BACKGROUND In 1992, the United States Air Force loaned the City a jet to be used for display purposes at Babe D. Zaharias Park. The Department of Defense regulations require the Air Force to check each year on the status of the jet to be sure that it is being used as intended. The National Museum of the United States Air Force, which is now charged with the responsibility of verifying the status of the jet, is requesting that the loan agreement be renewed in accordance with the original terms of the loan and federal regulations. The jet is an attractive addition to the park and staff wishes to keep it there on display. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to execute the necessary documents to renew the loan agreement with the National Museum of the United States Air Force for the jet on display at Babe D. Zaharias Park. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Singletary, Chief of Police MEETING DATE: February 26, 2019 REQUESTED ACTION: Council consider a resolution authorizing the City Manager, or his designee, to execute all documents necessary, for an agreement with the Department of Veteran Affairs. 11 BACKGROUND The Department of Veteran Affairs currently owns Beaumont Outpatient Clinic in our jurisdiction. This agreement would continue to be able to grant the Beaumont Police Department full rights to exercise law enforcement functions, if needed. Even though the Veteran Affair's police officers are highly trained, there may be some situations that still require assistance from our Department. Signing this agreement would continue to maintain a close and professional working relationship between our departments. FUNDING SOURCE Not Applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager, or his designee, be and they are hereby authorized to execute a Memorandum of Understanding between the City of Beaumont and Department of Veterans Affairs to grant the Beaumont Police Department full rights to exercise law enforcement functions, if needed, at Beaumont Outpatient Center located at 3420 Veterans Circle, Beaumont, Texas. Said Memorandum of Understanding is substantially in the form attached hereto as Exhibit "A" and made a part hereof for all purposes. Box 3827 Beaumont, Texas 77704 Dear Chief Singletary: The Department of Veterans Affairs requires VA Police to maintain current written support agreements with all local law enforcement agencies. All properties under the control or ownership of the Department of Veterans Affairs, 3420 Veterans Circle, Beaumont, Texas 77707 are under concurrent jurisdiction. This jurisdiction grants Beaumont Police Department and other Law Enforcement agencies full rights to exercise law enforcement functions at Beaumont Outpatient Clinic. For clarity it is imperative that we enter into a memorandum of understanding outlining agency responsibilities and expectations. Our VA Police Officers are highly trained, experienced and require minimal need for other Law Enforcement agencies intervention; however, we may still encounter certain situations that would require your department's assistance, I It is understood that the Beaumont Police Department is the responding agency for our Beaumont Outpatient Clinic. In an extreme emergency these needs would include, but may or may not be limited to, the following situations where your department's assistance would be required: a. Assist in responding to an armed hostage taking situations that would require an armed response to assist VA Police Officers in containing the situation until appropriate federal agencies (such as the Federal Bureau of investigation - FBI) can respond to assume control. b. Assist confirming and executing the arrest of individuals who have outstanding warrants issued for their arrest by law enforcement agencies and subjects under federal warrants and other incidents warranting -an individual to be physically arrested. EXHIBIT "A" c. Assist in the transporting of arrested offenders to the inmate Processing Center. VA Police would execute the detention, physical arrest of the subject and complete all corresponding paperwork. d. Provide additional Officers when needed to assist with the physical arrest of a violent(disorderly person(s) who poses a serious threat to patients, visitors, medical staff or themselves. Should any VA Police Officer be involved in a shooting, the FBI will be notified immediately. This agreement establishes inter -agency support for the VA Police to receive investigative assistance from Beaumont Police Department. This assistance may range from establishing, preserving and controlling the crime scene, to performing as the lead investigative agency. BACKGROUND ExxOnMObil Oil Corporation has requested permission to install a 10" pipeline to transport light cycle oil. The 10" pipeline will cross undeveloped Veatch Avenue, and there are no city improvements along Veatch Avenue. The pipeline will be constructed in accordance with City requirements. There is a one-time fee of $500 for each Pipeline License Agreement. