HomeMy WebLinkAboutORD 32-WAN ORDINANCE AN ORDINANCE PROVIDING FOR THE LICENSING AND REGISTRATION OF ELECTRICIANS; PROVIDING FOR ISSUANCE OF PERMITS,, COLLEC- TION OF FEES THEREFOR, AND INSPECTION OF ELECTRICAL WORK; SETTING FORTH STANDARDS FOR ELECTRICAL INSTALLATIONS, EQUIPMENT, AND SIGNS; PROVIDING FOR APPROVED WIRING METHODS; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR SEP- ARABILITY AND SAVINGS CLAUSE; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. �-13-1�r1 BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: CHAPTER I - TITLE AND SCOPE Sec. 1-1, Title: The title of this Ordinance shall be tt.The Beaumont Electrical Code,tt and may be cited as such, and it will be referred to in this Ordinance as "This Code,tt See. 1-2, Purpose: The purpose of this Code is the practical safeguarding of per- sons and buildings and their contents from electrical hazards arising from the improper use of electricity for light, heat, power, radio,'sigrialing, and for other purpose*. Sec. 1-3, Scope The provisions of this Code shall apply to all installations of and work done on electrical conductors, fittings, devices., motors, controls, ap- pliances, fixtures, electronic devices, signs and gaseous tubing, hereinafter referred to as t1electrical equipment.." within or on public and private buildings and premises with exceptions as provided herein. (a) On all installations of electrical conductors or equipment here- after made,, and all existing installations which are altered, or for which the use hac 'changed, ali work shall be done in a manner -iat will conform with,the re-, quirements for 3 sufficient and safe electrical structure and system under this Code. lwi (b) Repair and maintenance work shall be such that if any "electrical conductor or equipment" -is removed and later replaced, same shall be replaced in accordance with the provisions of this Code. See. 1-4, Public Utilities: The provisions of this Code shall not apply to in- stallations made or used by agencies'in the generation, transmission or distribu- tion of electricity, or for the operation of street railways, signal or transmis- sion of intelligence when located within or on buildings, enclosures, or premises used exclusively by such an agency or on public thoroughfares; provided, however, that such agencies excepted are operating under a valid franchise agreement with The City of Beaumont, Texas. Sec. 1-5, Radio Stations: The provisions of this Code shall apply to electrical equipment used for supplying electrical power for radio transmission in amateur radio transmitting stations and shall apply to all electrical equipment used for power supply to radio transmitting equipment, but shall not apply to other elec- trical equipment used for radio transmission. Sec. 1-;6, Signs and Gaseous Tubing: This Code shall apply to all forms of elec- trical signs, gaseous tubing, and outline lighting conductors and equipment. All sign structures,_ attachment to buildings and/or foundations shall be approved by the City Building Inspector as set forth in Sections covering the construction and erection of signs in the Building Code prior to inspection under this Code. Sec. 1-7, Responsibility for -;Safe Work: The electrical regulations of this Code shall not be construed to relieve from or lessen the responsibility or liability of any person owning, operating, or installing electrical conductors, devices, appliances, fixtures, apparatus, motors, or equipment, for damages to persons or . buildings caused by any defect therein by reason of the inspection herein author- ized or the certificate of approved inspection issued by the Electrical Inspection Section as herein provided; nor shall the City be held liable for any damages by reason of the enforcement of this Code. CHAPTER II - DEFINITIONS: Sec. 2-1, Approved or Approval: ttApprovedtt or "approval" shall mean approved by the City Electridal Inspector. National, state, and city standards shall be the basis of such approval. Sec. 2-2, Authorized Persons:- 44Authorized person" shall mean an individual or authorized representative of a firm or corporation who is licensed under the pro- visions of this Code to do the work as permitted under the specific provisions of this Code. Sec. 2-3, City: "City" shall mean the territory within the corporate limits of The City of Beaumont, Texas, or the legally constituted governing body thereof, its agents and its officers. Sec. 2-4 Conductor: ttConduetortt shall mean a wire or cable or other form of metal suitable for carrying electrical current or potential. Sec. 2-5, Electrical Construction: ttElectrical construction" shall mean and in- clude all work and material used in the installing, maintaining, and extending a system of electrical wiring, and all appurtenances, apparatus, and equipment used in connection therewith, inside of or attached to any building or structure, lot, or premises. Sec. 2-6, Equipment: ttEquipmenttt shall mean conductors, materials, fittings, de- vices, appliances, fixtures, signs, apparatus, motors, and the like, used as a part of or in connection with any electrical installation. Sec. 2-7. Inspector: ttlnspectortt shall mean an individual who has been designated by The City of Beaumont as an Electrical Inspector. Sec. 2-8, Maintenance and Repair: "Maintenance and Repair" shall mean the act of keeping in a state of safe operating condition any conductor or piece of equipment used inside or outside, attached or connected to any building electrical system, by replacement of units or elements thereof, but shall not include extensions of or additions to an existing system or branch thereof. Sec. 2-9., Outside Electrical Work: 710utside Electrical WorkW shall .mean the in- stalling, maintaining, altering, repairing, or erecting of any electrical wiring, apparatus, devices, appliances, fixtures, or equipment loeatek outside of and separate from buildings and on poles, towers,.or other structures designed or con- structed to be used exclusively for the support of such electrical wiring, appara- tus, devices, appliances, fixtures, or equipment for which a permit is required under the terms of this Code, except that overhead conductors may be attached to buildings. Sec. 2-10, Registered: "Registeredtt shall mean that person who has made applica- tion to the Examining Board and has satisfied the Board that he is qualified to do the work stated in the application, that he has paid the necessary registration fees to date, and that his name is carried in the records of the Chief Electrical Inspector as a person authorized to do electrical work as defined in this Code; and also means and includes any person who has been issued a Master Electricians li- oense in accordance with the provisions of this Code. ;ec. 2-11, Advertising Matter: It shall be unlawful for any person, firm, or cor- poration to place or allow to be placed any advertising cards, posters, or any like material on any poles within the city limits of Beaumont used for the transmission of light, heat, or power. - 2 - 3? Vk/ CHAPTER III - ADMINISTRATION AND ENFORCEMENT Sec. 3-1, Chief Electrical Inspector: There is hereby created the office of Chief Electrical Inspector. The person chosen to fill the office of Chief Electrical Inspector shall be qualified as follows: (a) He shall have a good moral character. (b) He shall be possessed of such executive ability as is required for the performance of his duties. (c) He shall have a thorough knowledge of the standard materials and methods used in the installation of electrical conductors and equipment. (d) He shall be well versed in approved methods of construction for safety to persons and property, and in the provisions of the National Electrical