HomeMy WebLinkAboutORD 74-53LLJ/cb 8=9-74 ORDINANCE NO. rj—56 8-1.3-1 -7 ENTITLED AN ORDINANCE REPEALING ORDINANCE NUMBER 74-46; AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A PARCEL OF LAND OUT OF THE EASLEY LEAGUE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DE- SCRIBED HEREIN, PRESENTLY ZONED "A-1", TO "R-211; PROVIDING FOR SEVERABILITY; AND PRO- VIDING A PENALTY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Secti nn 1 _ That Ordinance Number 74-46 passed by the City Council on July 30, 1974, is hereby repealed. Section 2. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the .Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zone classification of the following described parcel of land presently zoned "A-1", Agricultural Residential, to "R-211; Two Family and Multiple Dwelling, to wit: A 15.088 acre tract of land out of the D. Easley League in Beaumont, Jefferson County, Texas, being out of that certain 20 1/6 acre tract of land that was conveyed by E. E. Rutledge to A. E. Broussard by deed dated February 27, 1901, said deed being recorded in Volume 41 Page 82, of the Deed Records of Jefferson County, Texas, and said 15.088 acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at a 1 1/2 inch iron pipe in a fence corner locating .the Northwest corner of said 20 1/6 acre tract of land and the Northwest and the beginning corner of the tract of land' herein described; d, 7 �--53 THENCE South 0 degrees 0 minutes 53 seconds West with the West line of said 20 1/6 acre tract of land 778.51 feet to a steel rod placed for corner; THENCE North 89 degrees 39 minutes 20 seconds East 845.87 feet to a steel rod placed for corner in the West line of Major Drive (F. M. Highway No. 364) ; THENCE North 0 degrees said West line 776.92 found for corner; 06 minutes West with feet to a steel rod THENCE South 89 degrees 46 minutes 46 seconds West with the North line of said 20 1/6 acre tract 844..31 feet to the place of beginning, containing 15.088 acres of land. SAVE AND EXCEPT the following tract of land containing 4.82 acres, more or less,` described as follows: BEING a certain tract or parcel of land out of and a part of a certain 15.088 acre tract of of land owned by JOHN M. BLACKWELL and SYLVEN W. DuCOTE, said 15.088 acre tract of land more fully described in Deed of Trust dated November 19, 1973, from John M. Blackwell and Sylven W. DuCote, to.John W. Bailey, Trustee, recorded in the office of the County Clerk of Jefferson County, Texas, on November 21, 1973, under County Clerk's file no. 867370; the portion thereof which is excepted being described as follows: BEING a tract of land approximately rectangular in shape, beginning at the Southeast corner of said 15.088 acre tract of land, fronting 350 feet on.Major Drive, and extending Westward from Major Drive to a depth of 600 feet; and containing approximately 4.82 acres of land, more or less; and theofficial map of the City of Beaumont is hereby amended to reflect such changes. Section 3. That in all other respects the use of the property herein- above described shall be'subject to all of the applicable regu- lations contained in Chapter 42'of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 4. That the terms and provisions of this Ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described herein- above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property de- scribed herein. Section 5. That any person or corporation violating any of the terms and provisions of this Ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas. 1974.