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. RESOLUTION NO. I - Mayor Becky Ames - APPLICATION FOR UTILITY CROSSING AGREEMENT OUTSIDE THE CORPORATE LIMITS OF THE CITY OF BEAUMONT THE STATE OF TEXAS § COUNTY OF JEFFERSON § Business Name:_ ExxonMobil Oil Corporation Business Phone: ( 601) 672-9376 Business Address: 22777 Springwood Village Parkway, Spring, Texas 77399 The City of Beaumont, hereinafter called "City", for and in consideration of the sum specified herein $500.00 application fee plus $90.00 (40 linear feet for a total of $590.00 hereby grants to ExxonMobil OR Corporation hereinafter called "Licensee", the license to lay, maintain, operate, replace, or remove a pipeline for the transportation of Oil, gas, water, or light cycle Oil products, on or across the following City easement and/or property situated outside the City of Beaumont, Jefferson County, Texas, but being within our Extra -Territorial Jurisdiction (ETJ) and/or Certificate of Convenience and Necessity (CCN) and being more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes. Nearest Street Distance to Easement Length (Linear Foot) of Crossing Undevleoped Veatch Ave. 40 linear foot 1 EXHIBIT "A" COST OF LICENSE: Licensee shall make payment to the City of Beaumont as follows: License Agreement fee - $500.00 Annual fee of $2.25 per linear foot of pipeline located within City property. Said fee shall be reset on January 31, 2011 and shall be reset every ten (10) years, thereafter, to a level to be determined by the City Council or their delegated representative. All fees, including the first annual fee for linear foot usage shall be made to the Water Utilities Department and payable to the City of Beaumont prior to construction. This license is granted by the City of Beaumont subject to conditions. Failure to comply with the following may result in termination of agreement (see page 8). GENERAL CONDITIONS: Licensee does not intend to sell product for resale from the covered pipeline to customers located within the City; however, Licensee recognizes that should it sell product for resale from this covered pipeline to customers within the City, it will be required to report such distribution and when lawfully required to do so, pay a street rental fee based on revenues. The annual fee and the regulations controlling the payment of such fee will be those as lawfully established by the ordinances of the City. All pipelines crossing City of Beaumont utility easements, water or sanitary sewer easements shall be bored from easement line to easement line. Within these limits, the pipeline shall be protected by casing or other method approved by the City Water Utilities Department. The pipeline shall be constructed in such a manner as approved by the City so as it does not interfere with the use of the City property. The pipeline shall be installed a minimum of three (3) feet below ground and a minimum of five (5) feet below the lowest existing or proposed ditch grades, waterlines, sanitary sewer lines or storm drainage lines, unless otherwise authorized by the City. Such grades and lines shall be indicated on map submittal, as well as depth of proposed pipeline (see page 3). 0 The construction and operation of the pipeline shall not interfere with the natural drainage in that area nor with the drainage system of the City, nor with sanitary sewer lines, waterlines, or other utilities. Damage to existing ditch grade during construction or maintenance of the pipeline shall be corrected and the ditch grade shall be restored to the condition and grade at which it existed prior to construction or maintenance. Bore pits shall be backfilled according to City standards. Excavations necessary for the construction, repair, or maintenance of the pipeline shall be performed in such a manner that will cause minimal inconvenience to the public. Licensee shall promptly restore the area to as good a condition as before working thereon and to the reasonable satisfaction of the City's Water Utilities Department. Operations along easements shall be performed in such a manner that all property where operations are performed will be restored to original condition or better. No equipment or installation procedures will be used which will damage any structures. The cost of any repairs to structures, sanitary sewer lines, water lines or other easement features as a result of this installation will be borne by the owner of this line. Any construction which takes place in, on, under, above, or across property not owned by the City shall require additional permission by the owner(s) of the property involved. Written proof of