HomeMy WebLinkAboutORD 28-XART ORDINANCE AN ORDINANCE AUTHORIZING THE PROPER OFFICIALS OF ?HE CITY OF BEAUMONT TO EXECUTE AND DELIVER A SPECIAL WARRANTY DEED CONVEYING TO TEXAS &-NEW ORLEANS RAILROAD COMPANY CERTAIN.PROPERTY AS RIGHT-OF-WAY FOR RELOCATION OF'RAILROAD.LINE IN CONNECTION WITH U. S. HIGHWAY 90 PROJECT WHEREAS, in connection with the U. S. Highway 90 Project it is necessary to relocate a railroad line of,the Texas & New Orleans Railroad Company for the purpose of constructing an overpass over this line and a line owned by;the Santa Fe Railroad Company and the City has hereto- fore entered into a -contract dated November 7, 1950, wherein the City agreed to purchase the necessary right- of-way for such relocation and would then convey such property to the railroad company; and, WHEREAS) in accordance with this agreement the - City has acquired in its'name the property needed for re- locating said railroad track and is now ready to transfer same to the Texas & New Orleans Railroad Company and a special warranty deed has-been .prepared to effect such a transfer; and, WHEREAS, the City Council is of the opinion that it is for the best interest of the City that such property be conveyed to -the Texas & New Orleans'Railroad Company for the reasons above set forth; NOW, THEREFORE J. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS; That Otho Plummer, Mayor of the'City of Beaumont, be and he is hereby.authorized to execute for and on behalf of said City that certain special warranty deed above re- ferred to,conveying to the Texas & New Orleans Railroad Com- pany the above mentioned property purchased by the City for the relocation of the -railroad track in connection with the U. S. Highway 90 Project, and the City Clerk be and he is hereby authorized to attest to said instrument and to affix the official seal of the City of Beaumont thereto.
