HomeMy WebLinkAboutORD 2-XAN ORDINANCE ENTITLED AN ORDINANCE AMENDING AN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT ON SEPTEMBER 2$, 1948, ENTITLED "AN ORDINANCE AMENDING ARTICLES 29-17,31)-3, AND 31-4, RESPECTIVELY, OF THE CODE OF THE CITY OF BEAUMONT REQUIRING HEALTH CERTIFICATE OF EVERY PERSON IN A FOOD -PRODUCTS ESTABLISHMENT WHOSE WORK BRINGS THEM IN CONTACT WITH FOOD PRODUCTS, AND FIXING A CHARGE.FOR SAID HEALTH CERTIFICATE; REQUIRING A MEDICAL EXAMINATION PRIOR TO ISSUING A HEALTH CERTIFICATE TO DOMES- TIC SERVANTS; PRESCRIBING THE. CONTENTS OF -SUCH CERTIFICATE, AND FIXING A CHARGE THEREFOR; AND REPEAL OF.ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT. OR CONTRARY HERETO." BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That Section 1 of the ordinance entitled: "AN ORDINANCE AMENDING ARTICLES 29-17, 31-3, AND 31-4. RESPECTIVELY, OF THE CODE OF THE CITY OF BEAUMONT. REQUIRING HEALTH CERTIFICATE OF. EVERY- PERSON. IN A FOOD PRODUCTS ESTABLISH- MENT WHOSE WORK BRINGS THEM IN CONTACT WITH FOOD PRODUCTS AND FIXING A CHARGE FOR SAID HEALTH CERTIFICATE; REQUIRING.A MEDICAL EXAMI- NATION PRIOR TO ISSUING A HEALTH CERTIFICATE T:0 DOMESTIC SERVANTS; PRESCRIBING THE CONTENTS OF SUCH CERTIFICATE, AND FIXING A CHARGE THERE- FOR; AND REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR CONTRARY HERETO," is hereby amended to read as follows: "Art. 29-17. Health Certificate. - Every person in a food products establishment whose work brings him in contact with the production, handling, storage or transportation of food products, shall hold a certificate from the City Health Officer certifying to the fact that the said person has theretofore within six (6) months filed with the Health Officer a certificate signed by a legally licensed physician residing in Jefferson County and registered to practice therein stating that the said person has been physically examined by him and that the said person does not have a venereal disease in a communicable stage and that said person does not have tuberculosis of an active type which would be considered dangerous to public health and that said person is free from acute ex- anthemata or acute infectious or contageous skin diseases or any other infectious or contageous di- seases considered dangerous to public health by the examining physician; said physiciants certifi- cate shall be accompanied by a report from a labor- atory operating in The City of Beaumont whose pro- ficiency in making tests required for public health purposes shall have been proven to the satisfaction of the Health Officer showing that a Wassermann test has been made within five (5) days prior thereto and giving the results thereof; said physiciants certificate shall also be accom- panied by -a report showing the results of an X-ray examination for tuberculosis made within the previous thirty (30) days. The City Health Officer shall charge a fee of $1.25 for each health certificate issued by him, as provided herein." Section 2 of said ordinance is hereby amended to read as follows: Articles 31-3 and 31-4 of the Code of The City of Beaumont be and the same are hereby amended to read: "Art. 31-3. Examination prior to issuance_. - The health certificate shall be issued by the City Health Officer to any domestic servant ap- plying therefor only after a medical examination has been made of said applicant. The City Health Officer shall charge a fee of $1.25 for each health certificate issued by him as provided herein." "Art. 31-4. Contents of certificate. - The health certificate, when issued, shall certify to the fact that the person has theretofore within six (6) months filed with the City Health Officer a certificate signed by a legally licen- sed physician residing in Jefferson County and registered to practice therein, stating that the said person has been physically examined by him, that the said person does not have a venereal disease in a communicable stage and that said person does not have tuberculosis of an active type which would be considered dangerous to pub- lic health, and that said person is free from acute exanthemata or acute infectious or conta- geous skin diseases or any other infectious or contageous diseases considered dangerous to pub- lic health by the examining physician; said phy- siciants certificate shall be accompanied by a report from a laboratory operating in The City of Beaumont whose proficiency in making tests re- quired for public health purposes shall have been proven to the satisfaction of the Health Officer, showing that a Wassermann test has been made within five (5) days prior thereto and giving the results thereof; there shall also be filed with the physiciants certificate a report showing the results of an.X-ray examination for tuberculosis made within the previous thirty (30) days. Section 3 of said ordinance shall read as follows: Separability- and Savings Clause. - If any section, sub- section, sentence,.clause�, phrase or portion of this Ordinance is for any reason held invalid or'unconstitutional by any court 2. of competent jurisdiction, such section, subsection., sentence, clause, phrase, or portion shall be deemed a separate, dis- tinct and independent provision and such holding shall not affect the validity or constitutionality of the remaining por- tions thereof. Section 4 of said ordinance shall read as follows: All parts of ordinances inconsistent or contrary here- to are hereby expressly repealed. PASSED by the City Council this 13th day of November, A.