Code as approved by the American Standards Association. (e) He shall have had at least five (5) years experience as a Master or Journeyman Electrician, some of which experience shall have been as an electrical inspector, or in a supervisory capacity in the installation of electrical equip- ment, or equally qualifying experience. (f) He shall hold a certificate which has been issued by the Examining Board of Beaumont, Texas, as a Master or Journeyman Electrician, some of which ex- perience shall have been as an electrical inspector, or in a supervisory capacity in the installation of electrical equipment, or equally qualifying experience. (g) He shall be physically capable of performing the duties of his of- fice. Seco 3-2, Electrical Inspectors: Electrical Inspectors shall qualify under the same provisions as in Section 3-1 herein. Sec. 3-3, Appointment of Inspectors: The Chief Electrical Inspector and electri- cal inspectors shall be appointed by the City Manager. Sec. 3-4, Incumbent Electrical Inspectors: Electrical Inspectors serving in such capacity on date of passage of this Ordinance shall be deemed qualified as pro- vided in Sec. 3-2. Sec. 3-5, Certificates For Electrical Inspectors: Electrical Inspectors shall not be required to keep in force a certificate of registration during their terms of office. Upon termination of their services, for any reason, they shall be issued a certificate of the same class as had been issued to them and was in force at the time of their appointment to office. The certificate shall be issued only for the remainder of the year and there shall be no charge for same. Sec. -6, Prohibited Interests: It shall be unlawful for City Electrical Inspec- tors to engage in the business of the sale, installation, or maintenance of elec- trical conductors, devices, appliances, apparatus, fixtures, or other electrical equipment, either directly or indirectly, and they shall hav e no financial inter- est in any concern engaged in such business at any time while in the employ of The City of Beaumont, Texas, as an electrical inspector. Sec. 3-7, Duties of Chief Electrical Inspector: The Chief Electrical Inspector shall have the following duties: (a) He shall enforce the provisions of this Code. (b) He shall delegate any powers of inspection to his subordinates which he deems advisable. (c) He shall collect, or have collected, all fees as provided herein and transmit same to the proper City officials. (d) He shall, upon application, grant permits for the installation, ex- tension, or alteration of electrical work as provided in this Code. (e) He shall make inspections of all electrical work as provided in this Code. (f) He shall keep complete records of all permits issued, inspections �.nd re -inspections made, and other official work performed in accordance with the provisions of this Code. (g) He shall keep on file a list of inspected electrical appliances is- sued by Underwriters Laboratories, Inc., which list shall be accessible for public reference during regular office hours. . - 3 - &Ad- 15d --W x ,.13 - 1 ) CHAPTER IV - EXAMINING BOARD _Sec. 4-1. Examining Board Created: There is hereby created the "Examining Board For Master ElectriciansP9 consisting of five (5) persons. This Board shall deter- mine the qualifications of anyone desiring to enter the business of a master elec- trician. The members of the Board shall be appointed by the City Manager and shall consist of the following: (a) City Electrical Inspector; (b) One Electrical Enginegr; (c) One Master Electrician; (d) One general Contractor; (e) One Architect. Sec. 4-2. Tenure of Office: As soon as this Ordinance -becomes effective, a Board shall be appointed whose membership shall hold office from the date of their ap- pointment for a term ending June 30, of each year, or until their successors have:: been appointed and qualified; thereafter, a Board shall be appointed on July 1, of each year, the members of which shall serve for a term of one (l) ­year, unless re -appointed for a succeeding term. Any member of the Board may be removed by the governing body of the City for cause. Vacancies within the Board shall be filled by appointment for the unexpired term. The members of the Board shall serve without compensation. Sec. 4-3. Powers and Duties: The Board shall select a chairman and shall pre- scribe a procedure and order of business for hearing applications for examina- tions. The City Electrical Inspector shall act as Secretary to said Board. It shall be the duty of said Board to pass upon the qualifications of all applicants for a license as master electrician to do business in The City of Beaumont; the Board shall fix the date of examination for such applicant, which examination shall be held monthly or oftener as may be decided by the Board. The Board shall make reasonable rules relating to the type of examination required, so as to determine the qualifications of applicants. Three (3) members of the'Board present at any meeting shall constitute a quorum for the transaction of business; and a majority of the members present and voting shall be necessary to constitute an official action of the Board. A record of,all official transactions of the Boatd shall be kept in such a manner as to properly reflect the business transcribed by said Board, and shall be available to the City Manager and the City .Council at all times. The Board shall have the power to suspend or revoke the license of a master electrician who is found guilty of: (1) Practice of any fraud or deceit in obtaining such license; (2) Taking out electrical permits in the name of some person, firm or corporation.authorized by law to do electrical work and thereafter permitting a person without a proper license to do the work; (3) Any gross negligence, incompetence,.or misconduct in the perfor- nance of electrical work within the jurisdiction of the City under this Code. Sec. 4-4, Application for Examination: All applications for examination shall be made in writing and addressed to the Board, and shall be accompanied by an exam- ination fee of ten ($10.00) dollars, which shall be payable to The City of Beau- mont and which includes one examination. Each applicant shall have a minimum of four (4) years experience as a Journeyman Electrician before he will be eligible to take the examination for Master Electricianvs license. The applicant shall chow the number of years of applicantfs experience in the alteration, installation and repair of electrical wiring and equipment. .The Examining Board of Master Electricians shall prescribe a written examination of a uniform, fair, impartial nature, testing the applicantfs knowledge of the electrical ordinances and regu- lations of The City of Beaumont and his ability to read simple electrical plans. All examinations shall be graded promptly by the Board on the basis set out by the minutes of the Board. The Board may prescribe certain other fair, impartial tests of the applicants skill and ability in work involving the alteration, in- stallation and repair of electrical wiring and equipment. -4-� Upon presentation to the Chief Electrical Inspector of a Certificate signed by the Chairman of the Examining Board for Master Electricians, stating the name and address of the applicant and that he has passed the required exam- ination,and after the applicant has paid to the City the fees prescribed in this Code, the Chief Electrical Inspector shall issue to such applicant a Master Elec- tricians License on a form prescribed by said Board, and said applicant shall be considered as "registered'? within the meaning of this Code. Sec. 4-5, Appeal:- Any applicant that is refused a license, or whose license may have been revoked, may appeal to