. ENTITLED AN ORDINANCE` AUTHORIZING THE VACATING AND
ABANDONMENT OF.'THAT PART OF NINTH STREET ABUTTING
THE SOUTHWESTERLY PART OF BLOCK ONE (1)'.OF THE
PRATER ADDITION TO THE CITY OF.B_EAUMONT. TEXAS, AND
LYING BETWEEN -SAID BLOCK ONE (1) AND THE ABANDONED
S&ET RAILROAD RIGHT OF,"WAY, RESERVING, HOWEVER, THE
RIGHT OF THE CITY OF BEAUMONT.TO MAINTAIN IN SAID
STREET ALL WATER LINES,•DRAINAGE DITCHES, AND OTHER
UTILITIES NOW IN SAID.STREET, AND PROHIBITING THE
OBSTRUCTION OF ANY PRESENT WATER OR SEWER LINE 'OR,
ANY DRAINAGE DITCH BY ANY BUILDING OR STRUCTURE.
BE -IT ORDAINED BY THE : C.ITY OF.- BEAUMONT, . TEXAS
That that part,of Ninth Street abutting upon the southwesterly
part..of Block- Oni e (1) ' `of the Prater Addition to � The City' of Beau-'
mont' Texas,,..and lying between Block One (1) and the abandoned
S&ET.Railroad„right of -way -be.. -and the -same is, hereby,,authorized
to be vacated: and abandoned, a'ndthat title to such portion of
Ninth.Street herein''closed shall revert to and become the property
of the :persons''entitle'd, thereto, .as provided by-law; provided, how-
ever, _ that the_. vacating and abandonment of said. -street ---shall in no -
way.affect.the right of the City to maintain therein such sewer,
gas and waterlines, and other utilities and drainage ditches now
in said stree't,.'and the vacating and.abandonment of such street
shall not be construed as'autho.rizing or permitting.any.person,.
party' corporation, or =legal .entity whatsoever 'to erect, construct,
build, move onto, or.place any building or structure thereon, so '
as to,obstruct the maintenance' of said. water, gas and. sewer lines,.
and drainage ditches -or other utilities -now in said street.
'The portion of Ninth Street herein closed -is that part of -
Ninth Street lying south of that portion of Ninth Street closed
by an, ordinance -pass-ed,--by -the .City -.-Council the '12th -day. of April,
1955, and filed for record in the Deed Records of Jefferson County,
.Texas, in Volume 973., -page 263, et seq.
