HomeMy WebLinkAboutORD 11-XI SCF-., �� x AN ORDINANCE ENTITLED AN ORDINANCE ORDERING THE SUBMISSION OF THE QUESTION OF THE AMENDMENT OF SECTION 3, ARTICLE IV OF THE CITY CHARTER OF BEAUMONT, TEXAS, AT THE GENERAL MUNICIPAL ELECTION ON H THE H DAY OF APRIL, 1952; PROVIDING THE IS- SUES TO BE SUBMITTED AND THE FORM OF BALLOTS, AND PROVIDING FOR NOTICE. WHEREAS, the City Council has heretofore by resolution passed the 5th day of February, 1952, given notice of the intention to submit at the regular municipal election on April 8, 1952, the question of amending Section 3 of Article IV of the City Charter of Beaumont, Texas, to provide for the regular municipal election to be held on the second Tues- day in May, 195., and on the second Tuesday of May every two years thereafter; and, WHEREAS, said notice of intention has been published for a period of twenty (20) days, as provided by the laws of the State of Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That at the regular municipal election heretofore called by ordinance for the 8th day of April, 1952, there shall be sub- mitted to the qualified voters of The City of Beaumont the question of amending Section 3 of Article IV of the Charter of The City of Beaumont so as to provide that all elective offi- cers under the Charter shall be elected at the regular munici- pal election which shall be held on the second Tuesday in May, 1954, and on the second Tuesday in May every two years thereafter, and that all officers elected at said election shall take office on the first Tuesday following said election. Section 2. A separate ballot .shall be used for the submission of the question concerning the amendment of the Charter and there shall be printed on the ballot to be used in said election the following: "PROPOSITION. "SHALL SECTION 3, ARTICLE IV OF THE CHARTER OF THE CITY OF BEAUMONT, TEXAS, BE AMENDED TO READ AS FOLLOWS: 'SECTION 3 --GENERAL ELECTIONS HELD: ALL ELECTIVE OFFICERS UNDER THIS CHARTER SHALL BE ELECTED AT THE REGULAR MUNICIPAL ELECTION WHICH SHALL BE HELD ON THE SECOND TUESDAY IN MAY, 195., AND ON THE S8COND TUESDAY IN MAY EVERY TWO (2) YEARS THEREAFTER. ALL OFFICERS ELECTED AT SAID ELECTION SHALL TAKE OFFICE ON THE FIRST TUES- DAY FOLLOWING THE SAID ELECTION.t" All voters desiring to vote for the amendment of the Charter as submitted in the above proposition shall vote on the voting machine: "Yes", and all voters desiring to vote against the amendment shall vote on the voting machine: "No." Section 3.. Should a majority of the qualified voters voting in said election vote for the amendment of Section 3, Article IV of the Charter of The City of Beaumont, Texas, then said Section shall be amended and hereafter Article IV, Section 3 of the Charter of The City of Beaumont shall be as written in said proposition above. Should a majority of the qualified voters voting in said election vote against the proposed amendment, then in such event Section 3, Article IV of the Charter of The City of Beaumont shall remain as a part of the Charter of The City of Beaumont as now written. Section 4. The City Clerk will mail a copy of the proposed proposi- tion to amend�3Section 3, Article IV of the City Charter to every qualified voter in the City as appears from the Tax Col- lector's roll for the year ending January 31, 1952,.said 2. f} l notices shall be mailed immediately upon the adoption of this ordinance so as to give all qualified tax payers thirty (30) days? notice, as required by law. Murphy, City Attorney Subject: Amendment to Charter. ,,COMMENT: The form of the notice to be given the voters in con- nection with -the amendment--of-the charter at the General Election should read as follows: NOTICE At the GenAral Election on April 8, 1952, the amendment of Section 3, Article IV of the City_,. Charter will be submitted to the voters in the following form: PROPOSITION "SHALL SECTION 3, ARTICLE IV OF THE CHARTER OF THE CITY OF-BEAUMONT,.TEXAS, BE AMENDED TO READ AS FOLLOWS: tSECTION 3 --GENERAL ELECTIONS HELD: ALL EXECUTIVE -OFFICERS UNDER THIS CHARTER SHALL BE ELECTED AT THE REGULAR MUNICIPAL ELECTION WHICH SHALL BE HELD ON THE SECOND TUESDAY IN MAY, 1954, AND ON THE SECOND TUESDAY IN MAY EVERY TWO (2) YEARS THEREAFTER. ALL OFFICERS ELECTED AT SAID ELECTION SHALL TAKE OFFICE ON THE FIRST TUES- DAY FOLLOWING THE SAID ELECTION.t" -= -This notice should be mailed -immediately after Tuesday as the statute requires that thirty (30) dayst notice be given.
