BLOCK ONE HUNDRED THIRTY-FIVE (135) OF.THE PINECREST ADDITION TO THE CITY OF.BEAUMONT, TEXAS, RESERVING, HOWEVER,.THE.RIGHT OF. THE CITY OF .BEAUMONT TO CONSTRUCT. AND MAINTAIN IN SAID ALLEY SEVER LINES, WATER LINES, AND OTHER UTIL-. ITIES AND RESERVING THE RIGHT.OF THE CITY.OF BEAUMONT TO GRINT A FRANCHISE RIGHT.TO,OTHERS TO CONSTRUCT AND. MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH AND ALONG.SAID ALLEY, AND PROHIBITING THE OBSTRUCTION OF .SAME BY ANY BUILDING OR STRUCTURE. WHEREAS, a petition signed by all of the property owners of Block One Hundred Thirty -Five (135) of the Pinecrest Addition to The City of Beaumont has been presented to the City Council of The City of Beaumont, requesting that the alley in said Block be vacated and abandoned; and WHEREAS, said petition has been referred to the City Planning. Commission for examination and approval, and the same has been approved by said Commission; and WHEREAS, said petition has been duly canvassed and examined by the City Council and has been found to have been signed by all of the property owners in said Block, and it appearing to the City Council that the request of said property owners should be granted and that an ordinance should be enacted vacating and abandoning said alley, reserving, however, to `.The City of Beaumont the right to construct and maintain all necessary public utilities in said alley, or ,to grant a franchise for the construction and maintenance of such utilities in said alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the alley running through Block One Hundred Thirty -Five (135) of Pinecrest Addition to The City of Beaumont be, and the same is here- by, authorized to be vacated and abandoned, and that the title to such alley should revert to and become the property of the persons entitled thereto, as w . a provided by law; provided, however, that the vacating and aban- doning of said alley shall in no way affect the right of The City of Beaumont to.place and maintain therein sewer, gas, and water lines, telephone, telegraph, and electric wires, poles, and cab- les, or any other public utility service. Neither shall the vacating and abandoning of said alley affect the right of The City of Beaumont to grant a franchise to any person, firm, or corpora- tion authorizing the placing and maintaining in said alley of such sewer, gas, or water line, telephone, telegraph, or electric lines, or other public utility service, all of which rights are hereby expressly reserved. And the vacating and abandoning of said alley shall not be construed as authorizing or permitting any person, party, corporation or legal entity whatsoever to erect, construct, build, move onto or place any building or structure thereon, and the erection, construction, building, moving onto or placing of any building or structure therein without express per- mission from the City Council to do so is hereby prohibited. PASSED by the City Council this 17th day of July, A.D. 1951. - Mayor - SPECIAL MEETING OF THAI CITY PLANNING COWIISSION HELD JULY 11, 1951 BE IT- REIJ1E MERED that the City Planning Commission of the' City of Beaumont, Texas., met in special session on July 11, 1951, with the following present: C. B. Holland, Chairman Others Present: Leonard Stone Miss Florence McCluskey, Secretary R. Clyde Black, City Engineer Matthew Cartwright Absent: C. E. Holland, Vice -Chairman Russell Phelps # P. G. Matthews K. C. Withers -000- Minutes of the special meeting of the City Planning Commission held May 30„ 1951 were approved on motion made by Leonard Stone and seconded by Miss Florence McCluskey. Passed by the Commission. Miss McCluskey made a motion, seconded by Leonard Stone, that the City Planning Commission recommend to the City Council that the alley through Block 135, Pinecrest Addition be closed and vacated. Mr. Black, City Engineer, stated that the petition had been signed by all property owners. Passed by the Commission. -000- Leonard Stone made a motion, seconded by Miss McCluskey, that the City Planning Commission recommend to the City Council that the alley between Lots Nos. 7 to 12, Highland Addition and Lots Nos. 6 to 10, Block Three, University Place Second Addition be closed and vacated. Mr. Black, City Engineer, stated that the petition had been signed by all the property owners. Passed by the Commission. Mr. Black presented for final approval a plat of the Fannin Street Addition which is located in the west section of Beaumont and is bounded by Eleventh, Fannin and College Streets. Leonard Stone made a motion seconded by Miss McCluskey, that final approval be given the Fannin Street Addition. Passed by the Commission. Mr. Black also presented for final approval a plat of the Reincke Addition which is bounded by Helbig Road, Meetzen Avenue., and Myers Lane. Diss McCluskey made a motion, sgconded by Leonard Stone, that final approval be given the Re`incke A&aitiona Passed by the Commission. —000— Mr, C. B. Holland was authorized to vote for Mr. Russell Phelps by proxy. There being no farther business the meeting was adjourned by Mr. Holland. Isl C. B. COUNTY 01' JEFiiEit60N : WE, the undersigned, being the sole owners of all the property located in Blockof theC 7 Addition to the City of Beaumont, hereby respectfully petition that the alley located in Block Addition be closed in the manner as permitted by the statutes of the State of Texas, and that such alley become the absolute property of the owners of the land in said block adjacent and abutting on such alley, it being understand, however, that the closing of this alley shall in no way affect the rights of the City as to placing and maintaining therein of any sewer or water lines, or telephone, telegraph, or electric lines, wires poles, or cables -or any other service or utility of the City, or the right of the City to grant franchises to persons or corporations to place and maintain therein any such severer or water line, or telephone, telegraph, or.electric line-, wires, poles, or cables, or any other service -or utility of the City. NOTE: This petition cannot be acted'upon favorably if water line is in the alley.
