AN ORDINANCE REPEALING AN ORDINANCE PASSED BY THE
CITY COUNCIL ON THE 8TH DAY OF FEBRUARY, 1955,
AUTHORIZING THE VACATING AND ABANDONING OF AN ALLEY
DESCRIBED IN DEED RECORDED IN VOLUME 114, PAGE 597,
DEED RECORDS OF JEFFERSON COUNTY, TEXAS, AND AUTHOR-
IZING THE VACATING AND ABANDONING OF SAID ALLEY
WHICH LIES BETWEEN ANCHOR STREET AND IRBY STREET,
AND RUNNING FRO14 BRANDON AVENUE TO HIGHLAND AVENUE.
WHEREAS', under date of. February 8, 1955, the City Coun-
cil, by ordinance, authorized the vacating and abandoning of
the alley described in deed recorded in Volume 114, page 597,
Deed Records of Jefferson County, Texas, said alley lying be-
tween Anchor Street and Irby Street, and running from Brandon
Avenue to Highland avenue, and in said ordinance the City re-
served the right to construct and maintain in said alley sewer
lines, water lines, and other utilities, and reserved the right
bf the City to grant a franchise right to others to construct
and maintain the utilities hereinbefore mentioned through and
along said alley, and prohibited the obstruction of same by
any building or buildings; and,
WHEREAS, the City Engineer now finds that the alley does
not appear on any of the maps of the City and was only dedi-
cated by the owner but never used by the public or opened -for
the use of the public, and that subsequently a 15 -foot alley
abutting upon the aforementioned alley was dedicated and opened
and utilities constructed in same, so that there is no need for
utilities in the 7.5 -foot alley closed in the aforementioned
ordinance; and,
VHEREAS, the City Engineer has certified that he sees no
necessity for the City to retain the right to grant franchises
for future utilities in said alley, and said petitioners have
requested that the alley be closed without reservation of util-
ity rights;
NOW, THEREFORE, BE IT ORDAINED.BY THE CITY OF
BEAUMOTIT :
That the alley lying north of Anchor Street and south of Irby
Street, running between. Brandon Avenue and Highland Avenue in
the City of Beaumont, as described in deed recorded in Volume
114, page 597, Deed Records of Jefferson County, Texas, be,
and the same is hereby, authorized to be vacated and abandoned,
and that the title to such alley should revert to and become
the property.of the owners of land abutting said alley, as pro-
vided by law.
