AN ORDINANCE FOR VACATING AND ABANDONING THAT
PORTION OF A FLORIDA STREET 0.056 ACRE RIGHT-
OF-WAY EXTENDING WEST OF THE WEST RIGHT-OF-WAY
LINE OF ERIE STREET, AS DESCRIBED HEREIN.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
THAT that portion of the surface of the Florida Street
right-of-way, as hereinafter described, in The City of Beaumont,
Jefferson County, Texas, be, and is hereby,.vacated and aban-
doned, said portion of the Florida Street right-of-way to be
abandoned being described as follows, to -wit:
BEING a 0.056 acre tract of land out of the
right-of-way of Florida Avenue, said tract
of land being more fully described as follows:
BEGINNING at a point in the North line of
Florida Avenue, said point also being the
Southeast corner of the Davenport tract as
described by Deed and Recorded in Volume 437,
Page 57, of the Deed Records of Jefferson
County, Texas;
THENCE North 89 degrees 55 minutes West with
the North line of Florida Avenue 125.40 feet
to a point for corner in the North line of
Loop 251 - Cardinal Drive;
THENCE South 70 degrees 55 minutes East with
the North line of Cardinal Drive 118.57 feet
to a point for corner;
THENCE North 19'degrees 05 minutes East 40.83
feet to the PLACE OF BEGINNING and;
CONTAINING 0.056 acres of land, more or less.
Provided however, that the Grantor specifically.reserves
for use as a sewer utility easement that portion of the herein
described 0.056 acre tract, being a ten (10') foot wide strip of
land lying northerly parallel and adjacent to the south line of
the 0.056 acre tract, which will be retained for sewer utility
purposes. Provided further that such abandonment pertains to The
City of Beaumont°s surface rights only, and is not intended and

does not act to abandon utility easements if any, now owned
by the City under said right-of-way. Provided further that the
aforementioned abandonment is in return for a donation to The
City of Beaumont of A certain tract of land by T. R. Blanton,
Jr., said tract to be used by The City of Beaumont as a sewer
utility easement, said tract being described as follows:
BEING that certain 0.061 acre tract of
land out of the J. W. Bullock Survey,
Abstract No. 7, Beaumont, Jefferson
County,.Texas:
ALL THAT CERTAIN tract or parcel of land.
being a part of Block 15 of the Annie T.
Warren Subdivision as described in deed
to Ted Blanton, Sr., et al, dated Decem-
ber 28, 1967, and recorded in Volume
1530, page 240 of the Deed Records of
Jefferson County, Texas, and said herein
described tract being more.particularly
described as follows:
BEGINNING at a point in the north line
of Florida Avenue, said point being to
cated North eighty-nine de rees fifty-
five minutes West (N 89055 W) along the
north right-of-way line of Florida Avenue
a distance of ninety-four and sixty-eight
hundredths feet (94.68') from the south-
east corner of the Davenport Tract as de-
scribed in deed recorded in Volume 437,
Page 57, Deed Records of Jefferson County,
Texas;
THENCE with the south line of the herein
described tract North eighty-nine degrees
fifty-five minutes West (N 89055' W) along
said north right-of-way line a distance of
thirty and seventy-two hundredths feet
(30.72') to the point of intersection of
the northerly line'of Cardinal Drive (loop
251) with the north line of Florida Avenue
for corner;
THENCE North seventy degrees fifty-five
minutes West (N 70055' W) along the northerly
right-of-way line of Loop 251 and the north-
erly property line of that certain parcel of
land conveyed to The City of Beaumont in deed
dated November 30, 1956, and recorded in Vol-
ume 1044, Page 549, Deed Records of Jefferson
County, Texas, for a distance of two hundred
fifty and two tenths feet (250.2') to a point
for corner, said point being located on the
west line of Block 15 and the west line of the
Blanton tract;

THENCE North zero degrees two minutes East
(N 00002' E) along said west property line
a distance of ten and fifty-eight hundredths
feet (10.58') to a point for corner;
THENCE South seventy degrees fifty-five min-
utes East (S 70055' E) parallel to and ten
feet (10') distant from the northerly right-
of-way line of Loop 251 for a distance of two
hundred eighty-two and sixty-nine hundredths
feet (282.691) to the POINT OF BEGINNING;
CONTAINING IN AREA sixty-one thousandths
(0.061) acres of land, more or less.
THAT portion of Florida Street being herewith abandoned
by The City of Beaumont is a smaller tract of land than that be-
ing received by The City of Beaumont from T. R. Blanton, Jr., for
sewer right-of-way purposes, and its fair market value is less
than or equal to the fair market value of that portion being re-
ceived by the City.