the Board of Appeals for a review of his case. If an applicant is dissatisfied with the decision of the Board of Appeals, he shall have the right of final appeal to the City Council, whose judgment as to all matters involved shall be final. The Board of Appeals shall consist of three (3) members appointed by the City Manager, subject to the approval of the City Council, who, by experience and training, shall be qualified to pass upon the safety of installations and apparatus regulated by this Code. Members of the Board shall be appointed for each case as it arises. No member of the Board of Appeals shall sit in a case in which he is directly or indirectly interested, and in case of disqualification for such cause, or in case.of his necessary absence, the City Manager shall make temporary appointment of a substitute. Every Master Electrician must have and maintain an established place of business and shall have a person in attendance to receive messages from the Elec- trical Inspection Section of the City or other persons concerned during regular business hours. Sec. 4=6, License,Required: It shall be unlawful for any Master Electrician to perform electrical work within The City of Beaumont without first obtaining a license to do the same. CHAPTER V - EXAMINING BOARD FOR QUALIFIED ELECTRICIANS OTHER THAN MASTER ELECTRI- CIANS Sec. 5-1, Examining Board Created: There is hereby created five (5) Boards to be known as 99Examining Boards For Qualified Electricians Other Than Master Electri- cians.'? The Boards shall determine the qualifications of anyone desiring to enter the business of the following: (a) Limited Electrician (Sign); (b) Limited Electrician (Elevator); (c) Maintenance Electrician; (d) Journeyman Electrician; (e) Outside Electrician. Each of these Boards shall consist of three (3) persons appointed by the City Manager, as follows: (a) City Electrical Inspector; (b) City Building Inspector; and, (c) A registered electrician of the same classification as applicant. Sec. 5-2, Tenure of Office: As soon as this Ordinance becomes effective, members to said Boards shall be appointed and shall hold office from the date of their appointment for a term ending June 30 of each year, or until their successors have been appointed and qualified. Thereafter, a Board in each classification, as above set forth, shall be appointed on July 1 of each year, the members of which shall serve for a term of one (1) year, unless re -appointed for a succeed- ing term. It shall be the duty of each Board to pass upon the qualifications of applicants to said Board for Certificates of Registration in the particular - 5 - electriciants classification over which said Board has jurisdidtion, and shall fix the date of examinations. All members must be present at any meeting to con- stitute a quorum for the transaction of business, and a majority of the members present and voting shall be necessary to constitute an official action of such Board. Sec. 5-4, Conducting Examinations: The Board shall prescribe a reasonable exam- ination of a uniform, fair, and impartial nature covering the classification of Certificate of Registration involved, testing the knowledge and skill of each ap- plicant to do electrical work involving the installation, alteration, repair and maintenance of electrical conductors and equipment. (a) Examinations shall be conducted in the manner and sequence pre- scribed by the Board relative to each classification as specified in Chapter V of this Code. (b) The Board shall examine each applicant pertaining to -the competency of applicant. (c) Exami;hations shall be graded promptly by the Board and the results or findings of the,Board shall be.'filed with the City Building Inspector within thirty (30) days of the date of the examination. (d) All applicants examined by the Board shall be graded on the basis set out by the minutes of the Board. .(e) The Board shall be diligent and tolerant in aiding and assisting all applicants by enlightening them concerning the rules prescribed by the Board for examination in each cladsification of electrical registration issued by the Chief Electrical Inspector to each applicant upon his request for examination. Sec. 5-5, Suspension or Revocation of Rights: (a) The Board shall have the power to suspend or revoke the Certificate of Registration, or license, or both, of any electrician who is found guilty of: (1) The practice of any fraud or deceit in obtaining such Certifi- cate of Registration and license to do the work. (2) Taking out electrical permits in the name of some person, firm, or corporation authorized by law to do electrical work and thereafter per- mitting a person without a proper Certificate of Registration and license to do the work. (3) Any gross negligence, incompetency, or misconduct in the per- formance of electrical work within the jurisdiction of the City under this Code. (b) Any applicant that is refused a Certificate of Registration or whose Certificate of Registration has been revoked shall have the right of ap- peal as provided in Chapter IV, Section 4-5 (Appeal) of this Code. CHAPTER VI - QUALIFICATIONS AND REGISTRATION OF ELECTRICIANS: Sec. 6-1, Registration Required: It shall be unlawful for any person to engage in the business of installing, maintaining, altering or repairing of any wiring, fixtures or equipment used for the conducting of electricity for which a permit is required by this Code, nor shall any person in any manner unddrtake to execute such work unless such person is holder of a Certificate of Registration as re- quired by this Code. (a) It shall be unlawful for any person to falsely represent himself as a Registered Electrician of any class set forth in this Code or to use the words 94Electrical Contractor)" "Master Electrician," or "Electrician," or words 'Df similar import or meaning, on signs, cards, stationery, or by any other man- ner whatsoever, unless said person is properly registered within the meaning of this Code. 13-j � Sec. 6-2, Classification of Registration: There shall be six (6) classes of Elec- trical Registration which shall be known as follows: (a) Master Electrician; (b) Limited Electrician (Sign); (c) Limited Electrician (Elevator); (d) Maintenance Electrician; (e) Journeyman Electrician; (f) Outside Electrician. See. 6-3, Method of Registration: To secure a Certificate of Registration as a qualified and competent electrician in any of the last five (5) classes set out in Section 6-2, an application shall be made in writing and addressed to the particu- lar Examining Board for Classified Electricians Other Than Master Electricians having jurisdiction of the electrician classification that he is applicant for. The application shall show the applicant's name and address, and such other infor- mation as may be prescribed by such Board, and shall be made out on forms avail- able in the office of the Chief Electrical Inspector4 Sec. 6-4, Master Electrician: "Master Electrician" `hall mean any person engaged in or carrying on the business of electrical contracting, who is by training, ex perience, and education competent to lay out, design, and install a system of wir- ing for light, heat, and power. See. 6;5, Limited Electrician.