HomeMy WebLinkAboutORD 75-36Or:�� /3 19 } ORDINANCE NO. 5_ - ENTITLED AN ORDINANCE AMENDING CHAPTER 32A OF THE CODE OF ORDINANCES OF.THE CITY OF BEAUMONT BY ADDING A NEW SECTION, PROVIDING A METHOD OF COST RECOVERY FROM INDUSTRIAL USERS FOR THE CONSTRUCTION COST OF SANITARY SEWER LINES; PRO- VIDING FOR PAYMENT; PROVIDING FOR SEVERABILITY; :AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. Chapter 32A of the Code of Ordinances of the City of Beaumont, Texas, is hereby amended by adding a new Section 32A-2.1, said section to read as follows: 32A-2.1: Industrial Cost Recovery. A. City shall require a signed letter of in- tent of all significant industrial users of the sanitary sewerage system constructed in the City of Beaumont with the aid of federal funds after March 1, 1973, said letter of intent in- dicating the intent of that significant indus- trial user to pay that portion of the federal grant amount allocable to its industrial waste discharge. A significant industrial user is one that will contribute greater than 100 of the designed flow or designed pollutant load- ing of the treatment works. Such letters of intent shall also ind de a statement of the period of the industrial users intended use of the proposed facilities. B. All industrial users discharging industrial waste into the sanitary sewerage system con- structed after March 1, 1973 with the use of any federal funds shall make annual payments to the City during the industrial cost recovery period. Each industrial user shall pay its in- dividual share of the grant amount received by the City divided by the industrial cost recovery period for that industrial user. Each indus- trial user's share shall be calculated from the following formula: I. Sanitary Sewer Lines and Pump Stations A=[ F -( B+C)] X E+ G 30 Years H Where: A = annual payment by individual user B = annual cost of improvements attributable to non- industrial users C = annual cost of improvements attributable to ,capacity E = volume of industrial waste discharged by industrial user F = amount of Federal grant G = capacity reserved by industrial user H = volume of industrial waste discharged to improvements by all industrial users 2. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such inva- lidity shall in no wise affect the remaining portions of this ordinance, and to such end the provisions of this ordinance are declared to be-sever- able. e-sever- able. 3. That all ordinances and parts of ordinances in conflict herewith are hereby repealed.
