HomeMy WebLinkAboutORD 64-Yf1F-il �_t: P �A AN ORDINANCE AMENDING SECTION 6 OF AN ORDINANCE PASSED BY THE CITY COUNCIL ON DECEMBER 22, 1953, ENTITLED: "AN ORDINANCE ENTITLED AN ORDINANCE DEFINING CERTAIN TERMS; DECLARING RAILROAD CROSSINGS AT CERTAIN STREET INTERSECTIONS AS DANGEROUS TO PEDESTRIANS AND VEHICULAR TRAFFIC; PROHIBITING THE OPERATION OF ANY RAILROAD TRAIN ACROSS SAID DANGEROUS CROSS- INGS WITHOUT TRAIN -APPROACH SIGNALS AS DEFINED HEREIN BEING MAINTAINED AND OPERATED; PROVIDING FOR THE FLAGGING BY TRAIN PERSONNEL OR RAILROAD. EMPLOYEES OF OTHER CROSSINGS; PRESCRIBING A PENALTY OF NOT LESS THAN $5 NOR MORE THAN $200 FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; AND REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES INCONSISTENT OR CON- TRARY THERETO.." BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That Section 6 of the above captioned ordinance be and the same is hereby amended 'and shall hereafter read as follows: Section 6. If train -approach signals, as provided for in this ordinance, are not in existence at any of the aforenamed dangerous crossings at the effective date of this ordinance, the railway company operating railroad trains over said crossings shall have until January 1, 1955, within which to install said train - approach signals at said crossings; provided, however, it shall be unlawful, at such dangerous railroad crossings where said train -approach -signals .do not exist at the effective date of this ordinance, for any person to operate, or permit,to be operated, any railroad train at said crossings, without providing for a flagman at said crossing to give notice of the approach of any railroad train; said flagman shall be stationed in the center of said street or thoroughfare at its intersection with the railroad track prior to the time the railroad train enters the intersection of said street or thoroughfare. In the daylight hours, said flagman shall have a red flag or signal device with the word "STOP" and i at night said flagman shall carry a lighted signal so as to warn pedestrians and vehicles approaching said crossing.
