THE ' CITY OF, BEAUMONT, TEXAS, RE- SERVING HOWEVER, THE RIGHT OF THE_CITY OF BEAUMONT TO CONHRUCT AND MAINTAIN_ IN SAID ALLEY SEWER LINES, WATER LINES, AND OTHER UTILITIES, AND RESERVING THE RIGHT OF THE CITY OF BEAUMONT.TO GRANT A FRANCHISE RIGHT TO OTHERS. TO CONSTRUCT, AND MAINTAIN ,THE UTIL- ITIES HEREINBEFORE MENTIONED THROUGH AND ALONG SAID ALLEY,.AND.PROHIBITING.THE.OBSTRUCTION OF SAME BY ANY BUILDING ORSTRUCTURE° WHEREAS, the property owners of Lots Seven (7) to Twelve (12) of the Highland Addition and Lots Six (6) to Ten (10), Block Three (3), University Place Second Addition to The City of Beaumont have presented a petition to the City Council of The City of Beaumont, requesting that the alley in this Block be va- cated and abandoned; and WHEREAS, said petition has been referred to the City Plan- ning Commission for examination and approval, and the same -has been approved by said Commission; and WHEREAS, said petition has,been duly canvassed and examined by the City Council and has been found to, have been signed by all - of the property owners of Lots 7 to 12, Highland Addition, and Lots 6 to 10, Block Three, University Place Second Addition, and it appearing to the City Council that the request of said property" owners should be granted and that an ordinance should be enacted vacating and abandoning said alley, reserving, however, to The City of Beaumont the right to construct and maintain all necessary pub- lic utilities in said alley, or to grant a franchise for the con- struction and maintenance of such utilities in said alley; NOW, THEREFORE,..B.E IT ORDAINED BY THE CITY OF BEAUMONT: That the alley running: -between Lots 7 to 12, Highl&hd Addition and Lots 6 to 10'. Block 3, University Place Second Addition to The City of Beaumont be, and the.same are hereby, authorized to be vacated and abandoned, and that the title to such alley should re- vert to and become the I °Ia M-1<75-1 property of the owners of land in said Block bordering said alley, as provided by law; provided, however, that the vacating and aban- doning of said alley shall in no way affect the right of The City of Beaumont to place and maintain therein sewer, gas, and water lines, telephone, telegraph, and electric wires, poles, and cables, or any other public utility service. Neither shall the vacating and abandoning of said alley affect the right of The City of Beau- mont to grant a franchise to any person, firm, or corporation authorizing the placing and maintaining in said alley of such sewer, gas, or water line, telephone, telegraph, or electric lines, or other public utility service, all of which rights are hereby ex- pressly reserved. And the vacating and abandoning of said alley shall not be construed as authorizing or permitting ar_y person, party, corporation, or legal entity whatsoever to erect, construct, build, move onto or place any building or structure thereon, and the erection, construction, building, moving onto or placing of any building or structure therein without express permission from the City Council to do so is hereby prohibited. COUNTY Of' JEFii'EnSON : WE, the undersigned, being the sole owners of all the LOTs T TO 12 property located irk/ Block 1 , of the HI CHL AND ADDITION Addition to the City of Beaumont, hereby respectfully petition LoTs 7` To 12 that the alley located in/Block 1 , j6HLAHD Addition be closed in the manner as permitted by the statutes of the State of Texas, and that such alley become the absolute property of the owners of the land it said block adjacent and abutting on such alley, it being understand, however, that the closing of this alley shall in no way affect the rights of the Uity as to placing and maintaining therein of any sewer or water lines, or telephone, telegraph, or electric lines, wires poles, or cables or any other service or utility of the City, or the right of the City to grant franchises to persons or corporations to place and maintain therein any such sewer or water line,., -or telephone, telegraph, or electric lines, wires, poles, or cables, or any other service -or- utility of the City. SPECIAL MEETING CF THE CITY PLANNING COIDIISSION HELD JULY 110 1951 BE IT' REIJMIBERED that the City Planning Commission of the City of Beaumont, Texas, met in special session on July 11, 1951, with the following present: C. B. Holland, Chairman Others Present: Leonard Stone Miss Florence McCluskey, Secretary R, Clyde Black, City Engineer Matthew Cartwright Absent: C. E, Holland, Vice—Chairman Russell Phelps P. G. Matthews K. C. )dithers —000— Minutes of the special meeting of the City Planning Commission held May 30, 1951 were approved on motion made by Leonard Stone and seconded by Miss Florence McCluskey. -Passed by the Commission. Miss McCluskey made a motion, seconded by Leonard Stone, that the City Planning Commission recommend to the City Council that the alley through Block 135, Pinecrest Addition be closed and vacated. Mr. Black, City Engineer, stated that the petition had been signed by all property owners. Passed by the Commission. .!7 M. Leonard Stone made a motion, seconded by Miss McCluskey, that the City Flaming Commission recommend to the City Council that the alley between Lots Nos. 7 to 12, Highland Addition and Lots Nos. 6 to 10, Block Three, University Place Second Addition be closed and vacated. Mr. Black, City Engineer, stated that the petition had been signed by all the property owners. Passed by the Commission. —000— Mr. Black presented for final approval a plat of the Fannin Street Addition which is located in the west section of Beaumont and is bounded by Eleventh, Fannin and College Streets. Leonard Stone made a motion seconded by Miss McCluskey, that final approval be given the Fannin Street Addition. Passed by the Commission. Mr. Black also presented for final approval a plat of the Reinke Addition which is bounded by Helbig Road, Meetzen Avenue, and Myers Lane. Miss McCluskey made a motion, sgconded by Leonard Stone, that final approval be given the Fbalmke Additions Passed by the Commission. —000— # Mr. 0, B.
