HomeMy WebLinkAboutORD 8-WVol — 1'0 i AN ORDINANCE AN ORDINANCE ACCEPTING OFFER OF THE UNITED GAS CORPORATION TO PURCHASE CERTAIN PROPERTY AND AUTHORIZING PROPER CITY OFFICERS TO EXECUTE AND DELIVER QUITCLAIM DEED TO PURCHASER OF SAME., PREAMBLE WHEREAS, on the 9th day of March, A.D. 1946, the City of Beaumont, for itself and in behalf of the Beaumont Independent School District, recovered a tag judgment against Charles S. Morgan and wife, Jewell Morgan, if living; if dead, their unknown heirs and legal representatives, together with the foreclosure of a tax lien upon the following described property, to -wit; - "Being a part of that certain two acre of land in the David Brown Survey, City of Beaumont, Jefferson County, Texas, conveyed by Karl Paine to George M. Oliver by deed dated Sept. 9, 18842 and recorded in'Volume X. page 70 of the deed records of Jefferson County, Texas; the tract herein being the middle one-third of the east one-half of the above mentioned two acre tract of land, and more particularly described as follows, to -wit; ?Beginning at a point on the east line of the original two acre tract of land conveyed by said Karl Paine to George M. Oliver and referred to hereinabove, 1001 south of the original northeast corner of said two acre tract, which point is also the southeast corner of a tract of land conveyed by said G. M. Oliver and wife, to James Stewart and wife, Maud Stewart by deed records in Vol. 34, page 426, deed records; thence south 1001 to the corner, said corner being the northeast corner of tract con- veyed by said George M. Oliver to Moise Broussard by deed recorded in Vol 8, page 401, deed records; thence west 150 feet to the east line of a tract of land conveyed by said George M. Oliver to heirs of P. Bordages by deed recorded in Vol. 10, page 621, Deed Records, which point is also the northwest corner of the Moise Broussard tract mentioned above; thence north 78.8 to the southeast line of Blanchette Street; thence north 48 degrees, 23 minutes east with said southeast line of Blanchette Street to a point in the south line of the tract conveyed by said G. M. Oliver and wife to said James Stewart and wife and referred to herein above, said point being 234 feet, more or less, east of the southwest corner of said .,Tames Stewart tract; thence east with the south bound- ary line of said tract conveyed to said Stewart, 126.6 feet to the place of beginning, and further known as Tract 15, Plat B. of the 5DBrown Survey to the City of Beaumont, Jefferson County, Texas; and, WHEREAS, on the 2nd day of July, A.D. 19463, the City of Beaumont purchased said above described property at public auction in satisfaction of said judgment and tax lien; and, a WHEREAS, on the 9th day of July A.D. 19469 W. W. Richard- son, Sheriff of Jefferson County, Texas, made, executed, and deliv- ered unto the City of Beaumont a tax deed to the above described property in satisfaction of said judgment and tax lien, which deed was recorded in Volume 397, Page 633, of the Deed Records of Jeffer- son County, Texas, on the 26th day of September, A.D. 1946; and, WHEREAS, on the 29th day of August, A.D. 1950, the United Gas Corporation, a Corporation duly and legally incorporated under the laws of the State of Delaware with a permit to do business in the State of Texas, with its principal Texas office_ in the City of Houston, Harris County, Texas, offered to purchase all of the right, title, interest, claim, estate and demand of the City of Beaumont and the Beaumont Independent School District in the above described property for the sum of Nine Hundred, Ninety-three and 38/100 0993.38) Dollars; and, WHEREAS, the City Council of the City of Beaumont, Texas, is of the opinion that such sale is for the best interest of the City of Beaumont and should be consummated; NOW, therefore, be it ordained by the City Council of the City of Beaumont, Texas, that the aforesaid offer to purchase the above . described property is hereby accepted and the Mayor and City Clerk are hereby authorized to -execute -and deliver on behalf of the City of Beaumont and the Beaumont Independent School District a QUITCLAIM DEED conveying unto the United Gas Corporation, its successors and assigns forever, all of - the- right, title; interest,- claim, ,estate and demand of .the City of Beaumont and the Beaumont Independent School District in the above described property derived by reason of said Sheriff's deed.
