ENTITLED AN ORDINANCE RESTRICTING PARKING IN
THE CITY PARKING LOT; REQUIRING A PARKING
PERMIT FOR USE OF SAID PARKING LOT; PROVIDING
FOR A PRESUMPTION THAT THE REGISTERED OWNER
PARKED SAID VEHICLE; PROVIDING A PENALTY; PRO-
VIDING FOR,SEVERABILITY AND PROVIDING FOR
REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 37 of the Code of Ordinances of the City of Beaumont
be, and the same is hereby, amended by adding a new Section 37-115.3 to
read as follows:
Section 37-115.3 - No person shall park a vehicle in the
City parking lot bounded by Main, Wall and the Port of
Beaumont rail yards between the hours of 8:00 a.m. and
5:00 p.m. Monday through Friday,, except in metered areas,
or areas reserved for Mayor and City Council members un-
less such vehicle shall have a valid City of Beaumont
parking permit affixed to the rear window.
In any prosecution charging a violation of this section
proof that the particular vehicle described in the complaint
was parked in violation of this section together with proof
that the defendant named in the complaint was at the time of
such parking, the registered owner of such vehicle, shall con-
stitute in evidence a prima facie presumption that the
registered owner of such vehicle was the person who parked
or placed such vehicle in violation of this section.
Section 2.
Any person who violates any provision of this ordinance shall, upon
conviction, be punished as provided in Section 1-8 of the Code of Ordinances
of Beaumont, Texas.

That if any section, subsection, sentence, clause or phrase of this
ordinance, or the application of same to a particular set of persons or
circumstances, should for any reason be held to be invalid, such invalidity
shall in no wise affect the remaining portions of this ordinance, and to
such end the various portions and provisions of this ordinance are de-
clared to be severable.
Section 4.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
