Code 'of Ordinances of. the City of Beaunont. -BE IT ORJDASNM) BY THE CI`T'Y COUNCIL OF THE 'CITY OF BEAT,Ji+SONT: Section 1, That Articles 880 to 887, inclusive, of the Revised Code of Ordinances of the City of Beaumont are hereby amended so they shall hereafter read as- f ollows: Artic-le 880. It shall b e unl awful for the owner or keep Or of .any' dog o r bi tch_1 to p ermit the same to run at 1 arge in arW street, alley or other public highway or, public grounds in the City of Beaumont, unless said dog or bitch shall have been licers ed, and. wear a ta-g as provided in Article 882, Article 881. It Shall also be unlawful under arty con- sideration for the owner or keeper of any vicious dog or bitch or proud bitch to allow it -to run at large in the streets, alleys highways and public places, Article 882. The Chief of Police shall pro vi de and keep a book of blank licenses, numbered in consecutive order, to be issued to persons who demand same, which lac ense shall -state the name and residence of the person to.whom it is issued, the date of i ssuance, a descriP#on of the dog or bitch licensed, the place where usually kept, and the amount of 1 -tense fee paid there- for* A. mem'braindura of sach license shall be kept on the marginal stub in such bo=ok. The Chief of Police shall also provide and issue with each .li,c ense a metallic tag, to be attached to the dog or bitch licensed, bearing a number corresponding to the license, and also the year for .which it is issued. The, license fee to be collected by the Chief of Police shall be '4.2.00 for each male dog or spayed " bi tch and 05.00 for each bitch. Provided however, that no license shall .be issued for a spayed bitch for ��9,00 uhl eas the applicant shall furnish to the Chief of Police a cer-. tificate for a --veterinarian that the said bitch has been sp4d by him. i X20 Licenses issued hereunder shall be in force for one year, said year t o run from June 1st, to June 1st, thereafter, beginning v. th June lst, 1911. Provided, that in case the possessor of any license and tag wishes to ,use said tag on arty other dog or bitch not as des'cri'li d in the license as above provided, he may do so if he previously gives written notice to the. Chief of Police of same and a' de scri-pt ion , of the dog or bitch which he intends to place the, tag on. Provided further, ary owner or keeper of a dog or "bitch may on filing; an affidavit with the Chief of Police, that the tag .furni dhed him at the time he secured his license has been los t and he does not know where same is, be en- titled to receive another tag- upon the payment .of a fee of .50�, - provided, that any person who shall use a tag on any dog or bitch without securing same from the Chief of Police shall be guilty of a mi sdem anon, and b e fined in a mm as gal ided in Article 887. Article 883. The Chief of Police aha ll designate one or, more policemen, whose duty it shall be, til th such assis- tance asmay be provided, to., capture, take charge t and place in the public dog pound --to be delected by -the Mayor ani Chief of Police --all dogs and bitches found running at large in ary street, alley or other highway and public grounds, unless said dog or bitch shall have been licensed aixi also wear a tag as described in Article 882 of the Revised Code of Ordinances of the City of Beaumont. In case the owner or ' e eper of any dog or bitch should fail v_ithin 24 hours to redeem, such dog or bitch, the Chief of Police shall, advertise such animal for sale by posting three notices of said sale, one of which shall be placed gat the Court House, one at' the Police Station and one at the United states Post Offices. --- Said sale to be held not earlier than 48 hours after posti'rig of said notice. The notice shall give a. good description of the .dog or bi tch, and the time and place of sale; and, unless said dog or bitch is redeem d be fore the time det for said 'sale, the dog or bitch shall .be sold to the highest bidder* 3. Provided, if no sale can be made of the dog or bitch, the Chief of Police shall have sate killed, Article 884,XTf within a 1v riod of three days after the capture of ai ,dog or biteb. th,e owner or keeper of same may wish to redeem it, he can do -so by paying to the Chief of Polk a the sten of $2.M@ as a p enalty, and if said cb g or bitch has not been licensed as required in article '882 , the said ovmer or keeper shall also be required to secure a license for said m inial. Provided that if the said dog or bitch captured shall have be en licen sed, then th e Chi of of Police shall colla ct from the owner or keeper of the dog or bitch captured the sum of 50cents as a penalty, but if the owner or leper makes an affidavit that said tag is lost and he does not know where it is the Chief of Police shall issue him a re w one as provided in Article 882, and he shall not be Iiable for the 50 cents 'peria.lty as_above provided'in this ar- ticle, Article 885, All movie s toll, ected by the Chi of o f P olir• e under this ordinance.,shall be paid over to the City Treasurer in the manner designated by the City Cotur il. Artic2.e 886, The excess of all monies derived from the sale of a.ry dog --or bitch shall be placed by -the City Treasurer in a separate and -distinct account and if %ithin a period of 12 montlis after the sale t;s provided in Article 883, the owner or keeper can satisfactorily prove to the City Council that said dog or bitch was his, the City Counil shall order the City Secre- ta ry t o draw watrant on said fund for .such excess. And i r_ case no person shall establish a clai.rn within 12 months after ary sale the said excess sh-all, be and become the property of the City. Article 887. Any person who shall violate ai y of the preceeding articles of this chapter relative to dogs and bitches shall be fined,in_-ary sum not less than 45.00 nor more than $50.00. 4, Section 2,, This'; ordina me shall take effect and be in full force and effect from and after it s passage, approval by the Mayor and 1 awful -publication.
