BE IT ORDAINED BY THE CITY COUNCIL -.OF THE CITY OF BEAUMONT: Section 1. That all vehbles shall keep to the right of the center line of the street, and as near the right hand curb, as prac- ticable. Section 2. Al'. vehicles shall keep close to the curb on the right, provided that a vehicle overtaking �nother shall go the left of the overtaken vehicle in passing, but it shall not turn out to -the left unless there is a clear way -_of at_ Ilii _ ed feet ahead on the left, free.. Section 3.: All vehicles turning to the right into another street shall turn the corner as near As practicatie to the curb. Section 4. All vehicles turning to the. left into -another street shall pass totheright of, and beyond the -center of, the street in- .tersection before turning. Section 5.. All vehicles crossing from.one side of the street to the other shall do so by turning to the left, so as to head the same direction as the traffic on that side of the street. li .p 4 -fir Section 6. No vehicle shall s=top with its left side to )the curb, and all vehicles when stopped shall stand parallel to the curb. Section. 7. No vehicle shall stand backed up to the curb, except when actually, loading or unloading; and when a horse drawn vehicle is backed. up to the curb, the horse or horses shall be turned so as to stand parallel with the curb and headed in the general direction of travel for the side of the street on which the vehicle is standing. Section 8. Unless in an emergency, or to,allow another vehicle or pedestrian to cross its path, no vehicle shall stop and stand in any public street or highway in the .City of Beaumont, except close to'the curb line, and not over twelve.(12) inches there$vm. Section 0.9. No vehicles shall stop for the.purpose of taking up or setting down a passenger,,or loading or unloading, or for any other purpose, except,in the case of an emergency, in such a way as to obstruct any'street crossing. Section lU:• No vehicle shall stop and stand within the intersection of any two streetz. Section 11. Street cars.shall stop on the far side of the street at the crossing to dischar-e or.receive passengers. Section 12.'. -When an authmobile, other motor vehicle or any other character of vehicle whatsoever approaches a street car which has stopped for the purpose of permitting persons to alight therefrom or get upon said street car, the said automobile, motor vehicle, or other .vehicle, s_aall.immed iately slow down and pass said street car slowly and in a very cautious manner; and in turning any corner where cars are stationary for'the 9 purpose -of receiving or -discharging passengers, no such automobile, motor vehicle or other vehicle shall travel at.any speed that -may endanger persons alighting from or desirous of entering said street caar,.which shall be considered reckless driving, and a violation of this ordinance. Section 13. On 411 public streets and highways of the City of Beaumont, all vehicles going in a northerly or southerly direction shall have the right of way over those going in an easterly or westerly direction. ,Provided, that officers and members of the Fire Department, with their fire apparatus, when going to, or on duty at or returning from a fire, and'all officers or men and -vehicles of the Police Department and. all amUnlances when ' answering emergency calls,' shall always have the right of way'in any street and through any Procession. Street cars shall have the.right. of.way on their tracks between street inter- sections,'and persons drivin6 vehicles on the street car tracks shall immediately turnout on signal.given by the -.motorman. Section '140' It shall.be unlawful for any vehicle operated on the streets or ways of the City of Beaumont to go at a speed greater than that indicated as follows: Beginning at a point where the north line of _Pdulberry- Street meets the river; Thence west with the north boundary line of said street to the east line of Plain Street. ° Thence with the East line of Main Street',to the intersection of the said line and the North line of Calder Avenue. Thenc6LWest on ,the North line of Calder Avenue to the inter- section of the West line of Magnolia, Avenue. Thence southward on the We^t line of Magnolia Avenue and across the railroad yards of the T. & N. 0• Railway Company to the .south line of Bonham Street; Thence westward on the North line. of Bonham Street to the Nest line of Railroad Avenue; Thence Southward on the !lest line of -Railroad Avonue to the Southline of College Street Thence eastward.on the'South line of College Street to the ?Vest line of Orleans Street. Thence southward on- the west line, of Orleans Street to the River; Thence up the river to the place of beginning. Also in any cemetery or place of'burial in the said City, and.also within any