HomeMy WebLinkAboutORD 76-012ORDINANCE NO. 1 - ENTITLED AN ORDINANCE AUTHORIZING THE OPERATION OF MINI -BIKES AND MOTORCYCLES ON A PORTION OF MULTIMAX VILLAGE; PROVIDING REQUIREMEN'T'S AND LIMITATIONS ON. SAID OPERATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. There is hereby added to Chapter 37 of the Code of Ordinances of the City. of Beaumont a new Section 37-81.2 said,Section 37-81.2 to read as follows: 37-81.2 A portion of the. property known as Multimax Village, bounded by the service road of Interstate 10, St. Helena Street, Caldwell Street, and a line parallel to and 644 feet east of St. Helena. Street is hereby desig- nated for use by two -wheel mini -bikes and motorcycles of less than 100 c.c. displacement during daylight hours under the following limitations: (a) Only persons under the age of 15 years may ride mini -bikes and motorcycles on said property. (b) All riders are required to wear a helmet that is approved by the Department of Public Safety of the State of Texas. (c) All mini -bikes and motorcycles shall be equipped with an adequate muffler. (d) All riders must be accompanied and continuously supervised by'a person 18 years of age or older. (e) All mini -bikes and -motorcycles shall be -transported to the premises in a licensed and registered vehicle. (f) No.mini-bike or motorcycle operated on the premises shall be registered by the:State for operation on public roads and highways. -71 -76 r The designation of this property is made temporarily, only, and no intent to establish the herein described area as a park is intended by the City of Beaumont. Said property shall not be used for any park purposes, and is specifically not designated as a park. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such in- validity shall in no wise affect the remaining portions of..this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances ofBeatmaont; Texas.
