Entitled an ordinance creating the office of City Electrician of the City of Beaumont, prescribing the duties thereof, providing for its ,mainten€ ren Pry penalties y -'"Ck- '7k, OF BEAUMONT Section 1. The office of City Eleetiriefan of the City of Beau- mont is hereby created.,, --such office shall -be filled by appointment by the .payor and confirmed by the City Council- 'The City Electrician shall receive as compensation for his services such sum as the City Council may from time to time designate, same may be increased during the tenure of his office -but, not. diminished. Section 4. No such person, .firm, corporation: or company as mention- ed 'in the preceding article hereof: shall. hereafter erect or construct any pole, pier abutment, wire or other fixture,_appurtenanee or appliance -such as mentioned in said article, without first obtaining the consent of the City Electrician to -.do , so. All poles shall be ereeted'an,d: maintained in a per- pindicular position and shall be straight, and free from bark'and placed immediately within the cur#ing where''the'sidewalks are eight feet or upwards in width,, and shall be'placed in the curbing on a 'line -✓rith its outer surface where the sidewalks are less than eight feet in:, width... 17hen the, curbing is not 1 aid, --the outer line .of the same -shall be taken and eight inches ,within the outer line if the sidewalks are eight fact in width. Each line of piles shall be'run on one side of'the street, alley or avenue exly, except when absolutely nexessary to change to the other side, but this maybe done only by permission of the' Fire Committee. Cross arms.shall be of.uniform length, strengthened by braces, ,and the cross: arms of each company shall be branded or stamped with the.initials of the com:any owning the same, and no wires shall be less than twenty-five feet from the curb in height. It shall be unlawful for any 1p. rson, firm or corporation to place or allow to be -placed any advertising cards or posters or ogler light material or '' ► ­-;O_es within the City limits, and any person, firm or Corp owing the.same to be done shall be guilty of an offense. ?Thenever it shall become.necessary for any electric light or power company to carry its wires across theline of any fire alarm, telegraph, telephone or other electric light or power company, such wires shall be at a distance .from the other.wires, of not less than five feet. Nowires shall be allowed -over the fire alarm and police telegraph wire8, unless special permission is given in writing by the City Electrician. No wires of,telegraph, telephone, electric railways., electric light or pourer company, sha11 be" allowed under or --"ave sheds, galleries or awnings without the. written c_ors_ent o:f. the City Electrician. No person, firm or corporation shall hereafter commence the construction, installation, repair or alteration of any electrical work, either outside or inside of'any building, or any wiring inside or outside of any building, without first making application .in writing to the City Electrician for a permit for such construction, installation, repair, alteration or wiring, and said application shall contain a description by street ail num- ber, or by streets, lots or blocks, as may be necessary to locate the same, and shall be accompanied with the inspection fees required to be paid. Upon making the application provided for in the preced- ing article, and the payment of the inspection fees, provided for in this ordinance, the City Electrician shall issue a permit for the construction, installation,,repair or alteration of any electric- al work, and shall carefully inspect such work previous to, during and after its completion, and if the same shall prove to be con- structed in accordance with all the rules and requirements of this ordinance governing the same, and upon the payment of any additional fees for additional inspection not embraced in the original applicatJn n, The City Electrician shall issue a certificate approving the same. The use of any electric construction, such as provided for in this ordinance is hereby declared to be unlawful previous'to-the issuing a temporary permit for the use of elect..:* -wring the course of construction or alteration of a building when in 'judgment it is safe to do sD , but such temporary permit shall expire. when such building is completed. No electrical wiring or installation of electrical apparatus or appliances for furnishing lights, heat or power shall be introduced into or placed in any building or structure in the City of Beaumont M, except in compliance with the rules and regulations of the ZVational c Board of Fire Underwriters known as the "NATIONAL ELECTRICAL CODE" as adopted in 1909 and all amendments and changes or revisions made 3' or shall hereafter be made to said "NATIONAL ELECTRICAL CODE". Section 5. The City Electrican shall keep on file in his office at the City Hall a copy of the "NATIONAL ELrCTRTCL CODE", the amendments, changes or revisions that may be made to. same as provided in the above , section and same shall be open to inspection by any person, firm or corporation. Section 6. The City .electrician --his rowers and Duties-- The City Electrician shall have power, and it is his duty to inspector reinspect all overhead, underground and interior wires and apparatus conducting electric current for any of the purposes set ,forth in this ordinance and when said conductors or apparatus are found to be unsafe to life or property, he shall notify the person, firm, company or corporation owning, using or operating same, to place the same in a safe condition within forth -eight hours, and it shall be their duty to do so. The City Electrician shall erect in the Station of every electric light or power company, at the expense of said c omjany, a suit- able tapper, connecting with the fire alamm system of the City, by which shall be indicated the location of all fires, and in the event of a fire in any district in which anybcompany--had wires, said company shall forthwith send a man prepared to remove the wires, under the W direction of the City Electrician of the Chief of the Fire Department. Every lineman or lampman shall wear a badge in plain sight, indicating his number and the company by whom he is employed, and in case of fire, this badge shall ser�re.as.mss to admit the wearer inside the fire limits. - ?