(Sign): '?Limited Electrician (Sign)" shall mean any person who is engaged in the business of manufacturing and/or installation of Electric Signs. Sign Contr46t6is who employ Registered Electricians may run cir- cuits to signs if the sign requires two (2) circuits or less. If three (3) or more circuits are required for the sign., these circuits must be installed by a Master Electrician. Sec. 6-6, Limited Electrician(Elevator): "Limited Electrician (Elevator)" shall mean any person who is engaged in the business of installing, maintaining, or re- pairing elevators. Sec. 6-7, Journeyman Electrician: ?'Journeyman Electrician" shall mean any person who is employed to do electrical work for wages and who does not furnish any materials or supplies in the performance of his work. He shall have a minimum of four (4) years experience as an apprentice electrician. Applicant shall make in his application affidavit a statement that he will engage only in the employ of any person registered under the first four (4) classifications under the provis- ions of this Code and shall perform all installation, alteration, and repair of electrical wiring, fixtures, and equipment in accordance with this Code, and that he will not independently engage in the business of contracting such electrical work. Sec. -6-8, Maintenance Electrician: '?Maintenance Electrician" shall mean electri- cians regularly employed on a permanent basis by any person and who perform work only in confine of the building or in or on the premises where they are regularly employed on a permanent basis, and who do "Electrical Work (Maintenance)?' as de- fined in Sec. 24. Sec. 6-9, Outside Electrician: t'Outside Electrician?' shall, .mean any person in- stalling, maintaining, altering, repairing, or erecting any electrical wiring, apparatus, devices, appliances, fixtures, or equipment, or other structures de- signed or constructed to be used exclusively for the support of such electrical wiring, apparatus, devices, appliances, fixtures, or equipment for which a permit is required under the terms of this Code, except that overhead conductors may be attached to buildings. Sec. 6-10, General: In the actual work of installing, maintaining, altering, or repairing of any electrical conductors or equipment for which a permit is required by ordinance, there shall be present and in direct supervision a qualified elec- trician of the proper classification. It shall be required that an electrician c.•f the registered classification of the first three grades, as listed in Section 6-2 above, be liable and responsible for layout and technical supervision of any work which has required the securing of permits, and a journeyman or higher clas- sified grade electrician shall be in direct "on the job" supervision of work car- ried on as specified herein; except in work falling under the classification of - 7 - t � . ) Vv sign or elevator work, which work shall be performed by or directly supervised by the person holding such certificate of registration or a journeyman particularly qualified in such branch of electrical work. Should it come to the notice of the Chief Electrical Inspector or his assistants that such supervision and control are not being maintained, the Inspector may order the work to be discontinued and the person, firm, or corporation to whom the permit has been issued shall discontinue further work until proper supervision has been employed or supplied. Sec. 6-11, Fees For Examination Or Registration: The fees covering examination for a Certificate of Registration to qualified electricians of all classes shall be payable to The City of Beaumont at the office of the Chief Electrical Inspector as set out in Table 1 herein. The examination fee shall accompany the application for registration. (a.) The registration fee shall be paid to the City Electrical -Inspector before the issuance of a Certificate of Registration and only after the person has been approved by the Examining Board dealing with registrants classification. (b) Annual renewal of Certificate of Registration shall be accomplished by issuance of a certified receipt signed by the Chief Electrical Inspector issued upon payment each year extending the validity of correspondingly numbered certifi- cates for that year only. The holder of said certificate shall affix and display each yearly receipt upon the face of his certificate in the designated space. He shall remove and destroy any previously issued receipt. Sec. 6-12, Surety Bond..For Electrical Contractors And Electricians: All master and limited electricians certified under this Code shall be required to furnish and to keep in force each year during the life of his Certificate of Registration, a Surety Bond to The City of Beaumont in the sum specified in Table 1 herein.. The bond shall be conditioned that the holder thereof will indemnify and hold .The City of Beaumont harmless against all cost, expenses, damages, and injuries sustained by said City by reason of the carelessness or neglect of said person in operating under this Code. All such bonds shall be approved by the City Attorney as to form and shall be filed with the City Building Inspector. P.,3c.. 6_13, .Certificate of Registration: A Certificate of Registration form shall be prepared and used by the respective Examining Boards in the registration of the last five (5) classifications of electricians listed in Section 6-2. Master Elec- tricians are "registered" when they are issued a Master Electriciants License in accordance with this Code. (a) A Certificate of Registration shall not be transferable and shall be issued to the person examined by the Board and named on Certificate and Down the holder of the Certificate. (b) A Certificate of Registration shall not be valid unless it bears tnP signature of the holder and Chief Electrical Inspector. S,r.. 6-14, Registration Card: A Registration Card of identification shall be is- sued -to each registrant, as set out in the last five (5) classifications listed in Section 6-2. (a) The Registration Card as issued shall bear the signature of the Chief Electrical Inspector, and provided further that the registrant has paid to the City the required registration or annual renewal fee for his classification, as set forth in Sec. 6-11 (d) Table 1 herein. -g_ (c) Annual renewal of a Registration Card shall be required as herein set forth and in compliance with regulations of Sec. 6-14 herein. The bond shall be conditioned that the holder thereof will indemnify and hold .The City of Beaumont harmless against all cost, expenses, damages, and injuries sustained by said City by reason of the carelessness or neglect of said person in operating under this Code. All such bonds shall be approved by the City Attorney as to form and shall be filed with the City Building Inspector. P.,3c.. 6_13, .Certificate of Registration: A Certificate of Registration form shall be prepared and used by the respective Examining Boards in the registration of the last five (5) classifications of electricians listed in Section 6-2. Master Elec- tricians are "registered" when they are issued a Master Electriciants License in accordance with this Code. (a) A Certificate of Registration shall not be transferable and shall be issued to the person examined by the Board and named on Certificate and Down the holder of the Certificate. (b) A Certificate of Registration shall not be valid unless it bears tnP signature of the holder and Chief Electrical Inspector. S,r.. 6-14, Registration Card: A Registration Card of identification shall be is- sued -to each registrant, as set out in the last five (5) classifications listed in Section 6-2. (a) The Registration Card as issued shall bear the signature of the Chief Electrical Inspector, and provided further that the registrant has paid to the City the required registration or annual renewal fee for his classification, as set forth in Sec. 6-11 (d) Table 1 herein. -g_ (b) Each such Registration Card shall expire at midnight of December.31 of each year and a new card shall be issued each year to the registrant, as speci- fied in Section 6-11 (d) Table 1; and provided further that he has complied with all rules and regulations of this Code pertaining to