public park within said.Cit y;.the speed limit shall not,exceed eight miles per hour. Jn other.portions of said City, the speed limit shall not exceed 15 mikes per hour, provided that -in turning any corner at any place within the City'.. limits, the speed shall not -excwi.one half of the legal speed rate upon such street, provided further that no person in charge, of any- uehicle on..any public street orway within the City of Beaumont, shall dlrve same' at'any speed greater than is reason- able and proper and vri.th,-.due regard to. the .traffic and use of the public streets or so as-t,o endanger the life, limb or property of persons thereon. Provided that nothing in this section shall apply to .the Fire .Department: and Police Department of the.'City of Beaumont nor to dirvers of amhulances when ansewering emergency.,calls. Sedtion 15. Every automobile' -shall between -hour after sun set and one hour before, sun rise carry two lights, one on each side, of at least four (4) candle;pOwer; to be set in front of a reflector, and one light on the rear left corner,of vehicle, which latter light shall throw a white light on the number of such vehicle and a red light to the rear. Every bicz .e --or motor cycle shall carry a'white'light in front of at'le'ast tvo,(2•) candle power and onelight in the rear of such bicycle or motor -cycle of not less than two (2) candle power, which light shall 'throw a white ,light on the number of such vehicle and a red light to the rear and every other vehicle shall carry one or more lights in front or on sides so as to be plainly visible at not less than fifth (50) feet: .,Provided that the above provision'shall- not apply when said vehicles are left standing on any street which is lighted -r- sufficiently so that the said vehicle could.be easily seen at a dis- tance of.three hundred feet. Section 16. It shall be unlawful for any person to drive or pro= pel:any vehicle upon any sidewalk; or to..allow any,vthicle driven or propelled by him or her to stand upon any sidewalk. Section 17. It shall be unlawful.for any person in charge of any . horse or other domestic animal to tie or hitch such horse or other ani- mal to' any fire plug,, United States mail box post, .(jr'awning post. Section 18. It shall be unlawful for any person in charge of any ',vehicle or domestic animal to allow -said vehicle or animal to remain standing for a longer period of time than 'thi'rty (30) minutes upon Pearl Street between Cedar and'College Streets in the City.'of Beaumont. Secti on 19'. Every driver of a vehicle:s}all,,before slowing up or 'stopping, give .a signal to those behind by the; voice 6r.by the raising` of the hand. - Section 20. Before backing a vehicle ;to --unload; or load, ample warning shall be'given by voice or by the ±aising of the hand, so as to prevent injury.to those behind. j Section 22: No vehicle shall be driven through a proce:7sion, nor shall any vehicle remain on,any street �is. 'such manner as to inter- fere , ,. fere with the passage of such precession.. _- section 22.. No vehicle shall stop or remain standing on any street at any street crossing in'such mannan as to obstruct free pass- age over such crossing. Section 23. No person shall operate or propel any automobile or other motor vehicle in the streets or public'grounds of the City of Beaumont, unless; he shall first register under oath with the City Tax Assessor and Collectorhis or her name, age, address and occupation, who shall thereupon issue to said applicant a non transferable lieense or permit, which shall be good until November lst, thereafter. The City max Assessor and Collector shall collect from the applicant the sum of $1.00 for performing the above services, said money to be paid into the general fund .of the City. Provided that the conviction of any person holding such license or permit, for the $nrd time within twelve months ,of any provision of this ordinance, shall work an immediate cancellation of such license or permit, and such person shall not be allowed' to obtain or be en- titled to another license or permit for a,period of six months there- after. The license or permit above provided shall be carried by the person to whom same is issued whenever he shall drive or operate any vehicle as provided in this section provided that the Tax Assessor and Collector shall have a badge made to be worded as follows: License No......... Beaumont,'Texas• the said number to correspond with the license or .permit number taken out, and any person securing a license or permit mai also secure a badge and wear same in place of carrying the license or permit as above pro- vided. The City Tax Assessor and Collector shall collect for said badge the sum of •25 cents. Section 24. The owner of any automobile shall;before