ORDINANCE NO.' .7-4-26
ENTITLED AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS
PROPERTY AND PROVIDING A PROCEDURE THEREFOR; AND PRO-
VIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Sectiori 1.
That the City Manager or his delegated representative is
hereby authorized at public -.or private sale, to sell any surplus
personal property belonging to the City of Beaumont, including un-
claimed personal property held by the Police Department, of a value
of less than One Thousand and No/100 ($1,000.00) Dollars. The terms
of said sale shall be within the sole discretion of the City Manager
of the City of Beaumont or his delegated representative.
The City Manager is further authorized to sell any item of
surplus property belonging to the City of Beaumont of a value of
more than One Thousand and No/100 ($1,000.00) Dollars, but when
said item is of a value of more than One Thousand and No/100 ($1,000.00)
Dollars, said sale must be to the,highest and best bidder after
there has been an opportunity for competitive bidding. In those in-
stances in which competitive bidding is required, the City Manager
or his delegated representative shall cause to be published in a
newspaper in the City of Beaumont once a week for two (2) consecutive
weeks prior to the time for making such sale, the time of the first
publication to be at least fourteen (14) days prior to the time'of
making such sale, a notice describing the items to be sold, and the
terms of the sale. Nothing contained in this ordinance shall require
the City Manager or his designated representative to sell any surplus
personal property to any person.
Section 2.
That if any section, subsection, sentence, clause or phrase
of this ordinance or the application of same to a particular set of
persons or circumstances should for any reason be held to be invalid,
such invalidity shall in no wise affect the remaining portions of
this ordinance, and to such end the provisions of this ordinance
are declared to be severable.