renewals. Sec. 6-15, Lost or Destroyed: Registration Cards.lost or destroyed during the ,year for which they are issued shall be reissued by the Chief Electrical Inspector in accordance with the rules and regulations of this Code; provided satisfactory evidence has been presented by the registrant of such loss or destruction, and provided the registrant pay to the City at the Chief Inspectorts Office the sum of one ($1.00) Dollar for each such evidence of his registration as he is required to have for his identification. Sec. 6-16, Registration: Upon presentation to the Chief Electrical Inspector of a Certificate signed by the Chairman and the City Building Inspector, stating the name and,address df the applicant, the classification,applied for, and that he has passed the'requirod examination,andtafter the applicant.has paid'to The City of. Beaumont the registration fee ptescpibed in this Chapter, the Chief Electrical In- spector shall register the game of the applicant in the records kept for that pur- pose and shall issue to the applicant a Certificate of Registration. Sec. 6-17, Registration Not Transferable: It shall be unlawful for any person to lend, rent, or transfer his Certificate of Registration or any rights to any other person, and for any person to make use of any such rights which are not actually his own. Sec. 6-18, Altering or Amending Registration: It shall be unlawful for any person other than the Chief Electrical Inspector at the direction of the Board to alter or amend in any manner any instrument of Registration as set forth herein. Sec. 6-19, Display or Evidence of Registration: (a) Every holder of a license as a Plaster Electrician, or of a Certifi- cate of Registration as Limited Electrician (Sign), or Limited Electrician (Eleva- tor) shall display his license or certificate in a conspicuous place in his prin- cipal place of business. (b) Every holder of a Registration Card shall carry his Registration Card on his person at all times while doing electrical work and.shall produce and exhibit it when requested by any Electrical Inspector or proper official of The City of Beaumont. CHAPTER VII - PERMITS AND FEES- ELECTRICAL INSPECTION: Sec. 7-1, Permits Required: It shall be unlawful for any person, firm, or corpor- ation to install or cause to be installed, or to permit any person to install, any electrical wiring, fixtures, or equipment or to make any alteration, additions, changes, or repairs within the scope of this Code, without first having procured a permit therefor issued by the City Electrical Inspector, except as provided here- in. There shall be one permit for each building for which rough work for electri- cal conductors, or electrical equipment is installed. Accessory buildings, tour- ist cottages, or group houses shall not be considered separate buildings when the work is to be installed as one complete project, and at one time; except where separate switches or meter loops are installed thereon. Sec. 7-2, Permit Fees: Before proceeding with the installation, alteration of, or the addition to any electrical wiring or equipment within or on any building structure or premises, publicly or privately owned, within the corporate limits of Beaumont, the Plaster Electrician in charge of such proposed work shall first file with the Chief Electrical Inspector an application requesting inspection, and pay ....'ees to the City in accordance with the following schedule, to secure a permit to tarry on such work. (a) The Term sfoutlet" shall mean and be construed as any point on a wiring system at which a switch is installed or electricity is taken from a cir- cult for light, power, or any other purpose or service. (b) The term "outlet addition« or "outlet Extension" shall mean and be construed as any outlet installation made over and above the number as requested in the permit or as shown on the plans for new construction, or outlet installa- tion extending from or added to old existing circuits, respectively. (c) Permit applications covering the installation of meters on any job shall specify each motor individually and no grouping of motors, per machine, or other such grouping of horsepower shall be permitted. With such application there shall be filed a diagram or plan showing clearly the char- acter and kind.of wiring or installation of fixtures or equipment work to be done. The plan or diagram shall show the manner in which the electrical installation is to be made, or the character of any repairs to any existing electric installation. Said application shall include the following information: (a) Street and house number; (b) Name of the owner; (c) Kind of building; and (d) A list of electrical fixtures and appliances to be installed. The diagram or plans and application shall be referred to the Chief Electrical In- spector who shall have the authority to issue or refuse to issue a permit. Sec. 7-4, Permits For Part Jobs: When one Master Electrician completes the rough work, in whole or in part, on any electrical wiring or installation of fixtures or equipment and a second Master Electrician is called upon to complete the work, in whole or in part, then, in that event, a separate permit is required, for which regular fees shall be paid for the work to be done. Each Master Electrician shall be held responsible only for the work installed by him. Before the second Master Electrician is issued a permit for the completion of an electrical wiring or in- stallation of fixtures or equipment job, the Chief Electrical Inspector shall first notify the Master Electrician holding the original or first permit, if he can be found, that the second permit is to be issued. The issuance of the second permit shall cancel the first permit and no refund of fees shall be made. L. 7-5, Permits.- To Whom Issued: Permits shall be issued to Master Electri- cians qualified to secure permits as set forth in this Code, or to their duly authorized agent. Qualified Master Electricians shall certify their duly author- -zed agent to the Chief Electrical Inspector in the form of an affidavit stating that said Master Electrician assumes all and full responsibility for any permit ta_Len out or applied for by said Agent. This certification shall be kept in the Chief Electrical Inspector7s file after it has been approved by the City Attorney of Beaumont, Texas. 10 - Y Nothing in this Division shall be construed to prevent an owner from -do- ing electrical work himself on his own property, so long as he complies with all of the other provisions of this Ordinance._ This exception shall be construed to mean an individual owner (not a firm, co -partnership, or corporation) who actually does the labor himself. Sec. 7-6, Time Limitation of Permits: 1f electrical wiring or installation of fixtures or equipment work authorized under a permit is not started within sixty (60)'da�s after issuance of such permit, or if the work is started and then dis- dontinu'd,and the work remains disdontinued without justifiable cause for a period of siZ ((0) days; the permit shall become void, and no.work shall be done on the premise until a new permit ie issued and all necessary tees paid. No refunds shall be mage for �e�mit5 that have become void. Sec. 7-7; Revocation of Permits: The Chief Electrical Inspector shall have the right to declare a permit null and void if there has been misrepresentation of facts or any violation of the provisions of this Code. CHAPTER VIII - INSPECTIONS _Sec. 8-1, Inspections Required: It shall be unlawful for any person, firm, or corporation to make connections from a source of electrical energy to any electri- cal wiring, devices, or equipment on an installation for which.a permit is re -t quireol, as set forth is this