I /,� 4 10 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 1975 AND ENDING SEPTHrtRM 30, 1976, BY ADDING ONE SENIOR PLANNER POSITION TO THE PLANNING AND ZONING DIVISION OF THE COMMUNITY DE- VELOPMENT DEPARTMENT, ACTIVITY NO. 51. WHEREAS, the City Manager has recommended that one (1) Senior Planner be added to the budget of the Planning and Zoning Division of the Community Development Department; Activity No. 51, said salary for said planner to be paid fran existing 701 funds; and, WHEREAS, the City Council finds that .this position should be es- tablished; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. That the budget of the City of Beaumont for the fiscal period beginning October 1, 1975, and ending September 30, 1976, be and the same is hereby amended by adding one (1) Senior Planner to the Planning and Zoning Commission, Community Development Department, Activity No. 51 of the budget of the City of Beaumont. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of Q 9c j , , 1976. - Mayor - O- 76 - L16 3- ORDINANCE N0. 7 6 - 4 6 ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR CITY ELECTION WHICH WAS HELD ON THE 3RD DAY OF APRIL, 1976, AND ORDERING A RUN-OFF ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 17TH DAY OF APRIL, 1976, TO DETERMINE WHO SHALL BE COUNCILMAN IN WARD II; NAMING THE PLACES WHERE SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRE- SIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. WHEREAS, the City Council of the City of Beaumont, in session duly called the regular City election to be held on the 3rd day of April , 1976,and the election returns of the votes cast in said election were duly canvassed for the following officials: For the officer for the office of Councilman for the lst Ward; For the officer for the office of Councilman for the 2nd Ward; For the officer for the office of Councilman for the 3rd Ward; For the officer for the office of Councilman for the 4th Ward; WHEREAS, a request for a recount in the office of Mayor has been duly given and canvassing of votes for said office is to be deferred pending said recount. WHEREAS, after duly canvassing said returns, the City Council found that the votes cast at said election for the several candidates for said offices were as follows: For Councilman Ward No. 1: Don S. THAT the results of said regular City election be and the same are hereby declared to have been as herein set out, and'.the following named persons were elected to the following offices: For Councilman for the lst Ward: Don Cash For Councilman for the 3rd Ward: Calvin Williams For Councilman for the 4th Ward: J. Leroy Evans Canvassing of the votes in -the office of Mayor.is hereby deferred pending recount. The City Council of the City of Beaumont further finds that notice of said election was duly and properly given as required by law and pro- vided in the ordinance calling for said election, and that said election was duly and regularly held and returns thereof were duly and regularly made by the proper officials of said election and in all things according to law. Section 2. That in accordance with the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the 17th day of April, 1976, a run- off election for the purpose of electing an officer for the office of Councilman from the 2nd Ward. -2- That legally qualified voters residing within the corporate limits within the City of Beaumont shall be entitled to a vote at said election. Section 4. That said election shall be held in the City of Beaumont at the following places and the following named persons appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks, to -wit: (See Exhibit "A") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct, who shall be selected from different policital parties when practicable. Section 5. That said election shall be held under, and the qualifications of those voting thereat shall be controlled by, the provisions of the State Laws governing elections. The form of ballot which shall be used in said Run -Off Election shall be substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS APRIL 17, 1976 0 FOR COUNCILMAN [XARD NO. 2 (Vote for One) Section 7. In accordance with the provisions of the laws of the State of Texas, Myrtle Corgey is hereby appointed Presiding Judge of the Central Counting Station, Tom Lawrence is hereby appointed Manager of said Central Counting Station, and Raymond McInnis is hereby appointed Computer Coordinator. -3- Section 8. In accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for voting on the day of election and also for the casting, of absentee votes by personal appearance at the City Clerk's Office. In accordance with the provisions of the laws of the State of Texas, absentee votes by mail shall be counted by a special canvassing board, which shall be composed of E. A. Adams. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. That all ordinances and parts of ordinances in conflict herewith are hereby repealed.