said permission is to be provided to the City as part of the application process. Approval of this license agreement excludes permission to do any construction on property which is not owned by the City of Beaumont. • Any licenses, permits or agreements required by another governmental entity (County, State or Federal) to adjoining property shall be obtained and a copy of such document shall be provided to the City. • Licensee shall be responsible for acquiring all agreements necessary for the lawful use of any private property. • A map showing the location of the proposed pipeline shall be provided. • The pipeline shall be maintained and operated in such a manner as not to leak and/or cause damage to the City property. Once the pipeline is in operation, any damage that occurs to the pipeline which results in exposure or release of product must be reported immediately to the City Fire Department and Nater Utilities Department. Licensee shall fully cooperate with the Fire Department and provide, or assist with providing, any and all necessary notifications, evacuations or other necessary actions. Leaks or other defects are to be repaired immediately by Licensee at it's own cost. • The Licensee shall be responsible for the cleanup and remediation of contaminated areas due to exposure or release of product and any and all costs associated with said cleanup and remediation. • The Licensee shall be responsible for any and all costs associated with the relocation of the pipeline. As provided, the necessity for relocation of the pipeline shall be solely within the discretion of City. • Installation will be done in accordance with all City standards and statutes of the State of Texas. REQUIRED COVERAGE: • Licensee shall furnish the City with a Certificate of Standard Liability Insurance, including bodily injuries and property damage, naming the City of Beaumont as an Additional Insured. Such policy shall provide for the following minimum coverage: • Bodily injuries: $ 300,000.00 per person $1,000,000.00 per incident • Property Damage: $1,000,000.00 Such insurance shall be maintained in force and effect during the construction or required maintenance of the pipeline and during the life of the pipeline. Such certificate shall contain a provision that at least fifteen (15) days written notice must be given to the City prior to cancellation, alteration, or modification of such insurance. • Licensee shall have in force with the City a surety bond in the principal amount of $1,000,000.00. The bond shall be payable to the City of Beaumont for the use and benefit of any person entitled thereto and conditioned that the principal and surety will pay all damages to any person caused by, or arising from, or growing out of any violation of the terms of this agreement. The bond shall provide that it may not be cancelled, altered, or otherwise modified without giving, fifteen (15) days prior written notice to the City. The bond shall be good and in effect for a period of one (1) year from the date of completion of construction of the pipeline. 4 e Licensee shall indemnify, save and hold harmless the City of Beaumont from any and all claims for injuries and damages to persons or property occasioned by or arising out of the construction, maintenance, operation, repair or removal of the pipeline. This indemnity expressly extends to claims alleging negligence by the City of Beaumont, its agents, officers or employees, arising from actions taken or occurrences under this license agreement. • If the pipeline or any part thereof installed by Licensee shall be in any respect damaged or injured by City or any of its agents or employees in connection with the performance of any work or repairs that may be done upon the property mentioned herein: Licensee shall not be entitled to prosecute or maintain a claim against the City of Beaumont for any such damage or injuries so sustained by it; however, said conditions shall not prevent Licensee from recovering against any contractor who shall damage Licensee's property in the course of such contractor's performance of any contract with the City. OTHER CONSTRUCTION/MAINTENANCE WITHIN PROPERTY: • City will use its best efforts to notify Licensee of any proposed construction and/or maintenance, to be done by City forces or by contract for the City, within the property involved with this license. Notification, to Licensee, of other construction and/or maintenance permitted by the City and within the property involved with this license will be the responsibility of the company obtaining said permit. Licensee shall mark the location of its lines within forty-eight (48) hours after receipt of such notification of proposed construction. Licensee shall maintain a local, or toll free, telephone number to be called for notification of construction or maintenance and for location of lines. Such number, or charges to such number, will .be provided to the City (Water Utilities Department) and kept current at all times. This number shall be provided to entities permitted to construct, maintain or excavate within this City property and which are required to provide notification of such work. When information has been relayed to Licensee, through the phone number provided, such contact , shall constitute notification for Licensee to provide location of its lines. Failure, by Licensee, to respond within the required time frame shall alleviate the responsibility of the person(s) requiring the lines to be relocated. 