HomeMy WebLinkAboutORD 26-V6p g y q_9 AN ORDINANCE AN ORDINANCE AUTHORIZING THE VACATING AND CLOSING OF A PORTION OF.FOURTH STREET.AND.RETAINING AN EASEMENT.FOR MAINTAINING.EXISTING UTILITIES THERE- ON, AND.AUTHORIZING THE MAYOR.OF THE CITY OF BEAU- MONT TO EXECUTE A DEED ON BEHALF OF THE CITY OF BEAUMONT TO STATE LUMBER COMPANY. WHEREAS, The City of Beaumont is in the process of -widening Fourth Street, and it has been determined that the hereinafter de-' scribed portion of Fourth Street will not be needed for right-of-way purposes, and the City Council is of the opinion that it would be to the best interest of The City of Beaumont that such portion of Fourth Street be closed and abandoned, said property being described as follows: Beginning at a point on the original and existing west line of Fourth Street marking the most southerly corner of a triangular tract of land quitclaimed by the City of Beaumont to William Seals & Company (now State Lumber Company) and referred to in the descrip- tion of the west line of Fourth Street in resolution passed by the City Commission on January 9,.1934, said oint being one hundred thirty-six and six tenths (: (p136.6) feet south of the dividing lines between the Noah Tevis and David Brown Surveys and also -being two hundred twenty-one (221) feet, more or less, north of the north line of Fannin Street as now established east of Fourth Street produced westward; Thence north 27 degrees 24 minutes east along the new location of the west line of Fourth Street as referred to in the above -dated resolution, one hundred thirty- one (131) feet to an iron pipe; Thence south 20._degrees 35 minutes west one hundred twenty-four and two tenths (124.2) feet to corner; Thence south 89 degrees 39 minutes west sixteen and fifty-three hundredths (16.53) feet to the place of beginning; The above described tract contains 960 square feet, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: That the above described property, a portion of Fourth Street, be and the same is hereby authorized to be vacated and closed, andthe Mayor is hereby authorized to execute a quitclaim deed for and on behalf of The City of Beaumont to State Lumber Company conveying to V such Company MXRX&Xjaz9Asx=tmkx9=RA= all of the Cityts right, title and interest in said property for and in consideration of the conveyance by State Lumber Company to The City of Beaumont the following described property needed for right -of -wap purposes on Fourth Street: Beginning at a point on the original and existing west line of Fourth Street marking the most south- erly corner of a triangular tract of land quit- claimed by The City of Beaumont to William Seale & Company (now State Lumber Company) and referred to in the description.of the west line of Fourth Street in resolution passed by the City Commission on January 9, 1934, said point being onehundred thirty-six and six tenths (136.6) feet south of the dividing line between the Noah Tevis and Davis Brown Surveys; Thence north 27.degrees 24 minutes east along the new location of the west line of Fourth Street as referred to in the above -dated resolution one hun- dred thirty-one (131) feet to an iron pipe marking the beginning corner of this description; Thence continuing north 27'degrees 24 minutes east along the aforesaid west line of Fourth Street one hundred sixty-four and ninety-three hundredths (164.93) feet to corner in the dividing line between the said William Seale & Company (now State Lumber Company) and the Mabry Foundry & Machine Company properties, said point lying twenty-one and five tenths (21.5) feet west of the original east lines of these properties; Thence south $9 degrees 39 minutes west along the said dividing line of said William Seale & Company (now State Lumber Company) and the Mabry Foundry & Machine Company properties twelve and twenty-one one hundredths (12.21) feet to an iron pin; Thence south 23 degrees 31 minutes west one hundred fifty-nine and sixty-two hundredths (159.62) feet to'the place of beginning; The above described tract contains 891 square feet, more or less. There is, however, expressly retained by The City of Beau mont an easement upon and across said property for the purpose of perpetually maintaining the existing utilities on said property and the right of ingress andegress for such purposes.