operating same or permitting same to be operated, exhibit to the City max Assessor and Collector his certificate of registration from the -.County Clerk of Jefferson County and tegister with the Ci y Tax Assessor and Collector his,name, residence and a description of the vehicle so owned and the City Tax Assessor and Collector shd.l enter such name, residence and description and number of his certificate of Registration in a record kept for that purplse.. The said owner shall ,provide himself ORb � 4 A -3 with a number corresponding to the registration number taken out by hil?lfrom the County Clerk, which shall be' composed of figures not less than.six (6) 'inches in height and of. white or light color and such namber shall be placed.or caused to be placed by the'otrrner of said vehicle on'the rear of his vehicle and to be -rigidly fastened to the body in such manner that when the rear light of such vehicle is lit, the said number shall be -plainly discernible at a distance of not less than fifty (50) feet. The said figures shall at all times be kept clean so that'same shall be easily recognizable and shall not at any time be,concealed or covered up but shall be kept in plain sif,rht. The City Tax Collector and Assessor shall collect from the owner of the vehicle the sum of �l.OG `�" ' Section 25. The owner of any motor vehicle,other than automobiles, shall, before operating -same or permitting same to be operated, exhibit to the City Tax Assessor and Collector his certificate of registration from the County Clerk of Jefferson County'_ and register with the City Tax Assessor and Collector his name and residence together with a description of the vehicle so owned and the City max Assessor and Col- lector shall enter such name, residence, de,scriptionand number of'regis- tration in such book to be kept for that pu=rpose. The owner of said veh- icle shall place or cause to be placed on the rear of.his vehicle and rigidly fastened thereto in such manner as- t -o be discernable at a distance of not less than (30) thirty feet a_number as per his regist- ration, the figures of which shall be not, less than three (3) inches in height and of white or light color and shall -at all times keep said number i clean so that the same may be easily recognized and shall not at any time keep said number concealed or"covered�up, but shall always be kept in plain sight.. The City Tax Assessor,and.Collector shall collect from the owner of said vehicle for carrying out the provisions of this paragraph the sum of .1.00' °�-- Section 26. The sale or transfer of a licensed automobile or a licensed vehicle shall be recorded by the parties making such sale or transfer in the office of the City Tax Assessor and Collector, in a record i kept for that purpose -within fort2x-eight hours after such sale or "' as been. consumated' and shall pay a free of 25- cents therefor to the City Tax Assessor and Colle*ctor.for the use of the City and a fail- ure to do which shall render all such partfies guilty of a violation of this ordinance. Section 27. Any person driving or operating-an'ai-Ltomobile, motor- cycle or other vehicle, shall, at the request of or in response to a signal by person riding or 'driving. a horse',"or horses or other . domestic animals which show signs of fright,; -cause .such vehicleor machine to come to a standstill as quidly -,as- posaible, and to remain stationary long enough'to.allow such animal'or animals to pass. Section 28. No person shall run -or 'drive aril motor ear or other motor vehiele,upon or over the public streets which has an unusually loud exhause or otherwise makes an unusually -loud, uncommon or unnecessary. noisy. Section 29. No person shall operate, or cause to be operated, an auto- mobile or.other motor-vehicle,upon any of the streets," alleys; or�puhlie grounds of the City of Beaumont, without complying'with the provisions herein, provided that the provisions.of this ordinance, Sections 23,24, 25 and 26, shall not apply to non-resident visitors for a period of five consecutive"Idays. Section 30. No person'who is not.the.