HomeMy WebLinkAboutORD 74-32ORDINANCE NO. 2L32) 0)�Y.1 17 �L- 3-2, ENTITLED AN ORDINANCE ORDERING THE GENERAL MUNI- CIPAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 14TH DAY OF MAY, 1974, AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT, FOR THE PURPOSE OF ELECTING A,MAYOR AND FOUR COUNCILMEN; TO SUBMIT THE QUESTION OF THE ADOPTION OF THE STATE LAW APPLICABLE TO FIREFIGHTERS AND POLICE- MEN WHICH ESTABLISHES COLLECTIVE BARGAINING AND CONDITIONS THEREFOR; NAMING THE PRECINCTS AT WHICH ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRE- SIDE OVER SAID ELECTION; APPOINTING A CANVASSING BOARD FOR ABSENTEE VOTING; APPOINTING A MANAGER AND JUDGE OF THE CENTRAL COUNTING STATIONS; PRO- VIDING A MANNER.OF HOLDING SAID ELECTION; PROVID- ING FOR NOTICE THEREOF; AND PROVIDING FOR SEVERA- BILITY. WHEREAS, under the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, a regular general municipal election is required to be held in the City ,_of Beaumont on the second Tuesday of May, 1974. The election shall be for Mayor, Councilman for Ward One, Councilman for Ward Two, Coun- cilman for Ward Three, and Councilman for Ward Four; and, WHEREAS, Article 5154c-1 of the Revised Civil Statutes of the State of Texas provides upon proper petition, that an election be held to determine whether the City of Beaumont must adopt the State Law ap- plicable to firefighters and policemen which establishes collective bargaining and the conditions therefor; and, WHEREAS, the conditions for said election as provided in Arti- cle 5154c-1 of the Revised Civil Statutes have been met; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That in accordance with the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating there- to, there shall be held in the City of Beaumont on the second Tuesday in'May, 1974, the regular municipal election for said City for the pur- pose of electing a Mayor, a Councilman for Ward One, a Councilman for 1 0 -7V -3a �/- 9-7`- Z/ -1 &9 A, '74-3 t� Two, a Councilman for Ward Three, and a Councilman for Ward Four for said City; and to determine whether the City must adopt the State Law applicable to firefighters and policemen which establishes collective bargaining and the conditions therefor. 'S'ecti'ori 2. That legally qualified voters presiding vithin the corporate limits within the City of Beaumont shall be entitled to a vote at said election. Section '3. That said election shall be held in the City of Beaumont at the following places and the following named persons are appointed pre- siding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks, to -wit: (See Exhibit "A") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct, who shall be selected from different political parties when practicable. 'Section 4. That said election shall be held under, and the qualifications of those voting thereat, shall be controlled by the provisions of the State Laws governing elections. Sectiori '5. That notice of said election shall be given: (a) By posting the notice of election hereinafter prescribed, together with a copy of this ordinance at each of the places herein designated for holding said election, at least twenty (20) days prior to the date of holding said election; and, (b) By publishing said notice together with a copy of this ordinance in a newspaper of general circulation in this city and -2- county one time, not more than twenty-five (25) days or less than ten (10) days before said election. form: Said notice shall be in the following "NOTICE OF THE GENERAL MUNICIPAL ELECTION IN THE CITY OF BEAUMONT FOR THE PURPOSE OF ELECT- ING A MAYOR AND FOUR COUNCILMEN; AND TO DETER- MINE WHETHER THE CITY MUST ADOPT THE STATE LAW APPLICABLE TO FIREFIGHTERS AND POLICEMEN WHICH ESTABLISHES COLLECTIVE BARGAINING AND THE CON- DITIONS THEREFOR." "Notice is hereby given that the G_6neral Muni- cipal Election as provided by the Charter of the City of Beaumont will be held in the City of Beaumont, Texas, on the 14th day of May, 1974, from 7:00 A. M. to 7:00 P. M., for the purpose of electing a Mayor and four Council- men; to determine whether the City must adopt the State Law applicable to firefighters and policemen which establishes collective bar- gaining and the conditions therefor; all as is more particularly set forth in the copy of the election ordinance passed by the City Council and attached hereto." Section 6. The form of ballot which shall be used in said General Muncipal Election shall be substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS MAY 14, 1974 FOR MAYOR (Vote for One) FOR COUNCILMAN, WARD I (Vote for One) FOR COUNCILMAN, WARD II (Vote for One) FOR COUNCILMAN, WARD III (Vote for One) FOR COUNCILMAN, WARD IV (Vote for One) -3- !WJ 0 PROPOSITION "Adoption of the State Law applicable to fire- fighters and policemen which establishes collec- tive bargaining when a majority of the affected employees favor representation by an employees association and which preserves the prohibition of 'strikes and lock -outs and provides penalties therefor." FOR AGAINST Section 7. In accordance with the provisions of the laws of the State of Texas, Myrtle Corgey is hereby appointed Presiding Judge of the Central Counting Station and Tom Lawrence is hereby appointed Manager of said Central Counting Station. Section 8. That in accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for voting on the day of election and also for the casting of absentee votes by personal appearance at the City Clerk's office. In accordance with the provi- sions of.the laws of the State of Texas, absentee votes by mail shall be counted by a special canvassing board, which shall be composed of Hardy D. Akin, Charles R. Dollinger, Jr. and Roy Gibbs. Hardy D. Akin is hereby appointed Presiding Judge of said Special Canvassing Board and Charles R. Dollinger, Jr. and Roy Gibbs are hereby appointed as Clerks. Section '9. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions -4- 0 EXHIBIT "A" Pct.
