D. 1951, ENTITLED "AN ORDINANCE REGULATING THE INSPECTION AND SALE OF -MEAT IN THE CITY'OF BEAUMONT; CONTAINING DEFINITIONS; PROVIDING FOR INSPECTION; PROVIDING INSPECTION FEES; PROVIDING EXCEPTIONS; PROVIDING A SEVERABILITY CLAUSE; RE- PEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT, AND PROVIDING PENALTIES." BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Sections 5 and 12 of an ordinance passed by the City Council of The City of Beaumont on May 15, 1951, entitled: "AN ORDINANCE REGULATING THE INSPECTION AND SALE OF MEAT IN THE CITY OF BEAUMONT; CONTAINING DEFINITIONS; PROVIDING FOR INSPECTION; PROVIDING FOR INSPECTION FEES; PROVIDING EXCEPTIONS; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT, AND PROVIDING PENALTIES9" be', and the same are hereby, amended so as to read as follows: "Section 5: Permit Required. - It shall be unlawful of r any person, either For Himself or as agent or em- ployee of another, to sell, or offer, or expose for sale, or deliver for sale, use or comsumption, or have in his possession for sale or delivery within the city any meat or meat --food product unless holding a valid and unrevoked permit from The City of Beaumont, provided, however, that such a permit shall not be required of any person, firm or corporation engaged in retail business of selling meat or meat products or meat -food products, and provided, further, that such a permit shall not be required of any eating or drink- ing -establishment, within the city limits which holds a restaurant license issued under the provisions of the ordinances of The City of Beaumont, and which pro- cures its meat and meat -food products only from the holders of wholesaler permits, as provided by this ordinance, and provided further that the provisions of this Section shall not apply to the possession, sale or delivery of meat or meat -food products which are procured and sold or delivered either to the con- sumer or to a licensed eating and drinking establish- ment in the original sealed container labeled and marked in accordance with provisions of applicable State and Federal laws. No form of packaging shall be considered an original sealed container, as the term is used in this Section, unless clearly marked or labeled as to the contents and the place where packed." Ll�� r I1:7 ."Section 12; Time of Inspection. Regular inspec- tions will be -Fu a a during regular working hours, viz; $:00 a.m. until 5:00 p.m. on work days. In the event an abattoir permit holder requires an inspec- tion at times other than between $;00 a.m. and 5;00 p.m. on work days, the Health Department will fur- nish an inspector if said request is reasonable, provided the charge for such special inspection will be double that provided for herein, namely thirty (30¢) cents per head for the inspection of all ani- mals."
