ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAP TER 39 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
BY REPEALING SECTION 39-19 AND ENACTING A NEW
SECTION 39-19 IN LIEU THEREOF; BY ENACTING A
NEW SECTION 39-20; PRESCRIBING RATES AND CHARGES
FOR LOCAL EXCHANGE TELEPHONE SERVICE FURNISHED
BY SOUTHWESTERN BELL TELEPHONE COMPANY; PRO-
VIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL.
WHEREAS, Southwestern Bell Telephone Company has appeared,
before the City Council and has shown that.the rates and charges
for local exchange telephone service heretofore prescribed have
proved insufficient to afford said Company a fair return on the
fair value of its property devoted to furnishing local exchange
telephone service in the Beaumont telephone exchange;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMON T:

That Chapter 39 .of the Code of Ordinances of the City of
Beaumont is hereby amended by repealing Section 39-19 and enacting
a new Section 39-19 in lieu thereof and by enacting a new Section
39-20, which Sections 39-19 and 39-20 shall read as follows:
Section 39-19. Southwestern Bell Telephone Company Schedule.
Southwestern Bell Telephone Company shall place in effect
the following schedule of rates for local exchange telephone ser-
vice on its first billing date after final passage of this ordinance.

(c) The rate for flat rate Semi -Public Coin Telephone service
is 40% of the rate for one party business flat rate service.
(d) Company standard rates to be applied to all types of
miscellaneous equipment and services not listed.
Section 39-20. Miscellaneous Charges.
The present level of rates and charges for miscellaneous
services and equipment not included in the rates specified in
Section 39-19 were taken into account in establishing the rates
prescribed in Section 39-19, and all such rates and charges for
miscellaneous services and equipment shall remain subject to the
regulatory powers of the City Council of the City of Beaumont.
In the event that Southwestern Bell Telephone Company desires to
increase any such miscellaneous rates and charges it shall, not
less than 30 days prior to instituting any such increase in such
rates and charges, file with the City Clerk of the City of Beaumont
a proposed schedule of said rates, together with a report showing
the class of service or equipment involved, the present annual
revenues being obtained from such service, the approximate number
of customers to be affected, the amount of the proposed monthly
increase in the rates and charges for such service, and the esti-
mated annual increase in revenues to be generated by such increase
in rates and charges.

Section 39-20. Miscellaneous Charges.

Sect•iori 2.
If, after a result of any litigation or investigation of
Southwestern Bell's books or practices, it is determined that any
portion of the rates authorized to be placed into effect hereby,

exceed a fair rate on the fair value of Southwestern Bell's property,
said rate shall be ordered reduced or refunded by appropriate ordinance
after hearing before-theCity Council'.``By placing into effect any of
the rates and charges authorized -herein, Southwestern Bell Telephone
Company shall be conclusively presumed to have accepted all terms and
conditions of this. ordinance:

That if any section,. subsection, sentence, clause or phrase of
this ordinance or the appli"cation of same to a particular set of persons
or circumstances should for any reason be held to be invalid, -such in-
validity shall in no wise affect the remaining portions of this ordi-
nance, and to such end the various portions and provisions of this ordi-
nance are.declared to be severable.
Section 4.
That all ordinances and parts of ordinances in conflict herewith ,
are hereby repealed.
