ORDINANCE NO ,
ENTITLED AN ORDINANCE PROHIBITING THE DISCHARGING
OF CERTAIN GUNS AND SPRING DEVICES IN THE CITY;
PROVIDING EXCEPTIONS; PROVIDING FOR THE PRACTICE
OF THE SPORT OF ARCHERY UNDER CERTAIN LIMITATIONS;
PROVIDING FOR REPEAL; PROVIDING FOR SEVERABILITY;
AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 23 of the Code of Ordinances of the City of Beaumont,
Texas, be and the same is hereby amended by enacting a new Section 23-28,
which section repeals the old Section 23-28, said new section to read as
follows:
It shall be unlawful for any person to discharge gravel, marbles,
shot or any projectile,missile, object or material out of a gravel shooter,
blow gun, air gun, rubber sling, or compressed gas, compressed air or
spring device; provided however, that the section shall not be construed
to prevent the use of a compressed air device for the delivery of handbills,
circulars or newspapers; and provided that the section shall not apply to
the sport of archery when it is practiced on the property of the partici-
pant or on property upon which the participant has permission to practice
archery. It shall, however, be unlawful for any person to propel an arrow
or any other projectile used in the sport of archery onto the property of
another who has not given permission to the participant to propel an arrow
or other projectile onto or over his property.
Section 2.
That if any section, subsection, sentence, clause or phrase of this
ordinance, or the application of same to a particular set of persons or
circumstances, should for any reason be held to be invalid, such invalidity
shall in no wise affect the remaining portions of this ordinance, and to
such end the various portions and provisions of this ordinance are declared
to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4.
Any person who violates any provision of this ordinance shall, upon
conviction, be punished as provided in Section 1-8 of the Code of Ordinances
of Beaumont, Texas.
