ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING SUBSECTIONS (A)III(1) AND
(A)IV OF SECTION 42-16.1 OF CHAPTER 42 OF THE CODE OF
ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, PROVIDING FOR.
A RESTRICTION ON THE SALE OF ALCOHOLIC BEVERAGES; PROVIDING
FOR INDOOR RECREATIONAL USES; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 42 of the Code of Ordinances of the City of Beaumont
be amended by adding thereto a new Subsection (A)III(1) of Section 42-16.1
to read as follows:
(A)III(1). Restaurant (all normal services allowed), providing
that the term "restaurant" as used herein shall mean
a business that regularly serves food to customers,
and providing further that the sale of alcoholic
beverages shall be permissable under this subsection
only as an adjunct to the regular service of food.
and by adding a new Subsection (SIV of Section 42-16.1 to read as follows:.
(A)IV. Recreation
(a) Indoor recreational uses, such as bowling alleys,
theaters for the performing arts and for motion pic-
tures, swimming pools, tennis courts, family and senior
citizens' recreation centers, and other similar.enter-
tainment.type uses.
Section 2.
That if any. section, subsection, sentence, clause or. phrase of this
ordinance or the application of same to a particular set of persons or circum-
stances should for any reason be held to be invalid, such invalidity shall in
no wise affect the remaining portions of this ordinance, and to such end the
provisions of this ordinance are declared to be severable.
Section 3.
That all ordinances and parts of ordinances in conflict herewith are
hereby repealed.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the
day of 1975.
