ORDINANCE N0.
ENTITLED AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
A DEED CONVEYING 9.,814 ACRES OF LAND TO THE TEXAS DE-
PARTMENT OF MENTAL HEALTH AND MENTAL RETARDATION FOR
THE PURPOSE OF CONSTRUCTING A WARD BUILDING AT ITS
BEAUMONT STATE CENTER FOR HUMAN DEVELOPMENT; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR REPEAL.
WHEREAS, The City Council of the.City of Beaumont in accor-
dance with the requirements of Article 5421q, V.A.C,S., held a public
hearing concerning the proposed transfer of 9.814 acres of land to
the Texas Department of Mental Health and Mental Retardation; and,
WHEREAS, the City Council from evidence aduced at said public
hearing determined there was no feasible and prudent alternative for
the Beaumont State Center for Human Development if it is to expand its
facilities other than the use and taking of the 9.814 acre tract of
land which was the subject of said public hearing; and,
WHEREAS, the City Council further found from said public hear-
ing that the project of the construction of a ward building on the
9.814 acre tract of land by th.e Beaumont State Center for Human Deve-
lopment included all reasonable planning to minimize harm to the land
as a park in that a much larger and more useful site for an athletic
complex has been obtained through the sale of a portion of the presen-
tly existing athletic complex, and a neighborhood park has been re-
tained for the use of the reisdents of the immediate area;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:

That th-e Mayor of the City of Beaumont be, and he is hereby,
authorized to execute a warranty•deed transferring fee title to the
following described property to the Texas Department of Mental Health
and Mental. Retardation for the sole purpose of constructing a ward
building at the Beaumont State Center for Human Development:
BEING 9.814 acres of land out of the David Brown
League in Beaumont, Jefferson County, Texas, and
being out of that certain 42,371 acre tract of

land that was conveyed by Leonidas Cartwright to
the City of Beaumont by deed that is recorded in
Volume 174, Page 48 of the Deed Records of Jef-
ferson County, Texas and said 9.814 acre tract
of land being more particularly described by
metes and bounds as follows:
FOR LOCATIVE POINT, begin at a concrete monument
in.the South right-of-way line of Fannin Street
an 80 feet width right-of-way and in the East line
of.8th Street a 75 foot width right-of-way;
THENCE North 89 degrees 58 minutes 51 seconds East
with the South line of Fannin Street 300 feet to a
concrete monument locating the Northwest and the
beginning corner of the tract of land herein de-
scribed;
THENCE North 89 degrees 58 minutes 51 seconds East
with the South line of Fannin Street 900 feet to a
concrete monument for corner;
THENCE South 0 degrees 04 minutes 45 seconds West
475 feet to a concrete monument for corner; ,
THENCE South 89 degrees 58 minutes 51 seconds West
900 feet to a concrete monument for corner;
THENCE North 9 degrees 04 minutes 45 seconds East
with the East line of the 3,271 acre Mental Health
and Mental Retardation Tract 475 feet to the PLACE
OF BEGINNING;
CONTAINING 9.814 acres of land,

and the City Clerk is hereby authorized to attest to said deed, and to
affix the Seal of the City of Beaumont thereto.
Section 2.
That all ordinances and parts of ordinances in conflict here-
with are hereby repealed.
Section 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance or the application of same to a particular set of
persons or circumstances should for any reason be held to be invalid,
such invalidity shall in no wise affect the remainigg portions of
this ordinance, and to such end the provisions of this ordinance are
declared to be severable,