5 • City reserves the right to lay, and to permit to be laid, sewer, gas, water and other pipes and cables, and to do or permit to be done any underground work that may be deemed to be necessary or proper by City in, across, along, or under the property. In doing or permitting any such work, the City of Beaumont shall not be liable to Licensee for any damage occasioned; it being understood that nothing herein shall be construed as foreclosing Licensee's rights to recover damages against any contractor or third party who may be responsible for damages to Licensee's facilities. • Whenever by reason of the change in the grade of the property occupied by Licensees' pipeline, or by reason of the location or manner of constructing drainage structures, water pipes, gas pipes, sewers, or other underground construction for any purpose whatever, it shall be deemed necessary, by City to relocate, alter, encase, change, adopt or conform the pipeline of Licensee thereto, such change shall be made promptly by Licensee at its cost and without claim for reimbursement or damages against City. If the change is demanded by the City for the benefit of any other person or private corporation, except the City, Licensee shall be reimbursed fully by the person or corporation desiring or occasioning such change for any expense arising out of such change; Licensee will, upon notice from the City, make such change immediately and at its own cost; it being understood that City will not participate in any part of the cost of any change involving relocation, altering, encasing, boring, or changing in any manner of the pipeline where same is within City property. NOTIFICATIONANSPECTION: • Any and all work to be performed on City property shall be observed and inspected by a City representative. Any work to be performed within the City limits will be subject to periodic inspection to ensure compliance with construction standards. • Licensee shall provide the City (Water Utilities Department) forty-eight (48) hours prior to the installation of the lines permitted by this license. A representative will be scheduled to be present. The expense of such inspection services may be billed to the Licensee and such amounts will be reimbursed to the City. • Licensee shall notify the Water Utilities Department at least forty-eight (48) hours prior to completion of work and removal of equipment from the job site to permit the City to make an inspection. rel SPECIAL CONDITIONS: Nonassi nable This license is personal to the Licensee. It is nonassignable and any attempt to assign this license will terminate the license privileges granted to Licensee hereunder. Termination This agreement is subject to termination by the City if any condition specified herein is not met. This agreement may also be terminated by the Licensee. Either party attempting to terminate this agreement shall give written notice to the other specifying the date of, and the reason for, termination. Such notice shall be given not less than thirty (30) days prior to the termination date therein specified. Any written notice may be effected either by personal delivery or by registered or certified mail, postage prepaid with return receipt requested. Projects include a Law Enforcement Terrorist Prevention Activities (LETPA) Sustaining Special Response Teams Project to purchase tactical equipment for SWAT to include 16 ballistic vests ($19,920) and eyewear ($2,910) to maintain warranted ballistic protection, 26 rescue belts ($1,356), 30 quicklitters ($599) to assist with medical rescues, 1 truck vault ($2,572) for equipment protection, 2 sets of bounce imaging cameras ($6,820), and 20 Self Contained Breathing Apparatus (SCBA) tanks to replace expired tanks ($20,500) for personal protection in hazardous material environments. The second project is an SHSP Sustaining Special Response Teams Project to purchase 9 radio encryption ($4,527) for Arson Investigators, 2 mobile radios ($9,054) for police tactical response support units, 3 scene lights ($3,897) for investigations, 40 Radio Battery Chargers ($12,870) and 48 radio batteries ($6,372) to support the Beaumont Fire/Rescue Department. Currently, Beaumont