HomeMy WebLinkAboutORD 37-XAN ORDINANCE ENTITLED AN ORDINANCE ORDERING AN -ELECTION TO BE HELD IN THE CITY OF BEAUMONT,-JEFFERSON COUNTY, TEXAS, ON THE 8th DAY OF AUGUST, 1952, TO DETERMINE WHETHER OR NOT THE CITY COUNCIL OF THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY FOR THE PURPOSE AND IN THE AMOUNT AS FOLLOWS: SANITARY SEWER IMPROVEMENT BONDS IN THE AMOUNT OF SIX MILLION FIVE HUNDRED THOUSAND DOLLARS (6,500,000) TO PROVIDE FUNDS FOR THE PURPOSE OF THE IMPROVEMENT, EXTENSION, AND REPAIR OF THE SANITARY SEWER SYSTEM AND THE CONSTRUC- TION OF SANITARY SEWAGE TREATMENT PLANTS AND ALL AP- PURTENANCES THERETO, AND THE PURCHASE OF NECESSARY SITES THEREFOR, IN THE CITY OF BEAUMONT: TEXAS, AND TO LEVY A TAX IN PAYMENT THEREOF; MAKING CERTAIN FINDINGS AS TO THE ADVISABILITY AND NECESSITY OF ISSUING SAID BONDS AND MAKING THE IMPROVEMENTS, EXTENSIONS AND REPAIRS THEREIN CONTEMPLATED; NAMING THE DATE AND PLACE OF HOLDING SAID ELECTION; APPOINTING OFFICERS THEREOF; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIVING NOTICE THEREOF. WHEREAS, the City Council of the City'of Beaumont, Texas, has found and determined and hereby finds and determines that in the public interest it is advisable, expedient and necessary to issue serial bonds of said city to provide funds necessary for additional improvements, extensions, and repairs to the sanitary sewer system, .and for the construc- tion of sanitary sewage treatment plants and appurtenances thereto, and the purchase of necessary sites therefor to adequately provide the City of Beaumont and its inhabitants with adequate sanitary sewerage service, since at the present time raw sewage is emptied into the Neches River, into Brakes Bayou, the Neches River marsh to the north of the city, and Hayes Gulley, and into Hillebrandt Bayou to the west of the city, and into the Ector Street ditch to the south of the city, in violation of state and federal laws, thereby encircling and surrounding the city with raw sewage, creating a deplorable health menace; and since it has been found that some areas within the City of Beaumont are without adequate sewer lines and some of the present existing sewer lines have deteriorated from years of use and must be repaired and renewed, and it is necessary to construct sanitary sewage treatment plants to prevent turning the raw sewage loose into the Neches River; the bayous and ditches surrounding the city, and such improvements, extensions and repairs and sanitary sewage treatment plants are necessary to protect the public.health of the City of Beaumont and its inhabitants; and, :31 � 9-)( WHEREAS, the City Council -of the City of Beaumont further finds that the probable period of usefulness of the improvements for which the bond funds are to be expended will be in excess of twenty-five (25) years; now, therefore: BE IT ORDAINED BY THE CITY OF BEAUMONT: SECTION 1 That an election be held in the City of Beaumont; Texas, on the 8th day of August, 1952, which is not less than fifteen (15) nor more than thirty (30) days from the date of the passage of this ordinance, at'which election the following proposition shall be submitted to the qualified electors of said city, who own taxable property in said city and who have duly rendered the same for taxation, for their action thereupon. SECTION 2 The proposition to be submitted at said election shall be the following: SHALL the City Council of the City of Beaumont, Texas, be authorized to issue serial bonds of said city in the amount of SIX MILLION FIVE HUNDRED THOUSAND DOLLARS ($6,500,000) to provide funds for the purpose of the improvement, extension, and repair of the sanitary sewer system and the construction of sanitary sewage treatment plants and all appurtenances thereto, and the purchase of necessary sites therefor, in the City of Beaumont.. Texas, said bonds to mature serially in such installments as may be fixed by the City Council, over a period of years not to exceed twenty-five (25) years from their date, to bear interest at a rate not to exceed five per cent (5%) per annum; and shall there be annually levied, assessed and collected while said bonds or any of them are outstanding an annual ad valorem tax on all taxable property in the City of Beaumont, Texas, sufficient to pay the interest on all of said bonds as it accrues, and to create a sinking fund sufficient to retire the same at maturity. The probable period of usefulness of the improve- ments for which this bond fund shall be expended is more than twenty-five (25) years. SECTION 3 The question as to whether or not the City Council of the City of Beaumont shall be authorized to issue said serial bonds shall be submitted on the ballot, and the ballots to be used in said election 61'_d, 3`7-X shall be printed and furnished by the City of Beaumont, as provided by law, and each ballot shall have printed thereon the following: OFFICIAL BALLOT PROPOSITION FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT, TEXAS, FOR THE PURPOSE OF THE IMPROVEMENT, EXTENSION AND REPAIR OF THE SANITARY SEWER SYSTEM AND THE CONSTRUCTION OF SANITARY SEWAGE TREATMENT PLANTS AND ALL,APPURTENANCES THERETO, AND THE PURCHASE OF NECESSARY SITES THEREFOR, IN THE CITY OF BEAUMONT, TEXAS; AND THE LEVYING OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT, TEXAS, FOR THE PURPOSE OF THE IMPROVE- MENT, EXTENSION AND REPAIR OF THE SANITARY SEWER SYSTEM AND THE CONSTRUCTION OF.SANITARY SEWAGE TREAT- MENT PLANTS AND ALL APPURTENANCES THERETO, AND THE PURCHASE OF NECESSARY SITES THEREFOR, IN THE CITY OF BEAUMONT, TEXAS; AND THE. LEVYING OF A TAX IN PAYMENT THEREOF SECTION 4 Except where voting machines are used, each voter shall mark out with black ink or black pencil one of the above expressions on the ballot, thus leaving the other as indicating his vote on such proposition. SECTIONS