1) Front Yard. There shall be a front yard having a depth of not less than twenty (20.') feet. (2) Side Yard. There shall be a minimum set back of fifteen (15') feet between the side of any structure and any peripheral development boundary, dedicated street right-of-way, or the curb line of any private street. There shall be a minimum distance of thirty (309 feet between the sides of detached buildings, except in the case of two single family dwellings where the separation between sides shall not be less than ten (10') feet. Where atingle family dwelling unit abuts a mul- tiple family unit, the separation between sides of structures shall be thirty (30') feet. (3) Rear'Yard. There shall be a rear yard having a depth of not less than .fifteen (151) feet. (4) 'Inteftsity of�Use. There shall be a lot area of not less than six thousand two hundred fifty (6,250) square feet for detached single family dwelling units and not less than two thousand four hundred fifty (2,450) square feet for two or more attached units. (5) 'Lot Widths. The minimum average width of each lot shall be: (a) Eighteen (18') feet for interior lots. (b) Thirty (3a') feet for corner lots. (c) In cases where lots do not have frontage on a dedicated pub- lic street, a thirty (30-1) foot access easement shall be improved with a twenty --four (24') foot minimum width of road unobstructed by parking. All such access roads, ex- cept in width of pavement, shall be constructed in accor- dance with the official street construction standards of the City of Beaumont. .M,M (6) 'Attached'Units. There shall not be more than eight (8), at- tached dva--lling units. Two or more.dwelling units shall be "attached", as that word is used herein, if there is less than fifteen (151) feet of open space at the ground level between said dwelling units even though there may be no wall or other structure physically joining the duelling units. (D) PARKING -REGULATIONS. A minimum of.one and one-half off-street park- ing spaces shall'be provided for each single-family dwelling unit and multi -family dwelling unit. (E) HEIGHT REGULATIONS. The maximum height of residential structures shall be thirty-five (35') feet. . r1 --i2- .,J THAT any person, firm or corporation violating any provision of this ordi- nance shall, upon conviction, be punished as provided in Section 1-8 of.the Code of Ordinances of the City.of Beaumont, Texas. Section 4. . THAT if any section, subsection, sentence, clause or phrase of this ordi- nance or the application of same to a particular person, group of persons, firm,. associations or corporation, or to a particular set of circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the re- maining portions of this ordinance, and to such end the various portions and provi- sions of this ordinance are declared to be severable.