� Nothing contained in this chart-er shall be so construed as to any manner effect the right of the City in.the future to prescribe any other mode -of conducting wiresver or under it's thoroughfares. Any j)erson or person, ,k corporations desiring to place along or acoss any of the streets, alleys or public places of the City of Beaumont, wires, tubes or cables, shall file in the office of the City '3ecretary an application therefor, stating in . detail the streets, alleys or public places which said wires, tubes or cables are to occupy, and the manner in which said wires, tubes or cables are to be secured or supported and.insulated, together with a plat shoring the route of such wires, - tubes or, bables. I The right is hereby reserved to the Fire Committee, at any time, to direct any alteration in,the location of poles and also in the height at which the :Vires shall run; but before any such alteration ix made, at least five days notice in writing shall be given the pres- ident res-ident or local officer of the company affected by the proposed alteration, and reasonable opportunity shall be afforded the representatives of such company or any citizen interested to be heard therein. But when any such alteration shall be ordered, the said company shall, within five days thereafter, commence such alteration and complete the same as soon -as practicable thereafter, and upon failure'to do so, ttL shall be deemed guilty of a misdemeanor and punished as hereinafter provided. Th-t�,t_.all .poles -erected to carry telephone, telegraph, electric light or other wires, shall be painted in accordance with the fo.11-owing- conditions ,• viz: 1. That -all pd. -es shall be painted black for a distance of seven -feet. -aboti e the ground line. 2. That from -a°- dist-ante f --seven- feet- from the ground line to__the top of all poles of any company or association; shall- be painted 9 a -uniform -and distinctive- color that may be as -signed to said company by> -the -City'-:1,31e ctridian. 3. That whenev:er---appl- -caiion is - made --for- the purpose, it shall be the duty -of the City Electrician.to assign' to each company or association that,have°poles erected, a distinctive color for the paint- ing of the poles, and the:City Electrician shall thereupon notify the street commissioner, Chief of Flre•Department and Chief of,Police De- partment, the maae.of'the company and the distinctive color so assigned. Whenever any electric wire.shall'be broken, or'be in un- safe condition, it shall be the duty of said owner of such wire, or the president or manager of the .company owning.',or;;control•ling such wire, to, until immediately'cause. the current : to - be. -discontinued su6h,-wire i s put 1* n- �saf-e tion.% Whenever the trolly wire, guard wire, guy wire, or any other wire used.in any way for the transmission of ele6fricity shall be poorly or improperly constructed, it shall'-be'the duty of the City Electrician to notify the owner of.such wire, or the manager of the company having charge of such wire, to have the same remedied, and it shall be the duty -of such manager -to put such wire or wires'in a safe and proper condition within one day after such notice; and every day that such manager shall fail to have,the same remedied after such notice, shall cor>stitute a separate offense. It shall be the duty of every electric light company and every electric -street railway company to maintain at least one lineman, - who can reach, within a reasonable length of time, from their office in the City of Beaumont, to remedy breaks or poor construction of such wires, and -keep their wires at all times:in a safe condition. A. charge of .25 cants will b'e charged --for each service connection and shall.be collected by the.City.Eleetrician and paid into the City Treasury;. also the charges -for. electrical_ -inspection. -- Section 9. �n Each violation of the provisions of this oh*,rA-ex shall constitute, a misdemeanor and the person, firm or corporation or any employee, agent or member or,officer thereof guilty violating the provisions of this ordinance, on onvietion in the Oorporation &urt, shall be fined in any sum not less than $5.00 nor more than $100.00 for each offense and every violation ofIand each and every day for failure or refusal to comply with this ordinance shall constitute a separate and distinct offense and in case of wilful and continual violation,of of the provisions of this by ahy person, firm or corporation,as aforesaid, or their employees, servants or officers, the City shall have the right and power to revoke and repeal any franchises or or- dinances under•which(persons, firms or corporations are operating or may be pp using and to revoke and repeal all permits and privileges granted to &aid person, firm or corporation as aforesaid." Section 10. All ordinances or parts of ofdinance's inconsistent with the; provisions of this ordinance are hereby repealed. Section 11. This ordinance shall go into effect and be in,full force and effect- from and after its passage, approval by -'the Mayor and lawful ,publication. Passed this the Approved this the r-_ XV-EeCALA.
