HomeMy WebLinkAboutORD 76-22F\•- 4-: ORDINANCE NO. 76—Z2 ENTITLED AN ORDINANCE ORDERING THE GENERAL MUNI- CIPAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 3RD DAY OF APRIL, 1976, AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT, AND THE STATUTES OF THE STATE OF TEXAS, FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR COUNCILMEN; NAMING THE PRECINCTS AT WHICH ELECTION SHALL BE HELD, AP- POINTING OFFICERS TO PRESIDE OVER SAID ELECTION• APPOINTING A CANVASSING BOARD FOR ABSENTEE V G; \P APPOINTING A MANAGER AND JUDGE OF THE CENT �X COUNTING STATIONS; PROVIDING A MANNER OF ING SAID ELECTION; PROVIDING FOR NOTICE F; PRO- ( VIDING FOR A JOINT ELECTION WITH THE UMONT IN- DEPENDENT SCHOOL DISTRICT; AND PROVID G FOR SEVERABILITY. WHEREAS, under the provisions of the ity Charter of the City of t and the laws of the State of Texas relating thereto, a regular municipal election is required 1 3rd, 1976. The election sha7 Councilman for Ward Two, Four; That in NOW, City of Beaumont and be held in the City of Beaumont be for Mayor, Councilman for Ward One, Ward Three, and Councilman for Ward , BE IT ORDAINED BY THE OF BEAUMONT, TEXAS: with the provisions of the City Charter of the laws of the State of Texas relating thereto, there shall be held in th6 City of Beaumont on April 3rd, 1976, the regular municipal election for said/ City for the purpose of electing a Mayor, a Councilman for Ward One, a CoLiAcilman for Ward Two, a Councilman for Ward Three, and a Council- man for Ward our for said City. Section 2. at legally. qualified voters presiding within the corporate limits within the City of Beaumont shall be entitled to a vote at said election. Section 3. That said election shall be held in the City of Beaumont at the places as listed in Exhibit "A" attached hereto and made a part hereof for all purposes and the persons whose names appear in Exhibit "B" attached hereto and made a part hereof for all purposes are appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks. (See Exhibits "A" and "B") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct, who shall be selected from different po- litical parties when practicable. Section 4. That said election shall be held under, and the qualifications of those voting thereat, shall be controlled by the provisions of the State Laws governing elections. That notice of said election shall be given by publishing said notice together with a copy of this ordinance in a newspaper of general circulation in this city and county one time, not more than twenty-five (25) days or less than.ten (10) days before said election. Said notice shall be in the following form: "NOTICE OF THE GENERAL MUNICIPAL ELECTION IN THE CITY OF BEAUMONT FOR THE PURPOSE OF ELECTING A. IVMOR AND FOUR COUNCILMEN." "Notice is hereby given that the General Municipal Election as provided by the Charter of'the City of Beaumont and the statutes of the State of Texas will be held in the City of Beaumont, Texas, on the 3rd day of April, 1976, from,7:00 A.M. to 7:00 P.M., for the purpose of electing a Mayor and four Councilmen. One) FOR COUNCILMAN, WARD III (Vote for One) FOR COUNCILMAN, �,MRD IV (Vote for One) . cora-; r - '7 In accordance with the provisions of the laws of the State of Texas, Myrtle Corgey is hereby appointed Presiding Judge of the Central Counting Station and Tom Lawrence is hereby appointed Manager of said Central Counting Station. (A) That in accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for voting on the day of election and also for the casting of absentee votes by personal appearance at this election. (B) In accordance with Article 5.05, V.A.T.S. Election Code, Myrtle Corgey is hereby appointed clerk for Absentee Voting and Archie D. Rogers and Beverly G. Watts are hereby appointed Deputy Clerks to assist in the conduct of the absentee voting. The places and hours for absentee voting shall be as follows: (1) Beaumont Independent School District School Administration Building, 820 Neches Street, Beaumont, Texas, at which the hours for ab - 29z -'x sentee voting shall be from 8:00 o'clock a.m. to 4:30 o'clock p.m. on Monday through Thursday and 8:00 o'clock a.m. to 4:00 o'clock p.m. on Friday. (2) City Clerk's Office, City Hall, Beaumont, Texas, at which the hours for absentee voting shall be from 8:00 o'clock a.m. to 5:00 o'clock p.m. on Monday through Friday. The Clerk for Absentee Voting shall keep her offices at said lo- cations open during such hours on each day for absentee voting which is not a Saturday, a Sunday or an official State holiday. The City Clerk's Office, City Hall, Beaumont, Texas, shall be the Clerk's mailing address to which ballot applications and ballots voted -by mail may be sent. (C) Absentee votes by mail shall be counted