SECTION I.
That the Beaumont Wharf &.Terninal.Company, in its own right,
and right .of its successors -and assigns, is hereby granted the right of
way for and authority to lay, conttruct, ocan, mai�itain and operate its
railroad and railroad tracks over, upon and across the following public
streets, allies and highways within the corporate limits of the City of
Beaumont a: follows, to -wit:
(a) On, over and across Archie avenue, beginning at the south
corner of Block twenty-Pn E(21) in the Van Wormer Addition to the City
of Beaumont, thence southward at right angles to the street line across
said Archie avenue to the east corner of block twenty one(21), in said
Van Wormer Addition.
(b) On, over and"across Holmes avenue,'beginning at -the south
corner of block twenty-one (21) in the Van C"ormer Addition to the City
of Beaumont, thence sout'v�ard. at right angles to the' -street line across
Holmes avenue to the east corner of block twenty-two . (22) in said Van.
Wormer Addition, as shown, by the map hereto attached, marked "E:-hibit All
and made a part hereof.
SECTION II.
The obligation "i -s- hereby imposed- upon said - Beaumont Gh.1arf
•Terninal Co., its successors and assigns, to surface said tracks laid,and
constructed on, over and across said streets, to grade to the level: of
the said streets with sand, crushed rock, shell, brick or other suitable
material as the City Council may require and direct from time to time;
and in the event that -at any time the city may undertake to construct
public• servers underground, intersecting -.-R- such tra o . tracks the
Beaumont Wharf &; Terminal Co. binds itself, . and it'' obligated to
pay.for so much of said sewerage that underlies such track or tracks,
intersected by such public-seviers, and the said Beaumont I"lharf &
Terminal Co. likewise shall be liable to construct,,build-and maintain
such ditches and culverts as may be directed by the City Council, to
properly drain such portion of said streets occupied by the Beaumont
Wharf &. Terminal Ca, and to d'o and perform all and every act and thing::,
required by the charter of the City of Beaumont and the ordinances duly
passed by the City Council, regulating the laying, constructing and
maintaining railroad tracks in the said City�of Beaumont.

SECTION III..
The rights, authority and privileges hereby ordained and
granted to the Beaumont Wharf & Terminal Go..', its successors and as-
signs, shall subsist and be vested in said Company, its successors and
assigns fora period of fifty , (50) years from the datre of its final
passage by the City Council.The said, Beaumont Rharf & Terminad. Co.
shall within thirty days of the final passage. of this ordinance -file
with the City of Beaumont an instrument.in.waiting, accepting the bene-
fits of this ordinance upon and subject to the terms thereof.
SECTION IV.
The provisions of this ordinance shall take effect and be in
force subject to the conditions thereof from and after its final passage
and acceptance:
