HomeMy WebLinkAboutORD 24-ZAN ORDINANCE ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT, JEFFERSON COUNTY$ TEXAS, ON SATURDAY, THE 19th DAY OF FEBRUARY, 1955, TO DETERMINE WHETHER OR NOT THE CITY COUNCIL OF THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO ISSUE SERIAL BONDS OF SAID CITY IN THE AMOUNT OF $165, 000 FOR THE PURPOSE OF PROVIDING FUNDS FOR THE PURCHASE OF STUART STADIUM, THE LAND, IMPROVEMENTS,, AND APPURTEN- ANCES THERETO,, TO BE USED AS A MUNICIPAL, ATHLETIC STADIUM AND FOR ALL LAWFUL PUBLIC PARK PURPOSES FOR SAID CITY,..AND TO LEVY A TAX IN PAYMENT THERE- OF� MAKING CERTAIN FINDINGS AS TO THE ADVISABILITY AND NECESSITY OF ISSUING SAID BONDS AND PURCHASING SAID PROPERTIES; NAMING THE DATE AND PLACES OF HOLDING SAID ELECTION AND APPOINTING OFFICERS ° THEREOF; PROVIDING THE MANNER OF HOLDING SAID ELECTION AND GIVING NOTICE THEREOF WHEREAS, the City Council of the City of Beaumont, Texas, has been requested by more than 2500 citizens of the City of Beaumont to call an election to determine whether or not the City of Beaumont should purchase Stuart Stadium, a baseball park consisting of approximately nine (9) acres of land, stadium, improvements and appurtenances thereto, to be used as a municipal athletic park and for all lawful public park purposes; and, WHEREAS, the City Council of the City of Beaumont deems it advisable to call such election, and the City Council finds that the probable period of usefulness of the improvements and appurtenances for which the bond funds are to be expended will be in excess of eighteen (18) years; now, therefore: BE IT ORDAINED BY THE CITY OF BEAUMONT SECTION 1 That an election be held in the City of Beaumont, Texas, on Saturday, the 19th day of February, 1955, which is not less than fifteen (151 nor more than thirty (30) days from the date of the passage of this ordinance, at which election the following proposition shall be submitted to the qualified electors - of said city who own taxable property in said city and who have duly rendered the same for taxation, for their action thereupon. SECTION 2 The -proposition to be submitted at said election shall be the following: PROPOSITION SHALL the City Council of the City of Beaumont, Texas, be authorized to issue serial bonds of said city in the amount of ONE HUNDRED SIXTY-FIVE THOUSAND DOLLARS ($165, 000), for the purpose of providing funds for the purchase of Stuart Stadium, the land, improvements, and appurtenances thereto, to be used as a municipal athletic stadium and for all lawful public park purposes for said city, said bonds maturing serially in such installments as may be fixed by the City Council, over a period of years not to exceed eighteen (18) years from their date, bearing interest at a rate not to exceed 5% per annum; and shall there be annually levied, assessed and collected while said bonds or any of them are outstanding an annual ad valorem tax on all taxable property in the City of Beaumont, Texas, sufficient to pay the interest on all of said bonds as it accrues and to create a sinking fund sufficient to retire the same at maturity. The probable usefulness of the improvements for which this bond fund shall be expended is more than eighteen (18) years. SECTION 3 The question as to whether or not the City Council of the: City of Beaumont shall be authorized to issue said serial bonds shall be submitted on the ballot, and the ballot to be used in said election shall be printed and furnished by the City of Beaumont, as provided by law, and each ballot shall have printed thereon the following: OFFICIAL BALLOT FOR THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT, TEXAS., FOR THE PURPOSE OF PROVIDING FUNDS FOR THE PURCHASE OF STUART STADIUM, THE LAND, IMPROVE- MENTS AND APPURTENANCES THERETO, TO BE USED AS A MUNICIPAL ATHLETIC STADIUM AND FOR ALL LAWFUL PUBLIC PARK PURPOSES FOR SAID CITY, AND THE LEVYING OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF THE SERIAL BONDS OF THE CITY OF BEAUMONT..TEXAS, FOR THE PURPOSE OF PROVIDING FUNDS FOR THE PURCHASE OF STUART STADIUM, THE LAND, IMPROVE- MENTS AND APPURTENANCES THERETO, TO BE USED AS A MUNICIPAL ATHLETIC STADIUM AND FOR ALL LAWFUL PUBLIC PARK PURPOSES FOR SAID CITY,,, AND THE LEVYING OF A TAX IN PAYMENT THEREOF c , - SECTION 4 Except where voting machines are used, each voter shall mark out with black ink or black pencil one of the above expressions on the ballot, thus leaving the other as indicating his vote on such proposition. SECTION 5 Said election shall be held in the following voting precincts in the City of Beaumont, and the following -named persons are hereby appointed judges. of said election, with authority to select their clerks and assistants: Precinct No. 1 At the Edwards School Building; and said election shall be conducted at said voting box by Mrs. C. C. Moore, Judge. Precinct No. 2 At the French High School Building, and said election shall be conducted at said voting box by Jack Folmar, Judge. Precinct No. 3 At the French Elementary School Building, and said election shall be conducted at said voting box by T. B. Hensley, Judge. Precinct No. 4 At the Longfellow School Building, and said election shall be conducted at said voting box by Albert Henry, Judge. Precinct No. 5 At St. Anne's School Building, and said election shall be conducted at said voting box by Mrs. W. T. McNeill, Judge. Precinct No. 6 At the Beaumont High .School Building, and said election shall be conducted at said voting box by Spencer Blain, Judge. Precinct No. 7 At the Averill School Building, and said election shall be conducted at said voting box by C. L. Rutt, Judge. Precinct No. 8 At the Junker School Building, and said election shall be conducted at said voting box by Mrs. James E. Ray, Judge. Precinct No. 9 At the -Millard School Building, and said election shall be conducted at said voting box by Miss Effie Piland, Judge. Precinct No. 10 At the Dick -Dowling Junior High School Building, and said election shall be conducted at said voting box by D. H. Barnes, Judge. Precinct No. 11 At the Jefferson County Courthouse, and said election shall be conducted at said voting box by Tobe Hahn, Judge. Precinct No. 12 At the George Washington Carver School Building, and said election shall be conducted at said voting box by W. W. Como, Judge. Precinct No. 13 At the Magnolia School Building, and said election shall be conducted at said voting box by E. A. Godwin, Judge. Precinct No. 14 At the Ogden School Building, and, said election shall be conducted at said voting box by mss. ' , Judge. Precinct No. 15 At the David Crockett Junior High -School Building, and said election shall be conducted at said voting box by F. L. Fisher, Judge. Precinct No. 16 At the Fletcher School Building, and said election shall be conducted at said voting box by Charles H. McDonough, Judge. Precinct No. 17 At Circle Drive Inn, 3615 College Street, and said election shall be conducted at said voting box by Mrs. D. B. Eberhard, Judge. Precinct No. 18 At the Hebert School Building, and said election shall be conducted at said voting box by A. L. Price, Judge. Precinct No. 19 At the Giles School Building, and said election shall be conducted at said voting box by Ray V. Watson, Judge. Precinct No. 20 At the L. R. Pietzsch School Building, and said election shall be -conducted at said voting box by Mrs. J. C. Burkhart, Judge. Precinct No. 21 At the South Park High School Building, and said election shall be conducted at said voting box by G. W. Glezen, Judge. Any voter, otherwise a qualified elector, having paid his poll tax in any of the above-described voting precincts and living in territory outside the limits of the City of Beaumont, shall not be entitled to vote in said election. None but resident, qualified electors who own taxable property in the City of Beaumont, Texas, and who have duly rendered the same for taxation therein shall be allowed to vote at this election. A voting machine shall be provided for the casting of absentee ballots at this election, and the place designated for the casting of absentee ballots shall be at the City Hall in the City of Beaumont, Texas, and all those residing within the City of Beaumont, Texas, qualified to wteat this election shall be entitled to cast absentee ballots at said place, and said absentee voting shall be conducted at said voting place by James T. -,,Garrard, judge, with authority to appoint his assistants and clerks. SECTION b Said election shall be. held under the provisions of and in -accordance with the laws governing the issuance of municipal bonds in cities, as provided in the constitution and general laws of the State of Texas, and the manner of holding said election and making returns thereof shall be governed by the laws of the State of Texas governing general elections, and voting machines shall be used in said election, � in accordance with Article 7. 14 et seq., of the Election -Code of 1951,- Acts of 1951, 52nd Legislature, Page 1097,- Chapter 492.; and only qualified electors of said city, who own taxable -property in said city and who have duly rendered the same for -taxation shall be qualified to,.vote at said election, and all electors shall vote in the election precinct of their residence. SECTION 7 The City Clerk .o£ the City of Beaumont is hereby directed to procure. and furnish the necessary ballots for said election and the necessary election supplies, and immediately. after said election has been held, the officers holding the same shall make return of the results thereof to the City Council of the- City of Beaumont, Texas, as provided by law. SECTION -8, A copy,of.this ordinance; signed by the Mayor of the City of Beaumont and attested by the -City Clerk .of the . City of Beaumont, shall serve as proper and sufficient notice of said election, and' -the Mayor is hereby directed to cause one each of said notices to be posted -in each -of the election precincts within the City of Beaumont, and at the: City Hall, such posting to be not less than fifteen x(1,5) full, days prior to the date. set for said election, and he shall further cause said notice to be published on the same day in each 'of two (2) successive weeks in a newspaper of general circulation published within said city, the date of the first publication to be not less than fourteen (14) full days prior to the date set for said election. And the person posting said notices shall make a return on the copy thereof showing the times and places of posting,, and"the return shall be filed in the office of the City Clerk and shall be conclusive evidence of the posting of said notice, and the affidavit of the publisher of the newspaper, stating the days on which the same was published, shall be filed in the office of the City Clerk and shall be conclusive evidence of the publication of said notice. SECTION 9 This ordinance shall take effect from and after the date of its passage.