Code, until a certificate of approval has been issued by the Electrical Inspector authorizing such connection and the use of such wir- ing, devices, or equipment. Sec. 8-2, Rough Inspection: When the rough wiring or installation work is com- pleted on any premises, the person responsible therefor shall notify the Electri- cal Inspector that the job is ready for inspection, giving proper identification of the work, address, and permit number. The Electrical Inspector shall then make an inspection of the electric installation within twenty-four (24) hours from the time of notification (exclusive of Sundays and legal holidays). If said wiring or installation work has been installed in accordance with the terms and provisions of this Code, the City Electrical Inspector shall sign the inspection card, noting thereon the date of approval of the work. More than one rough inspection may be made without charge when the progress of construction requires such inspection. (a) Faulty Work: If the electric wiring or installation of fixtures or equipment is found to be faulty, incorrectly or defectively installed, the Elec- trical Inspector shall notify the responsible person who installed such work of the changes necessary to be made in order that the work may conform to this Code. (b) Rectification of Fault Work: The Master Electrician shall, within forty-eight (48 hours from the time of notification, make or start to make the - changes ordered and shall proceed with the work until the same is completed. Upon completion thereof and payment of the Reinspection Fee, he shall notify the Elec- trical Inspector to the effect that faulty work has been corrected. The latter shall then cause the reinspection to be made, and if said work is found to comply with this Code he shall sign the Inspection Card, noting thereon the date of.ap- proval of the work. If the Electrical Inspector shall again find the work incor- rectly installed, he shall notify the responsible Master Electrician of the neces- sary changes, and shall collect an additional Reinspection Fee. If the responsi- ble Master Electrician does not make the required changes within a reasonable time, the Electrical -Inspector shall refuse to issue to any such person any fur- ther permits until said work in question is corrected and approved. Sec. 8-3, Final Inspection: Upon the completion of all electrical wiring or in-- etallation of fixtures or equipment in any building or on any premises, the elec- tri_cian in charge shall notify the Chief Electrical Inspector that the work is ready for final inspection, giving the Electrical Permit Number and street ad- dress, and the Chief Electrical Inspector shall then cause inspection to be made within twenty-four (24) hours from the time of receipt of notification (exclusive of Sundays and legal holidays), and if any faulty or defective wiring or equipment is found, the electrician in charge shall be notified of the changes to be made in order that such work shall conform to this Code. If such work is found to be cor- rectly installed, replaced, or repaired, the Electrical Inspector shall endorse his approval upon the Inspection Certificate stating that the wiring or installa- tion work has been installed in accordance with the provisions of this Code. For each and every final inspection requested by Master Electricians in charge of a job, after the first has been made, the final inspection fee shall be paid as here- inbefore provided.' Sec. 874, Work Left Open: It shall be unlawful for any person to cover or cause to be covered any part of a wiring installation with flooring, lath, wall -board, or other material, until the Electrical Inspector shall have approved the wiring installation, in part or as a whole, except as herein set forth. Sec. 8-5. Inspectors Removal Request: It shall be the duty of the Electrical In- spector to cause all abandoned dead wire, unused poles, or electrical apparatus on the outside of the buildings or in streets or alleys to be removed at the expense of the owners thereof, by giving the said owners written notice. Sec. 8-6, Interference: It shall be unlawful for any unauthorized person to, in any manner, change or alter electrical conductors or equipment in or on any build- ing. If, in the course of the erection of a building or structure, electrical conductors or equipment have previously been installed in such position as�to in- terfere with the erection or completion of the structure, notice shall be imme- diately given the authorized person or firm using the electrical conductors or equipment, and he shall be required to accomplish this needed change in accordance with this Code. Sec, 8 T7, Periodic General Inspection: The Chief Electrical Inspector shall in- augurate thorough periodic reinspection of installation of all electric wiring, electric devices, and electric equipment now installed, or that may hereafter be installed within The City of Beaumont, and within the scope of this Code, and when the installation of any such wiring, devices, or equipment is found to be defec- tive, dangerous, or in an unsafe condition, the person, firm, or corporation own- ing, using, or operating the same shall make the necessary repairs or changes re- quired to place such wiring, devices, or equipment in a safe condition within five (5) days or any longer period specified by the Chief Electrical Inspector in said notice. The Chief Electrical Inspector shall immediately order the disconnection or discontinuance of electrical service to such wiring, devices, or equipment un- til same has been made safe, as directed. Sec. 8-8, Proper Supervision: In the actual work of installing, maintaining, al- tering, or repairing any electrical wiring device or equipment for which a permit is required by this Code, there shall be present and in direct supervision a qual- 1.fiod electrician of the proper classification of registration as specified in Section 6-2 herein, aec..8-9, Electrical Service Connections: It shall be unlawful for any person, i.rm., or corporation to make connections from a source of electrical energy to any electrical wiring, device, or equipment which has been disconnected by order of the Electrical Inspector, or the use of which has been prohibited for reasons herein set forth, until a Certificate of Approval has been issued by him authoriz- �ng the reconnection and use of such wiring, devices, or equipment. Whenever the service wires are once disconnected in any commercial building in the city limits or any building in the inner fire limits, the service shall not again be connected until the same has been wired so as to conform to r,his Code. CHAPTER IX - STANDARDS Sec. 9-1, Standards For Electrical Installations: All installations of electrical wiring and equipment shall be reasonably safe to persons and property and in con- formity with the provisions of this Ordinance, the applicable Statutes of the State of Texas, and any rules or regulations issued by authority thereof. (a) Conformity of electrical installations with the applicable stand- ards set forth in the National Electrical Code, National Electric Safety Code, or electrical provisions of other safety codes which have been approved by the Amer- ican Standards Association shall be prima facie evidence that such installations are reasonably safe to persons and property. (b) Due to the unusual climatic conditions prevailing in and about Beaumont, certain exceptions to the wiring methods and materials, as set forth in - 12 - --13 - ll;iSl National Standards herein adopted, shall be made as set forth in Chapter X of this Code. Sec._9-2, Standards For Electrical Equipment: All electrical equipment installed or used shall be reasonably safe to persons and property in conformity with the provisions of this Code, the applicable Statutes of the State of Texas, and any rules or regulations issued by authority thereof. (a) Conformity of electrical equipment with the applicable standards of the Underwriters Laboratories, Inc. shall be prima facie evidence that such equip- ment is reasonably safe to persons and property. (b) Only standard parts and materials approved by the Underwriters Lab- oratories, Inc. or by the Chief Electrical Inspector, as set forthi in Chapter XI herein, shall be permitted in electrical repair or maintenance wo#k. i Sec. 9-3, Standards For Electric Signs3 All electrically illuminated or electri- cally powered outdoor and indoor signs and displays shall be reasonably safe to persons and property and in conformity with the provisions of this Code. (a) Conformity of all types of electrical signs with applicable stand- ards of the Underwriters Laboratories,. Inc-.