by a special canvassing board consisting of a Presiding Judge and two Clerks. E. A. Adams is hereby appointed Presiding Judge of the special canvassing board and he shall appoint the two clerks. This election shall be held jointly with the Trustee Election to be held by the Beaumont Independent School District, in the election precincts set forth in the election order of the Beaumont Independent School District attached hereto as Exhibit "C" and made a part hereof for all purposes, in ac- cordance with the following terms of agreement between Beaumont Independent School District and the City of Beaumont: (A) The expenses of the election within joint precincts shall be divided with the City of Beaumont paying that part of said expenses represented by a ratio of the number of voters voting in the Municipal Election to the total number of voters voting in both the School District and the Municipal Election in said joint precincts. -4- (B) A single ballot form shall be used which shall contain the Mayor and Council positions to be voted upon as well as the offices and propositions required by the School District. (C) The above named election officers shall conduct both elections in said election precincts. (D) Records for both elections shall be combined. (E) One set of ballot boxes and stub boxes for both elections shall be used. (F) Election returns shall be made on joint forms but the City Council of the City of Beaumont shall canvass the returns of the General Municipal Election. (G) The City Clerk of the City of Beaumont is designated custodian of all the records and of the voted ballots. Section 10. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. McMillan Alternate Presiding Judge e L1VWTnTm 'In" ELECTION ORDER AND NOTICE THE STATE OF TEXAS COUNTY OF JEFFERSON On this the 17th day of February, 1976, the Board of Trustees of the Beaumont Independent School District convened in special session (proper notice thereof having been given and posted pursuant to pertinent statute of the State of Texas), open to the public, with the following members present, to -wit: Vice President Secretary and the following absent: ..President constituting a quorum, and among other proceedings had by said Board. of Trustees was the following Order, to -wit: WHEREAS, the.term of office of Morris Cloninger, Murry J. Frank and Henry C. Hendrix, members of the Board of Trustees of this School District, will expire on the first Saturday in April, 1976, said first Saturday being April 3, 1976; and, WHEREAS, on said date of April 3, 1976, a Trustee election will be held in said School District; and, WHEREAS, it is necessary for this Board to pass an order establishing.the procedure for filing for and conducting said Trustee election; THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF THE BEAUMONT INDEPENDENT SCHOOL DISTRICT OF JEFFERSON COUNTY, TEXAS: 1. That an election shall be held in said School District on April 3, 1976,for the purpose of: Electing to the Board of Trustees of said School District two (2) Trustees for a term of three (3)- years and one (1) Trustee for a term of two (2) years (as provided in the Education Code and the Election Code of this State) in obedience to this order duly entered by the Board of Trustees of said District on the 17th day of February, 1976 2. (A) That all requests by candidates to have their names placed upon the ballot for the above mentioned election shall be in writing and signed by the candidate, and shall be filed with the Secretary of the Board of.Trustees.at the Superintendent's office not later than thirty (30) days prior to the date of said election.. (B) All candidates shall file with said application the ..loyalty affidavit required by Article 6.02,.V.A.T.S." Election Code. (C) The,Secretary of this Board of Trustees shall post on. the bulletin board in the building where the Board of Trustees meets the names of all candidates that have filed their application in accordance with the terms and provisions of this Order, and said .Secretary -shall otherwise comply with the terms and provisions. of Article 13.32, V.A.T.S, Election .Code. 3. That the election precincts set forth on'the. attached Exhibit "A" are hereby established for said election. 