•owner"or the one in charge, except with the permission of such owner or one in charge, enter or meddle with or in any way handle any automobile motor vehicle or other vehicle - - -ale s of -this Cifyglef ori- the -,streets or;No- erson- shall catch, on or hang on any vehicle except with the permission of the owner or person in charge of said vehicle.' �- Section .31. No person shall drive or conduct any vehicle, when required by this adinanee to be' .licensed or numbered; ;when such person is under sixteen (16) years of age. Section 32. It shall be the duty.of every,person driving,'using or having the control of any vehicle or animal upon the public streets of this City to obey the order of any police officer regarding the speed of any such vehicle or animal .upon any of the public streets of this City. Section 33. Any police officer may conduct -the movement or order the stoppage of any vehicle or animal in the streets and alleys of this City to -the end that pedestrians may cross same in safe- ty. Slow moving vehicles shall keep as -close as possible to the curb line so as to allow faster moving vehicles free passage on the left. Section 34. No person having charge of a vehicle shell allow the same to come within ten feet of any vehicle in front of him, when approaching or passing a crossing where a pedestrian is about to pass., Section 35. Drivers of automobiles and motor vehicles shall in approaching a crossing or in rounding a corner or a curve of a public street sound a signal..in such 'a way. as to give warning to other vehicles and to pedest-rians of their approach. Section 36. vehicles must stop so as to not interfere with or prevent the passage of pedestrians over crossings and at all times the drivers of vehicles must stop the same on a signal from a police officer. Section 37, The Volice, Fire Department, Emergency repair wagon, Unii ed. etates Ijlail Wagon and .amhulances -have the right of way in any street and through any procession._ section 38. Unless in an emergency or to allow a'vehicle or ped- estrian to pass, no vehicle shall stop, in any public. street except close to the curb as provided in Section 9. Section 39. A person having charge of a vehicle shall not stop same atreast of another vehicle legthwise• of the street in any public street except in case of accidents. - Section --40.1 No person'havi-ng- charge -of a vehicle in a.public street shall refuse,'or neglect to stop same or plae,e same as directed by a police officer. Any of these iules-or ordinances to .the contrary notwithstanding. Section 41.. No horse or vehicle shall be backed, .lead or allowed to stand on any sidewalk. Section 42. No person shall drive or conduct anyvehicle in such a condition, or so constructed or load,'as to be likely to cause delay in traffic or injury or accident to man, beast or property. Section 43. '- No_ person shall drive ,or convey throughany ,.public street any vehicle, the sides of which.with its load, exceeds ten feet, except in accordance with,a permit from the City Council. Section 44. No person shall in any public street use a clay or del ivery wagon, the, .length whereof, from the end' of the -.shaft to the extreme end of such vehicle shall b.e,greater than twenty-four, (24) feet and six (6) inches ora motor vehicle of greater length than twenty-six,(26) feet,'except in accordance with a permit from the City Council. Section 45,, - No person shall carry or cause to -be carried on any ' vehicle: in any public street, a load, the weight of which exceeds six (6) tons, unless such load consists of an article which can' not be divided, except upon a p'rmit from the City Council., Section 46• No person when driving a vehicle -with a horse or horses hitched thereto shall cease fron holding, -the, reing in his hands to guide and'restrain same nor when not riding, cease from walk- ing at. the head, of the shaft or wheel horse;' either holding or keeping within reach of the bridle or halter thereof. Section 47. No person shall so load a vehicle with iron or other material that may strike together without"pr'operly deadening the sound, so that, -it 'will not, cause any unnecessary noise.. Section 48. It shall be unlawful for any pedestrian to cross or to stand' upon any street in such. a way as to- interfere with the traffic ori that, street. Section 49. No person shall engage in any d n"ct upon any avenue or street or highway, which shall.,be likely to frighten horses, injure passengers or impair a passage of vehicles thereon.. 1'' i fi Section �5Q. Any person violating any -of they ;provisions of this or- dinance shall be deemed guilty of a misdemeanor and upon -convict= S ion ,thereof in the Corporation Court shall -be fined in any said not less than $5.00 mor more than $200.OQ.;,' Section 51. Nothing in this, ordinance contained shall be construed as repealing any o,-dinance except so far and so far only. -as they shall,eonflict with the provisions hereof. Section 52. No person shall leave a vehicle hitehed.,or standing in front of any person's residence, place of business or property for more than thirty minutes without the consent of the owner or occupant of such property. —Section_ 53. No person shall in a state of intoxication drive,or operate an automobile or motor vehicle upon the. greets of the City of Beaumont. Section 54. This ordinance shall go into effect and be in full force from and after its passage,-. approval by ,the �,Kayor and lawful pub- lication.