- and the National Electrical Code, National Electrical Safety Code, or electrical provisions of other safety codes ilhich have beenjapproved by�the American Standards Association, shall be prima face evidence that such installations are reasonably safe to persons and property. ' i ($) Conformity, of construction, erection, foundation and/or means of support of all such sighs with the City;,Building Code shall be approved by the City Building Inspector before permits for electrical inspection 'shall be issued under the authority of this Code. (c) All conductors for gaseous tubing signs, indoor and outdoor, shall be of a type approved for the purpose and for the voltage of the circuit, and shall not be smaller than No. 14, AWG. (d) Bare conductors may be used only on socket -type housings inside signs, and exposed if not over 1844 in length. Pyrex or equal insulators and hous- ings will be the only type approved for outdoor construction. Housings must have at least 7/844 opening when used outdoors. Open-end type housings win not be ap- proved for outdoor use. (e) All open high voltage sign conductors shall have a minimum two (244) _nch separation maintained between conductors and between conductors and other ob- Jects. Where subject to mechanical injury, or where within reach from ground, roof, window, or other substantial support accessible to unqualified persons, all high voltage conductors shall be enclosed in suitable raceways or suitably guarded. (f) All high voltage gaseous tube sign circuits shall be protected on the low voltage or primary circuit of each sign transformer by the installation of a separate non-tamperable fuse of 125 percent for each calculation of the load, or by test with suitable instruments in the primary circuit thereof. The input load in watts, for determining fuse capacities necessary under this rule, shall be f iYed by the following formula when transformers are rated in milli -amperes and output voltage: Milli -Amperes X Output Voltage = Watts 1000 (g) All signs shall be on a separate circuit and not greater than 1320 watts will be allowed on each circuit. (h) All sign switches shall be located within sight of the sign and shall provide for the opening of all ungrounded conductors supplying the sign, or supplying the low voltage primary circuit of the gaseous tube sign transformer. Each such switch shall be externally operable and so designed that it can be locked in the open and closed position. Switches or similar devices controlling sign transformers shall be of an approved type and shall have a current rating of not less than twice the current rating of the transformers. - 13 - (i) A'permit must be obtained from the Inspection Department before any sign is installed. (j) All signs must have a minimum clearance of eight (8) feet above sidewalks located on public property. (k) Supports below signs may not be installed on public property. (1) An approved type of fitting mist be used on all runs of conduit, such as weather -head or similar fitting. (m) Neon signs must be all metal or other approved material. (n) No guy wire used on outdoor signs shall be less than;3/16 stranded cable or chain of equal strength. No turnbuckles less than 3/16 for outdoor use. No guy cables shall be fastened to walls with less than 3/8 lag screw and shields. Electrodes on outdoor tube lighting must clear any object by at least lilt. All steel poles, booms, and supporting framework must pass inspection. Neon and metal letters mounted on masonry building shall be mounted with expansion shields, caulk- ing anchors, or lead wool set in holes at least ltt in depth. (o) All outdoor signs shall have transformers installed in an approved, metal container. Sen. 9-4, Utility Company Rules: Rules and regulations of the Gulf States Utili- ties Company regarding service and meter installations for the kind and character of service to be rendered, as passed and approved by the governing body of the City of Beaumont from time to time, in accordance with franchise provisions, are hereby referred to, incorporated herein, and made a part hereof. CHAPTER X - SPECIAL ELECTRICAL RULES Sec. 10-1, General: Due to the extreme climatic conditions prevailing in and about Beaumont, certain special rules covering electrical wiring and equipment in- stallations are set forth herein, and certain exceptions are taken to the rules and regulations of the National Electrical Code to raise the safety level of elec- trical installations and prevent the rapid deterioration of electrical materials and equipment from severe atmospheric and underground corrosive action. Sec. 10-2, Approved Wiring, Methods: Method A - Standard rigid steel conduit; Method B - Metal underfloor raceways' Method C - Underplaster extensions; Method D - Flexible steel conduit; Method E - Approved cable; Method F - Armored cable lead sheathed; Method G - Surface metal raceways; Method H - Bare--bus-bars and risers; Method I -- Wireways and busways; Method J - Auxiliary -gutters; Method K - Knob and tube; Method L - Electric-Metalic-Tubing. (a) On the exterior of buildings or structures, Method A or E of See - tion 10-2 shall.be used. Where Method A is used, conduits and fittings must be galvanized, threaded and water tight. (b) Underground: If in moist location Method A of Section 10-2 must be ased. (c) In hazardous locations because of more than ordinary risk of fire or explosion: Method A of Section 10-2, as required in the National Electric Code. (d) Any wiring subject to continuous moisture: Method A of Section 10- 2. Conduits and fittings must be galvanized, threaded and water tight. (e) In hoistways: Between riser and limit switch, interlocks, push - 14 - x.