Said election shall be held in each of the legal voting precincts within the City of Beaumont, and the following places therein, respective- ly, are hereby designated polling places in the following precincts of said city, and the following -named persons are hereby appointed officers of said election, and each judge shall have authority to appoint addition- al assistants and clerks, if necessary: (1) In voting precinct No. 1 said election shall be held at the French High School Building, and said election shall be conducted at said voting box by the following officers: T. B. Hensley, Judge Mrs. Lois S. Hensley, Clerk Mrs. C. L. Potter, Clerk Mrs. L. J. Ritter, Clerk (2) In voting precinct No. 2 said election shall be held at the Junker School Building, and said election shall be conducted at said voting box by the following officers: Mrs. James E. Ray, Judge Mrs. Anna Plake, Clerk Mrs. C. F. Culmore, Clerk Mrs. W. M. Haskell, Clerk (3) In voting precinct No. -3 said election shall be held at the Gladys Street Fire Station, and said election shall be conducted at said voting box by the following officers: Mrs. L. M. Coy, Judge Mrs. Nettie Close, Clerk T. A. Nicholson, Clerk Mrs. Anita Christian, Clerk (4) In voting precinct No. 4 said election shall be held at the Averill School Building, and said election shall be conducted at said voting box by the following officers: W. Nichols (5) In voting precinct No. 5 said election shall be held at the Beaumont High School Building, and said election shall be conducted at said voting box by the following officers: Mrs. B. D. Crosby, Clerk (42) In voting precinct No. 42 said election shall be held at the South Park High School Building, and said election shall be conducted at said voting box by the following officers: G. Rice., -Clerk J (47) In voting precinct No. 47 said election shall be held at St. Anne's School Building, and said election shall be -conducted at said voting box by the following officers: Mrs. W. T. McNeill, Judge Mrs. J. Paul McNeill, Clerk Mrs. Murl C. Davis, Clerk Miss Claudine Boone, Clerk (50) In fractional voting precinct No. 50 said election shall be held at Azalea Gardens, and said election shall be conducted at said voting box by the following officers: Mrs. D. B. Eberhard, Judge Mrs. Vernon Bazine, Clerk Mrs. R. H. Barrett, Clerk Mrs. J. H. Bergin, Jr., Clerk Any voter, otherwise a qualified elector, having paid his poll tax in any of the above-described voting precincts and living in territory outside the limits of the City of Beaumont, shall not be entitled to vote in said election. None but resident, qualified electors who own taxable property in the City of Beaumont, Texas, and who"., -have duly rendered the same for taxation therein shall be allowed to vote at this election. A voting machine shall be provided for the casting of absentee ballots at this election, and the place designated for the casting of absentee ballots shall be at the City Hall in the City of Beaumont, Texas, and all those residing within the City of Beaumont, Texas, qualified to vote at this election shall be entitled to cast absentee ballots at said place, and said absentee voting shall be conducted at said voting place by James T. Garrard, judge, with authority to appoint his assistants and clerks. SECTION 6 Said election shall be held under the provisions of and in accord- ance with the laws governing the issuance of municipal bonds in cities, as provided in the Constitution and General Laws of the State of Texas, and the manner of holding said election and making returns thereof shall be governed by the laws of the State of Texas governing general elections, and voting machines shall be used in said election in accordance with Article 7.14 et seq., of the Election Code of 1951, Acts of 19512 52 Legislature, Page 1097, Chapter 492; and only qualified electors of said city, who own taxable property in said city and who have duly rendered the same for tax- ation shall be qualified to vote at said election, and all electors shall vote in the election precinct of their residence. SECTION 7 The City Clerk of the City of Beaumont is hereby directed to procure and furnish the necessary ballots for said election and the -necessary election supplies, and immediately after said election has been held, the officers holding the same shall make return of the results thereof to the City Council of the City of Beaumont, Texas, as provided by law. SECTION 8 A copy of this ordinance, signed by the Mayor of the City of Beaumont and attested by the City Clerk of the City of Beaumont, shall serve as proper and sufficient notice of said election, and the Mayor is hereby directed to cause one each of said notices to be posted in each of the election precincts within. the City of Beaumont, and at the City Hall, such posting to be note less than fifteen (15) full days prior to the date set for said election, and he shall further cause said notice to be published on the same day in each of two (2) successive weeks in a newspaper of general circulation published within said city, the date of the first publication to be not less than fourteen (14) full days prior to the date set for said election. And the person posting said notices shall make a return on the copy thereof, showing the times and places of posting, and the return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice, and the affidavit of the publisher of the newspaper, stating the days on -which the same was published, shall be filed in the office of the City Clerk and shall be conclusive evidence of the publication of said notice. SECTION 9 passage. This ordinance shall take effect from and after the date of its PASSED this, the 15th day of July, 1952, by the affirmative vote of all members of the City Council of the City of Beaumont, Texas.
