Home My WebLink AboutORD 74-600-7s,/-90 ORDINANCE CALLING BOND ELECTION WHEREAS, the City Council of the City of Beaumont, Texas, has determined, and hereby affirmatively determines, that an election should be held in said City on the propositions of issuing City bonds payable from ad valorem taxes for the pur- poses hereinafter set forth; and WHEREAS, the City Council wishes to proceed with the or - Bering of such election; Therefore BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. That a special election shall be held in the City of Beaumont, Texas, on the 1st day of October, 1974, at which election there shall be submitted in accordance with law the following propositions, to -wit: PROPOSITION NO. ONE SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $12,000,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: A MUNICIPAL OR CIVIC CENTER, CONSISTING OF AN AUDITORIUM BUILDING, A CONVENTION BUILDING AND AN OFFICE BUILDING, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? The probable period of usefulness of the improvements for which the bond funds are to be expended is more than 25 years. PROPOSITION NO. TWO SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $133940,0003 MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: THE CONSTRUCTION AND IMPROVEMENT OF THE ROADS, BRIDGES, AND STREETS OF SUCH CITY, INCLUDING, BUT NOT BY WAY OF LIMITATION, RELATED DRAINAGE FACILITIES, RELATED TRAFFIC CONTROL DEVICES, AND THE ACQUISITION OF RIGHTS-OF-WAY, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? THREE SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $500,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: IMPROVING AND EXTENDING A TRAFFIC CONTROL SYSTEM FOR SAID CITY, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY: SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? FOUR SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $1,000,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, FOR THE PURPOSE OF ACQUIRING AND/OR CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID,CITY, TO -WIT: ACQUIRING OR IMPROVING, OR BOTH, LAND FOR PARK PURPOSES, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? FIVE SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $560,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT ANY RATE OR RATES, NOT TO EXCEED THE'MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING AND ACQUIRING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO -WIT: A TRANSIT SYSTEM GARAGE AND OFFICE BUILDING, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY AN- NUALLY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? The probable period of usefulness of the improve- ments for which the bond funds are to be expended is more than 25 years. 2. That the hours during which the polls will be open for voting in said election shall be from seven o'clock a.m. to seven o'clock p.m. 3. That voting shall be at the following respectively designated polling places in each of the following.numbered Jefferson County Voting Precincts in the City of Beaumont heretofore established and described by natural or artificial boundaries or survey lines by order adopted by the Commissioners' Court of Jefferson County and duly set out in its minutes. FIVE FOR THE ISSUANCE OF $560,000 TRANSIT SYSTEM GARAGE AND OFFICE BUILDING BONDS AGAINST • Each voter desiring to vote in favor of a proposition shall -7 pull the voting pointer down indicating "For" such proposition, and each voter desiring to vote against a proposition shall pull the voting pointer down indicating "Against" such proposi- tion. Absentee voting shall be conducted by a clerk for absentee voting, namely, Myrtle Corgey, City Clerk, and the place at which the absentee voting shall be conducted is designated as the City Hall, Beaumont, Texas, which is also the absentee vot- ing clerk's mailing address to which ballot applications and ballots voted by mail may be sent. Said clerk shall keep said office open for at least eight (8) hours, that is, from 8:00 o'clock a.m. to 5:00 o'clock p.m., on each day for absentee voting which is not a Saturday, a Sunday or an official State holiday; provided, however, except as authorized by Art. 5.05, Subdivision 3d, Texas Election Code, said clerk shall not per- mit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk's office, and under no circumstances shall she permit anyone to vote absentee by personal appearance at any time when her office is not open to the public. 5. That said election shall be held and conducted in ef- fect as two separate but simultaneous elections, to -wit: one election at which only the duly qualified resident electors of said City who own taxable property within said City -and who have duly rendered the same for taxation shall be qualified to vote on said propositions, and another election at which all other duly qualified resident electors of the City shall be qualified to vote on said propositions. The votes cast at each of said separate but simultaneous elections shall be recorded, returned and canvassed separately, 6. That notice of said election shall be given by posting a notice containing a substantial copy of this ordinance at the City Hall, Beaumont, Texas, and by posting a substantial copy of this ordinance in each of the election precincts of said City not less than fourteen (14) days prior to the date on which said election is to be held, and same shall likewise be published on the same day in each of two (2) successive weeks in The Beaumont Journal, a newspaper published in.the English language and of general circulation in said City, such newspaper being the offi- cial newspaper of said City, the first of said publications to be made not later than fourteen (14) days prior to the date set for said election.
