AN ORDINANCE
ENTITLED AN ORDINANCE AUTHORIZING THE PROPER
OFFICIALS OF THE CITY OF.BEAUMONT TO EXECUTE
AND DELIVER _AN. INSTRUMENT QUITCLAIMING THE.
CITYtS.RIGHT, TITLE AND INTEREST.TO RALPH C.
SAVING AND -CARL -L. SAVING IN AND TO A TEN (10)
FOOT UTILITY EASEKENT IN LOTS FOUR (4) . AND TEN
(10) IN.BLOCK FOURTEEN.(14).OF REPLAT_OF A POR-
TION OF MCFADDIN HEIGHTS ADDITION IN.EXCHANGE
FOR A FIVE (5) FOOT EASEMENT.FOR SEWER PURPOSES
ONLY OFF OF EAST ENDS OF LOTS ..FOUR (4) FIVE
(5 ) AND SIX ( 6) . AND . WEST ENDS OF LOTS _ f EN (10) ,
.ELEVEN (11) AND TWELVE (12), BLOCK FOURTEEN
(14) OF_MCFADDIN.HEIGHTS ADDITION.TO THE CITY
OF BEAUMONT._..
WHEREAS, in the replat of a portion of McFaddin Heights
Addition to The City of Beaumont a ten (10) foot utility easement
was reserved off of the north side of Lot Four (4) and a portion
of the north side of Lot Ten (101, Block Fourteen (14), of said Ad-
dition; and,
WHEREAS, the City Engineer has recommended that the City
relinquish all of its interest in and to said easement in consid-
eration of a conveyance from Ralph C. Savin and Carl L. Savino,
owners of said property, conveying to The City of Beaumont an ease-
ment for sewer purposes only, five (5) feet in width, two and five
tenths (2-5) feet off of the east ends of Lots Four (4) , Five (51,
and Six (_6), and two and five tenths (2.5) feet off of the west ends
of Lots Ten (10), Eleven (11), and Twelve (12), Block Fourteen (14)
of McFaddin Heights Addition to The City of Beaumont, and the City
Council is of the opinion that it would be to the best interest of
the City that such an exchange be made;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAU-
MONT, TEXAS
That Otho Plummer, Mayor of The City of Beaumont, be, and he is
hereby authorized to execute and deliver for and on behalf of The
City of Beaumont an instrument quitclaiming all of the Cityts right,
v
title and interest in and to the above-mentioned ten (10) foot
utility easement to Ralph C. Savino and Carl L. Savino, said ease-
ment being described as follows:
Being the abandonment of a ten (10) foot utility
easement off of the north side of Lot 4, and a por-
tion of the north side of Lot 10, Block 14, of the
Replat of a portion of McFaddin Heights Addition to
The City of Beaumont, Jefferson County, Texas, and
being more particularly described as follows:
Beginning at the northwest corner of Lot 4, Block
14 of the Replat of a portion of McFaddin Hei:.ghts
Addition, said point lying in the east line of Gulf
Street at a distance of one hundred fifty (150)
feet north of the north line of Isla Avenue;
Thence east along the north line of said Lot 4 and
said north line produced one hundred eighty (180)
feet to corner in the north line of Lot 10, said_
point being five (5) feet east of the northeast
corner of Lot 4 or the northwest corner of Lot 10;
Thence south along a line parallel with and one
hundred eighty (180), feet distant from the west
line of Lot 4 or the east line of Gulf Street ten
(10) feet to corner;
Thence west along a line parallel with and one
hundred forty (140). feet distant from the north
line of Isla Avenue one hundred eighty (180) feet
to the west line of Lot 4 or the east line of
Gulf Street;
Thence north along the west line of said Lot 4 or
the east line of Gulf Street ten (10) feet to the
place of beginning;
and the City Clerk be, and he is hereby, authorized to attest to
said instrument and to affix the seal of The City of Beaumont there-
to.