-13-151 buttons and similar devices:. Method A of Section 10-2, except for light and con- trol cables to car. (f) Under plaster extension: Methods A. b; of Section 10-2. (g) Temporary work, experimental or emergency work, work for fairs, ex- hibitions, and similar purposes: Methods A, $, D, E, G, and K of Section 10--2. (h). Conduit connections to,rotating or movable electrical apparatus: Method D of Section 10-2, if length is six (6) feet or lees. (i) Wiring in buildings located in the fire limits: Method A or L,, -of - Section 10-2. (j) Wiring for decorative lighting in display windows: Method A or L of Section 10-2. (k). Fuses: All switches or fuse cabinets mounted on the'exterior of a building must be of an approved rain -tight type. (s) Low Voltage Wiring: All low voltage magnetic switches that are de- signed to control lights and other non -inductive loads shall be installed as fol- lows:, The relay or magnetic switches shall be installed in "Such a manner that they may be readily removed and re -installed after outlet box containing same is concealed without,_removing plaster or finish of building; they are to be installed in outlet boxes of sufficient size.to compensate for space occupied*by the relay, and shall be securely and adequately fastened with machine screws or other ap- proved method in the outlet box in which they are installed. All remote control low voltage devices that are used to control lighting and power, shall be in-. stalled in an approved metal .box in a location readily accessible in maintenance, service, and repairs. All relay or magnetic switches will be appro-red only on circuits not exceeding 150 volts to ground, and all lower voltage wires must be separated by an approved barrier from circuit wires. All low voltage wiring shall not be smaller t an #18 gauge rubber -covered, not less t&an 300 volt, insulation. All low voltage wiring shall be installed in a workmanlike manner and shall not be rntn over ceiling joists, under floor joist, or across face of studs. All wires must pass through bored holes and be secured to sides of joists, studs or rafters with insulated staples at least every 4A feet. Low voltage wires shall be long enough to permit the removal and reconnection of the relay or magnetic switch. Lpw voltage switches used to operate the relay or magnetic switch shall be of an Ztype and installed in an approved manner. The transformer for the con- trol system shall not exceed 48 volts and shall have overcurrent protection on the secondary side not exceeding its capacity, located within twelve (12) inches of transformer. The primary.side of the transformer dill be considered protection by o*er-current protection not exceeding fifteen (15) amperes. And it is further provided that no permits will be required for the installation of wires to operate telephones, telegraph, district messengers, and watch -clock fire alarms. (t) Where five' (5) or more switches or meters are ganged, a continuous wiring gutter must be used. Sec. 10-1, Residential Wiring: (a) A miizimum of one receptacle will, be required in each room in all residences with 750 square feet of floor space, or lees. (b) In residences with more than 750 square feet of floor spaced one receptacle will be. required every 20 linear feet around the room as msaeured hori- zontally along the wall at the floor line. (c) One and two family dwelling units may be wired with Unob and tube, non-metallic sheathed cable, rigid steel conduit, or E.M.T. The same method of wiring must be used throughout. (d) Service-entranoe cable may be used on all residences where three (3) number 6 copper conductors or larger are used. (e) 20,Ampere multibreakers or Fusestats may be used on all circuits where number 12 wire is used. (f) Residential storage garages or garage apartments with storage space for six (6) cars or less may be wired with any approved type of wiring. Sec. 10-4l Branch Circuit Protection: To determine the number of outlets per cir- :uit, Article 210 of the National Electric Coded 1949 Edition] shall be complied with. The load on any branch circuit shall not exceed 80% of the circuit capa- city. All outlets except those as defined in Paragraph B. Section 2115, Article 21.0 of the National Electric Code shall be considered as li amperes minimum per outlet. Residential load shall be computed on the basis of three (3) watts per square foot or one (1) circuit for every 500 square feet of floor space, whichever is greater. Sec. 10-5.'Flexible Metallic Conduit: This may be used only where it is impracti- cal to use rigid steel conduit. Sec. 10--6. Extension Cords: Extension cords shall be no longer than eight (8) feet except those used for portable tools and trouble lights. - 16 - CHAPTER XI - SALE OF ELECTRICAL EQUIPMENT Sec. 11-1, Sales Prohibited: It shall be unlawful for any person, firm, associa- tion, or corporation within the incorporated limits of Beaumont to sell,,- expose for sale, offer to sell, dispose of as a premium, offer for rent, or to repair any appliance which has not been endorsed by the Underwriters Laboratories, Inc., or other nationally recognized standards association; or without first obtaining ap- proval from the Chief Electrical Inspector in absence of such evidence of safety approval. Sec. 11-2, Approval Given: The Chief Electrical Inspector shall approve for sale at retails such electrical equipment, material, conductors, apparatus; or applian- ces as are reasonably safe to persons and property. Conformity of such .equipment and material with the standards of the Underwriters Laboratories, Inc. shall be prima facie evidence that such equipment is reasonably safe to persons and proper- ty. Seco 11-3, Special Approval: Should any material or equipment be submitted for approval which is not listed as approved by the Underwriters Laboratories, Inc., the Chief Electrical Inspector shall, within ten (10) days of the receipt of writ- ten request for special approval, approve, provisionally approve, or disapprove such electrical material or equipment. (a) Approval shall be based on reasonable safety to persons or property, and material and equipment shall be considered as adequate for approval if the standards of the Underwriters Laboratories, Inc. and/or provisions of this Code are met. When material or equipment is approved by the Chief Electrical Inspector, such approval shall continue until the material or workmanship on the article ap- proved is changed. When the material or workmanship is changed, the article shall be re-examined for approval. (b) When no applicable standard can be used to determine whether an article is reasonably safe, the Chief Electrical Inspector may grant provisional approval and allow its sale until such time as it can be tested or determined whether the article is safe to persons or property. (c) When an article is disapproved by the Chef Electrical Inspector the decision may be appealed for review by the Examining Board for Master Electri- cians. (d) The Chief Electrical Inspector shall keep in his office a complete list of electrical equipment, material, appliances, and devices approved by Under- writers Laboratories, Inc., provisionally approved, or disapproved for sale within The City of Beaumont. This list shall be available to the public during regular working hours. CHAPTER XII - PENALTIES Sec. 12-1, Penalty for Violation of Electrical Code: Any person, firm, corpora- tion or association who violates any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than five (x$.00) dollars nor more than two hundred ($200.00) dollars, and each and every day of continued violation thereof shall constitute a distinct and separate offense. Violation of any of the terms or provisions of this Code by any corpora- tion or association shall subject the officers and agents actively in charge of the business of such corporation or association to the penalty herein provided. Sec. 12-2, Conviction: Conviction under the provisions of this Code shall be deemed just cause for the revocation of any certificate or license which said per- son, firm, corporation, or association may have and/or hold under the provisions of this Code, and pXamination for re -issue of such certificate or license shall be at the discretion off' the Examining Board for Master Electricians, but in no event shall be delayed longer than a period of one (1) year. — 17 — CHAPTER XIII - LEGISLATION Sec, 13-1, Validity Clause: If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this Code shall be held invalid, it shall not af- fect any valid provisions of this or any other Code of The City of Beaumont to which these rules and regulations relate. Sec. 13-2, Repeal of Conflicting Ordinances: All ordinances.or codes or parts of ordinances or codes of The City of Beaumont in conflict herewith are hereby re- pealed.
