ORDINANCE NO. o ENTITLED AN ORDINANCE RECOGNIZING LOCAL NO. 491 OF THE INTERNATIONAL BROTHERHOOD OF POLICE OFFI- CERS AS THE BARGAINING AGENT FOR THE .POLICE OFFI- CERS IN THE BEAUMONT POLICE DEPARTMENT; DESIGNA- TING A REPRESENTATIVE OF THE CITY OF BEAUMONT TO BARGAIN WITH THE REPRESENTATIVE OF THE POLICE OF- FICERS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. WHEREAS, at an election held May 14, 1974, the voters of the City of Beaumont approved adoption by the City of the Fire and Police Employees Relations Act, Article 5154c-1 of the Revised Civil Statutes of Texas; and, WHEREAS, by Ordinance No. 0-74-67, dated October 22, 1974, the City Council placed into effect in the City the provisions of the Fire and Police Employees Relations Act; and, WHEREAS, a representational election in accordance with Section 6 of the Act was held February 20, 1975, and a majority of the paid police officers of the Police Department of the City of Beaumont selected Local No. 491 of the International Brotherhood of Police Officers as the sole and exclusive bargaining agent for all of the police officers of the Beaumont Police Department; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. That Local No. 491 of the International Brotherhood of Police Officers is recognized as the sole and exclusive bargaining agent of the police officers of the Beaumont Police Department. 2. That the City Manager or his designee is appointed to bargain on behalf of the City of Beaumont with the representative of the police officers. 3. That upon appointment of a designee to bargain with the police officers, the City Manager is instructed to notify Local No. 491 of the appointment, and thereupon the City Manager or his designee is directed to bargain in good faith with the representative of the police officers in accordance with the Fire and Police Employees Relations Act. 4. That no other person other than the City Manager .or his designee shall be authorized to represent the City in collective bargaining nego- tiations with the representative of the police officers. 5. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such inva- lidity shall in no wise affect the remaining portions of this ordinance, and to such end the provisions of this ordinance are declared to be sever- able.