4: (A) That the polling places set forth on the.attached Exhibit "B" are designated for said election, and the said election shall be held at said places, and the persons named on the attached Exhibit "B" are appointed Presiding Judges and Alternate Presiding Judges for their respective voting,boxes.. (B) The polls at the said designated polling places shall be open on election day from 7:00 o'clock a.m. to 7:00 o'clock p.m. (C) The Presiding Judge for each election precinct shall appoint two clerks, and as many additional clerks as he deems necessary for the proper conduct of the election, provided that,. not more than a total of five clerks.shall be appointed for any precinct. If the regularly appointed Presiding -Judge conducts the election, he shall appoint the Alternate Presiding Judge as one of. the clerks to serve at such election. -2- (A) The electronic voting system adopted by the Commissioners Court of Jefferson County, Texas, for use in elections in Jefferson County, Texas, shall be used for voting in all of the Election Precincts on the day of this election and for absentee voting by personal appearance at this election. : (B) In accordance with Article 5.05, V.A.T.S: Election . The manner of holding said election and the qualifications of those voting thereat shall be governed by the.Election Code of this State. This election shall be held jointly with the General Municipal Election.to be held by The City of Beaumont, Texas, in the above set forth -.election precincts in accordance with the following terms of agreement between Beaumont- Independent School District and The City of Beaumont, Texas: (A) The expenses of the election within said precincts shall be divided with the School District paying that part of said expenses represented by a ratio of the number of voters voting in the School District election to the total number.of voters voting in both the School -District and City elections in said precincts. (F) Election returns shall be made on joint forms but the Board of Trustees of Beaumont Independent School District shall canvass the returns for the School. -District election. (G) The City Clerk of The City of Beaumont is designated custodian of all the records and of the voted ballots. . 8. (A) The Board of Trustees shall give notice of said election and this combined'Election Order and Notice shall -serve as Notice for said election. The President of the Board of Trustees is hereby authorized and instructed to post or cause to have posted said combined Election Order and Notice at three public places where notices are customarily posted in this school district, and said posting shall be made at least 20 days before the date of said election. (B) The President shall also cause a copy of this combined Election Order and Notice to be published one time in a newspaper of general circulation in the county where this school district is located. Said publication shall be not more than 30 days nor less; than 10 days before the date of said election. M (A) Further, the Board of Trustees finds that,.in accor- dance with the order of the Board of Trustees, the Secretary posted written notice of the date, place and subject of this meeting on the bulletin board at the main entrance of the Beaumont Independent School District School Administration,Building, 820 Neches Street, Beaumont, Jefferson Couty,. Texas, a place convenient to the public, -and said notice having been so posted, remained posted continuously for at least seventy-two.(72) hours preceding the date of this meeting. ■) (B) Further, the Board of Trustees finds that this district is located in Jefferson County, Texas, and that written notice of the date, place and subject matter of this meeting was. furnished to the County Clerk of Jefferson County, Texas, that said notice was posted by the said County Clerk on the bulletin board on the first floor of the Jefferson County Courthouse, Beaumont, Texas, a place convenient to the public in the County Courthouse, at least seventy-two (72) hours preceding.the date of this meeting and was not removed until after adjournment of this meeting. The returns of said posting shall be attached'to the minutes of this meeting and shall be a part thereof for all intents and purposes. The above order being read, it was moved and seconded that the same do pass.. All persons legally qualified to vote at said election residing within Jefferson County Voting Precinct No. 1, which lies entirely within the boundaries of the Beaumont Independent School District, shall vote in the Edwards School Election Precinct. The description of the area within Jefferson County Voting Precinct No. 1 is hereby referred to for a description of the area within Edwards School Election Precinct. (B) French High School: Election Precinct. All persons legally qualified to vote at said election residing within Jefferson County Voting Precinct No. 2, which lies entirely within the boundaries of the Beaumont. Independent School District, shall vote in the French High School Election Precinct. The description of the area within Jefferson County Voting Precinct No. 2 is hereby referred to for a description of the area within French High School Election Precinct. (C) Technical Center (formerly School for the Deaf) Elec-. tion Precinct.
