CONSIDER AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT PRO- VIDING FOR AN ADDITIONAL CHARGE TO THOSE HEALTH CARD APPLICANTS REQUIRING CHEST X-RAYS. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 'Sect'ion '1. Chapter 14 of the Code of Ordinances of the City of Beaumont, Section 14-8 is amended to read as follows: "Section 14-8: Health Registration'Card fforEm- ployees. It shall be unlawful for any person to prepare, serve or in any way handle foodstuffs intended or suited for human consumption or to employ any person in the business of preparing, serving or in any way handling foodstuffs intended for human consumption, including dishes, cutlery, and con- tainers used for the handling and serving of food, without a health registration card obtained from the City Health Department showing that such per- son has met the requirements of the laws of the state and the local ordinances governing food han- dlers and has a valid health certificate on file in the office of the City Health Department; pro- vided, however, this section shall not prevent an individual preparing foodstuffs and beverages for his own consumption or for the exclusive use or consumption of his own family. Before any person shall be issued a health regis- tration card, he shall be examined by a physician licensed to practice in the State of Texas, and he shall submit to such examinations, laboratory tests, and x-rays as may be necessary to determine if the individual examined is free of any trans- missible condition of any contagious or communi- cable disease. This shall include but is not neces- sarily limited to a standard serological test for syphilis performed in the laboratory approved by the State Department of Health and an x-ray for tuberculosis of the chest or standard skin test for tuberculosis, followed by an x-ray, if posi- tive, both to be performed within thirty (30) days of the application. However, said x-rays as pro- vided for herein shall not be required in any in- stance in which the health authority or any licensed physician believes said x-ray is not necessary or is dangerous to the health and safety of the ap- plicant. If such person examined is found to be free of_any transmissible condition of any conta- gious or communicable disease, such individual shall be issued a health registration card. If it is necessary for the applicant to have a chest x-ray done,.by the Health Department, charge for D-74- 16 �2-/.2- 7�,/- /z6 74, said x-ray shall be $5.00 in addition to the $2.50 charge for the health registration card provided for herein. If it is not necessary for the indi- vidual to have a chest x-ray, or if an x-ray is done by someone other than the Health Department, a charge of $2.50 will be made for said health registration card. The health registration card shall be placed in the files of the City Health Department bearing the same number as the health registration card issued to such individual. This card may be revoked when, in the opinion of the health authority, the holder is suspected of hav- ing a contagious or communicable disease or being a carrier of such, and the health authority re- serves the right to make such other examinations and tests at any time that may be necessary=at the sole discretion of the health authority. This registration card and health certificate shall be valid for a period of twelve (12) months unless canceled by the health authority as provided by this chapter. A duplicate health card may be obtained for an additional charge of $1.00." Section 2. This ordinance repeals all ordinances or parts of ordinances in conflict therewith.