has more than twice the state average of housing units supported by Tax Credits or private activity bonds per capita. As such, additional subsidized units cannot be considered for this development by TDHCA unless the City acknowledges that Beaumont has more than twice the state average of subsidized housing units per capita and offers support for the project. In addition, applications that receive a Commitment of Development Funding in the amount of at least $500 in the form of a loan, grant or reduced fees will receive additional consideration by TDHCA: During the discussion of this item at the February 26, 2019 meeting of the City Council,, additional information concerning the number of affordable housing units for seniors and the level of demand for those units was requested. The estimated number of persons in Beaumont that are sixty-five (65) or older is 16,324 or 13.8% of the total population. Housing this population at Beaumont's average person per household rate of 2.48 would require 6,582 dwelling units. It is estimated that there are currently 1,284 subsidized, affordable multi -family dwelling units for seniors in Beaumont. With regard to measurable demand, Herman & Kittle has provided data showing that the occupancy rate of senior multi -family, tax credit projects in Beaumont is currently at 99%. Moreover, the Beaumont Housing Authority (BHA) has provided data showing that there are currently 1,319 elderly on their public housing waiting list that are sixty-two (62) or older and 1,646 on their waiting list that are between fifty-five (55) and sixty-two (62). In addition, there are six hundred ninety-eight (698) elderly on BHA's Section 8 waiting list.. However, this number is estimated to be low due to the fact that the Section 8 waiting list has been closed since 2016 due to demand. Based on this information, there appears to be sufficient demand for the proposed additional units. The Administration recommends offering a building fee waiver in the amount of $500. There are also 1,646 near elderly (55 and older) on the PH waiting list. The average age of those is 61. The Section 8 waiting list doesn't really reflect the demand, because that waiting list has been closed and not accepting applications since 2016. There are 698 elderly on the Section 8 waiting list currently. BHA has 2 elderly only properties—The Crossing, which has 150 units, and Grandpine, which has 94 units. We plan to build a 150 unit elderly only property in the west end at some point in the near future — we are awaiting word on our application for Harvey funding. The property would be nearly identical to The Crossing, with a mixture of public housing and market rate units. The chart below shows the LIHTC senior -only properties in Beaumont. If you look at the number of vacancies, they are all pretty much full, with the exception of Seville Row. In addition to these, there are 3 HUD owned senior properties: Baten Arms, Raintree Towers, and Senior Y -House. Senior Y House has not re -opened since Harvey. �? BACKGROUND On September 27, 2016, by Resolution No. 16-188, City Council awarded McInnis Construction, Inc., of Silsbee the contract for the new Beaumont Fire Station No. 1 in the amount of $7,409,783.00. The project has been inspected by the Architect and Facilities Maintenance Department and found to be complete in accordance with the provisions and terms set forth in the contract. Acceptance of maintenance and final payment in the amount of $373,588.16 is recommended. FUNDING SOURCE Capital Program. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, on September 27, 2016, the City Council of the City of Beaumont, Texas, passed Resolution No. 16-188 awarding a contract in the amount of $7,409,783.00 to McInnis Construction, Inc., of Silsbee, Texas, for the new Beaumont Fire Station No. 1 Project; and, WHEREAS, a contingency allowance in the amount of $100,000.00 was included in the above noted contract; and, WHEREAS, on December 22, 2016, the City Manager executed Change Order No. 1, in the amount of $1,800.00, to remove approximately seventeen (17) concrete footings which were encountered in the current area of excavation; and, to haul off and backfill with compacted select fill, thereby decreasing the contingency allowance to $98200.00 and having no affect on the total contract amount of $7,409,783.00; and, WHEREAS, on January 10, 2017, the City Council of the City of Beaumont, Texas, passed Resolution No. 17-004 approving Change Order No. 2, in the amount of $33,180.00, to remove approximately 19,626 square feet of unstable subgrade soil located in the building foundation area, thereby decreasing -the contingency allowance to $65,020.00 and having no affect on the total contract amount of $7,409,783.00; and, WHEREAS, on January 24, 2017, the City Council of the City of