HomeMy WebLinkAboutORD 75-25LLJ/cb 4/7/75 0 523-Z j © ! - -:11:5- ORDINANCE N0. 75-,Z,j ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE ZONING CLASSIFICATION OF TWO (2) TRACTS OF LAND OUT OF THE W. B. DYCHES SURVEY IN THE CITY OF BEAUMONT, COUNTY OF JEFFERSON, STATE OF TEXAS, ACCORDING TO THE MAP OR PLAT OF SAID SURVEY ON FILE IN THE OFFICE OF THE COUNTY CLERK OF JEFFERSON COUNTY, TEXAS, PRESENTLY ZONED "R-lA" TO "LR -111; PRO- VIDING FOR SEVERABILITY: AND PROVIDING FOR PENALTY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 42 of the Code o-� Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tracts of land, presently zoned "R-lA", Single Family Residential, to "LR -1", Local Retail District, to wit: TRACT I All that certain tract or parcel of land, lying and being situated in the.County of Jefferson, State of Texas, described as follows, to -wit: A portion of the C. R. Buckner Homestead Tract in the W. B. Dyches Survey, and beginning at a point in the South line of State Highway No. 105 located South 89°29', West 452.8 feet from the West line of Dowlen Road, in the City of Beaumont, Texas; THENCE continuing South 89°29' West along the South line of said State Highway No. 105, a distance of 179.1 feet to a point for corner; THENCE South 0°26' East a distance of 490.1 feet to a point for corner in the South line of said C. R. Buckner Homestead Tract; THENCE South 89°56' East along the South line o.f said C. R. Buckner Homestead Tract, 201 feet to a point.for corner; THENCE North 2°59' West, 492.5 feet to the PLACE OF BEGINNING, containing 2.142 acres, more or less. j TRACT II A parcel or tract of land out of the W. B. Dyches and A..Durve Surveys in Jefferson County, Texas, described as follows, to -wit: BEGINNING South 46°44' East 145.4 feet from the Northwest corner of a tract of land conveyed by T. L. Treadaway, et al, to A. G. Murff and wife, by deed recorded in Volume 546, Page 436 of the Deed Records of Jefferson County, Texas, to which deed and record reference is hereby made; THENCE South 3°6 1/2' East 392.5 feet to the South corner of said tract conveyed by T. L. Treadaway, et al, to A. G. Murff, et ux; THENCE East 150'feet, that being the Southwest corner of a tract of land conveyed by David W. King, et ux, to Mrs. Anna Winkler by deed dated January 23, 1948 of record in Volume 690, Page 79 of the Deed Records; THENCE North 0° 46' East along the West line of said Winkler tract 493.24 feet to the Northwest corner of said Winkler tract, same being in the South right of way line of Highway 105; THENCE South 89°29' West 170 feet to the East corner of a tract conveyed by A. G. Murff and wife, to Mrs. Frances E. Buckner, by deed dated October 20, 19451, recorded in Volume 595, Page 232 of said Deed Records; THENCE South 3°6 1/2' East along the East line of the last mentioned tract conveyed to,Mrs. Buckner, 100.6 feet to the point of beginning, containing 1.7891 acres of land, more or less, and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property here- inabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. -2- Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
