ENTITLED AN ORDINANCE AMENDING CHAPTER 37,
SECTION 37-115.3 OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT, RESTRICTING PARKING
IN THE CITY PARXING LOT; PROVIDING A PENALTY;
PROVIDING FOR SEVERABI:L = AND PROVIDING FOR
REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
That Chapter 37 of the Code of Ordinances of the City of Beaumont
be, and the same is hereby, amended by amending Chapter 37, Section 37-115.3
of the Code of Ordinances for the.City of Beaumont to read.as follows:
Section 37-115.3 - No person shall park a vehicle in the parking
lot bounded by Main Street, Hickory Street (abandoned)
and the Port of Beaumont rail yard between the hours
of 8:00 a.m. and 5:00 p.m., Monday through Friday,
except in metered areas, or areas reserved for Mayor
or City Council members unless such vehicle shall
have a valid City of Beaumont parking permit affixed
to the rear window.
In a prosecution charging a violation of this
section, proof that the particular vehicle described
in the ccoplaint was parked in violation of this
section together with proof that the defendant named
in the complaint was at the time of such parking, the
registered owner of such vehicle, shall constitute in
evidence a prima facie presumption that :the registered
owner of such vehicle was the person who parked or
placed such vehicle in violation of this section -
Any person who violates any provision of this ordinance shall,
upon conviction, be punished as provided in Section 1-8 of the Code of
Ordinances of Beaumont, Texas.

Section 3.
That if any -section, subsection, sentence, clause or phrase of
this ordinance, or the application of sante to a particular set of persons
or circumstances, should for any reason be held to be invalid, such in-
validity shall in no wise affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