Beaumont, Texas, passed Resolution No. 17-008 approving Change Order No. 3, in the amount of $21,651.00, to remove approximately 9,600 square feet of unstable subgrade soil, asphalt roadway (13' x 160') and debris, thereby decreasing the contingency allowance to $43,369.00 and having no affect on the total contract amount of $7,409,783.00; and, 0 WHEREAS, on February 23, 2017, the City Manager executed Change Order No. 4 to approve ,the extension of the contract time due to inclement weather days for the months of December 2016 and January 2017, thereby having no affect on the contingency allowance amount of $43,369.00 and having no affect on the total contract amount of $7,409,783.00; and, WHEREAS, on October 26, 2017, the City Manager executed Change Order No. 12 to approve the extension of the contract time due to inclement weather days for the months of early August 2017 and August 25 -October 10, 2017 for Hurricane/Tropical Storm Harvey delay time, thereby having no affect on the total contract amount of $7,450,845.43; and, WHEREAS, on January 31, 2018, the City Manager executed Change Order No. 13, in the amount of $5,653.12, for the loss of labor and equipment cost due to conduit 0 obstructing the construction of the new sanitary sewer manhole on MLK; removal of 20" of concrete pipe and replacement with PVC pipe; and, sidewalk demo and re- installation, thereby increasing the contract amount to $7,456,498.55; and, WHEREAS, on February 9, 2018, the City Manager executed Change Order No. 14 to approve the extension of the contract time due to inclement weather days for the months of October and November 2017, thereby having no affect on the total contract . amount of $7,450,845.43; and, WHEREAS, on March 8, 2018, the City Manager executed Change Order No. 15, in the amount of $3,356.85, for the change out of hardware to electronic for door number 5; tear out and repair of brick to run conduit in the wall; change location of antenna from support side by removing sleeve and repairing brick; and, breaking hole in mezzanine and installing sleeve, thereby increasing the contract amount to $7,459,855.40; and, WHEREAS, on April 26, 2018, the City Manager executed Changer Order No. 16, in the amount of $8,520.73, for the fuel system change, block layer modifications and patch; and, consolidation of shunt trip breakers for fuel system, thereby increasing the contract amount to $7,468,376.13; and, WHEREAS, on August 22, 2018, the City Manager executed Change Order No. 17, to approve the extension of the contract time due to inclement weather days for the months of December 2017 and January -April 2018, thereby having no affect on the total contract amount of $7,468,376.13; and, WHEREAS, on August 27, 2018, the City Manager executed Changer Order No. 18, in the amount of $5,584.40, for the installation of 2" conduit from the technology room across the apparatus bay and into the east side; and, paining of additional conduit in open bay ceiling, thereby increasing the contract amount to $7,473,960.53; and, WHEREAS, on September 27, 2018, the City Manager executed Change Order No. 19, to approve the extension of the contract time due to inclement weather days for the months of June, July and August 2018, thereby having no affect on the total contract amount of $7,468,376.13; and, WHEREAS, on September 28, 2018, the City Manager executed Changer Order No. 20, in the amount of $3,651.25, for the installation of fourteen (14) 22/4 drops for the bay door control locations, thereby increasing the contract amount to $7,477,611.78; and, WHEREAS, on September 28, 2018, the City Manager executed Changer Order No. 21, in the amount of $2,727.80, for installation and configuration of materials for the drive gate, thereby increasing the contract amount to $7,480,339.58; and, WHEREAS, on November 29, 2018, the City Manager executed Changer Order No. 22, in the amou.nt of $1,423.64, for removal of the sprinkler protection in the server room; and, removal, replacement and repainting of sheetrock, thereby increasing the contract amount to $7,481,763.22; and, WHEREAS, on January 11, 2019, the City Manager executed Changer Order No. 23, in the amount of ($10,000.00, for the grounding loop system, thereby decreasing the contract amount to $7,471,763.22; and, WHEREAS, the project has been inspected by Architectural Alliance, Inc. and the Facilities Maintenance Division and found to be complete in accordance with the provisions and terms set forth in the contract; NOW, THEREFORE, BE IT RESOLVED BY -THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the new Beaumont Fire Station No. 1 Project be and the same is hereby accepted; and, BE IT FURTHER RESOLVED THAT the City Manager is hereby authorized to make final payment in the amount of $373,588.16 to McInnis Construction, Inc., of Silsbee, Texas.
