HomeMy WebLinkAboutORD 30-XAN ORDINANCE ENTITLED AN ORDINANCE AUTHORIZING THE VACATING AND ABANDONMENT OF ALLEYS LOCATED IN BLOCK ELEVEN (11) OF THE JARRETTE ADDITION, BLOCK NINE (9) OF THE GOLDHILL SECOND ADDITION, AND BLOCK NINETY- THREE (93) -OF THE PINECREST ADDITION, IN THE CITY OF BEAUMONT, TEXAS, RESERVING, HOWEVER, THE RIGHT OF THE CITY OF BEAUMONT TO CONSTRUCT AND MAINTAIN IN SAID ALLEYS SEWER LINES, WATER LINES, AND OTHER UTILITIES, AND RESERVING THE RIGHT OF THE CITY OF BEAUMONT TO GRANT.FRANCHISE RIGHTS TO OTHERS TO CONSTRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH AND ALONG SAID ALLEYS, AND PRO- HIBITING THE OBSTRUCTION OF SAME BY ANY BUILDING OR STRUCTURE. WHEREAS, petitions signed by all of the property owners of Block 11 of the Jarrette Addition, Block 9 of the Goldhill Second Addition, and Block 93.of the Pinecrest Addition to The City of Beaumont have been presented to the City Council of The City of Beaumont, requesting that the alleys in said Blocks be vacated and abandoned; and WHEREAS, said petitions have been referred to the City Planning Commission for examination and approval, and the same have been approved by said Commission; and WHEREAS, said petitions have been duly canvassed and exam - fined by the City Council and have been found to have been signed by all of the property owners in said Blocks, and it appearing to the City Council that the request of said property owners should be granted and that an ordinance should be enacted vacating and abandoning said alleys, reserving, however, to The City of Beaumont the right to construct and maintain all necessary public utilities in said alleys, or to grant franchises for the construc- tion and maintenance of such utilities in said alleys; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the alleys through Block 11 of the Jarrette Addition, Block 9 of the Goldhill Second Addition, and Block 93 of the Pinecrest Addition to The City of Beaumont be, and the same are hereby, authorized to be vacated and abandoned, and that the title to such alleys should revert to and become the property of the persons entitled thereto, as provided by law; provided, however, that the vacating and abandoning of said alleys shall in no way affect the right of The City of Beaumont to place and maintain therein sewer, gas, and water lines, telephone, telegraph, and electric wires, poles, and cables, or any other public utility service. Neither shall the vacating and abandoning of said al- leys affect the right of The City of Beaumont to grant franchises to any person, firm, or corporation authorizing the placing and maintaining in said alleys of such sewer, gas, or water line, telephone, telegraph, or electric lines, or other public utility service, all of which rights are hereby expressly reserved. And the vacating and abandoning of said alleys shall not be construed as authorizing or permitting any person, party, corporation or legal entity whatsoever to erect, construct, build, move onto or place any building or structure thereon, and the erection, con- struction, building, moving onto or placing of any building or structure therein -without express permission from the City Coun- cil to do so is hereby prohibited. B. Holland, Chairman C. E. Holland, Vice—Chairman Leonard Stone Bliss Florence McCluskey, Secretary Russell Phelps Absents P. G. Matthews —000— Others Present: Mr. R. Clyde Black, City Engineer Mr. George Schaumburg Mr. Clarence Kolter Minutes of the special meeting of the City Planning Commission held July 11, 1951, were approved :, m&Aon made 'by Leonard Stone and seconded by C. E. Holland. Passed by the Commission. After a brief discussion, C. E. Holland asked that the City Planning Commission go on record as requesting City Attorney Murphy to prepare a resolution for Mrs. K. C. Withers extending the Commission's deepest sympathy at the untimely death of Mr. Withers, and to be signed by all Commission members as individuals* Mr. C. B. Holland, Chairman, was appointed by the Commission to speak with City Attorney Murphy concerning the resolution. -000-. Mr. C. E. Holland made a motion, seconded by Miss Florence McCluskey, that the City Planning Commission recommend to the City Council that the following alleys be closed and vacated: Alley through Block 11 of the Jarrette Addition Alley through Block 9 of the Gold Hill Second Addition Alley through Block 93 of the Pinecrest Addition. Mr. Black, City Engineer, stated that the petitions had been signed by all property owners. Passed by the Commission. Mr. Clarence Kolter appeared before the City Planning Commission and requested that the Commission recommend to the City Council that the additional right of way needed for the opening of Gladys Street west of Eleventh Street be condemned by the City, and that the Commission go on record as approving the opening of Gladys Street west of Eleventh Street. Mr. Stone made a motion that the Commission go on record as recommending to the City Council that Gladys Street west of Eleventh Street be opened by whatever means necessary to do so, and that Mr. C. B. Holland, Chair man of the Commission appear before the City Council at their next meeting on October 9, 1951) and m011y make the same recommendation. The motion Was seconded by C. E. Holland, and passed by the Commission. —000— Mr. George Schaumburg presented for preliminary approval a plat of the Lincoln Terrace First Addition located west of Fourth Street and south of Sarah Street, Preliminary approval was granted on motion made by Russell Phelps and seconded by Miss McCluskey. Unanimously passed by the Commission. A plat of Lynwood Terrace Addition, Block 7, was presented for pre— liminary approval by'Mr. Schaumburg. Mr. Schaumburg explained that this addition fronts on Steelton Street. Preliminary approval was granted on motion made by Leonard Stone and seconded by Miss McCluskey.
