HomeMy WebLinkAboutORD 55-YP, AN ORDINANCE ENTITLED AN ORDINANCE ORDERING THE GENERAL MUNICIPAL ELECTION TO BE -HELD IN THE CITY OF BEAUMONT, TEXAS ON THE 11TH -DAY. OF NAY, 19541 AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT-FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR (4) COUNCILMEN; AND ORDERING AN ELECTION ON THE SAME DATE AND IN.CONJUNCTION WITH.SAID GENERAL ELECTION TO DETERMINE WHETHER OR NOT AN ORDINANCE AUTHORIZING THE FLUORI- DATION OF THE -WATER SUPPLY OF THE CITY OF. BEAUMONT SHALL BE REPEALED; _ORDERING AN. ELECTION ON THE SANTE DATE .AND IN CONJUNCTION WITH SAID GENERAL- ELECTION TO DETERMINE WHETHER.OR NOT THE PRESENT ORDINANCE REGU- LATING THE KEEPING OF DOGS WITHIN THE CITY SHALL BE REPEALED; NAMING THE.PLACES-WHERE SAID..ELECTIONS-SHALL BE HELD; APPOINTING JUDGES TO PRESIDE OVER SAID..ELECTIONS; PRO- VIDING THE MANNER OF HOLDING SAID.ELECTIONS; PROVIDING THE ISSUES TO.BE SUBMITTED AND FORM.OF BALLOT.IN THE FLUORIDATION AND DOG ORDINANCE ELECTIONS; AND PROVIDING FOR NOTICE OF SAID ELECTIONS. WHEREAS, under the provisions of the City Charter of -- --The City. -of Beaumont and -the laws- of -the State--of-Texas relating thereto, a regular general municipal .election is required to be held in the City of Beaumont on the second Tuesday of May, A. D., 1954, for the purpose of electing a Mayor and one Councilman from the first. ward, one Councilman from the second ward, one Councilman from the third ward, and one Councilman from the fourth ward; and WHEREAS, on the 10th day of November, A. D., 1953, the City Council of The City of Beaumont passed an ordinance entitled; "AN ORDINANCE AUTHORIZING THE FLUORIDATION OF -THE WATER SUPPLY OF THE CITY OF BEAUMONT, AFTER APPROVAL -OF THE TEXAS -STATE DEPARTMENT, OF HEALTH, AND PROVIDING THAT THE COST OF SAME SHALL BE PROVIDED FOR IN THE ANNUAL OPERATING BUDGET OF-THE.WATER DEPARTMENT OF THE CITY OF BEAUMONT,," and, WHEREAS, on the 28th day of April, A. D., 1953, The City Council of The City of Beaumont passed an ordinance entitled; "AN ORDINANCE PROVIDING FOR LICENSING.OF ALL ,DOGS WITHIN THE CORPORATE LIMITS OF THE CITY OF BEAUMONT,.TEXAS, AND PROVIDING A FEE -THEREFOR; PROVIDING THAT ALL DOGS BE VACCINATED AGAINST. RABIES; PROVIDING -FOR A CITY DOG POUND, AND PROVIDING REGULATIONS FOR.ITS-OPERATION; PRO- VIDING.FOR THE. APPOINTMENT. OF A POUND MASTER, AND.PRESCRIBING HIS POWERS AND DUTIES; REQUIRING THE DETENTION OF DOGS HAVING BITTEN A PERSON; PROVIDING AN OFFENSE FOR REMOVAL OF LICENSE TAG;.PROVIDING AN OFFENSE FOR DOGS .RUNNING AT LARGE; REPEALING CONFLICTING ORDINANCES; PRE- SCRIBING A PENALTY FOR.THE VIOLATION THEREOF, AND.PROVIDING A.SAVINGS.CLAUSE." and, WHEREAS, on February 1,'1954, a sufficient number of qualified voters of The City of Beaumont filed with the City Clerk petitions requesting that the above mentioned ordinances be submitted to a vote of the electors of The City of Beaumont for their approval or rejection and said City Clerk has certi- fied to the City Council, the sufficiency of the petitions and the - --------City Council- is- -of -the- opinion -that- the petitioners have complied with the provisions of the Charter of The City of Beaumont, and that, therefore,,the Council should provide for submitting the questions to the electors at an election within the time speci-' fied by the Charter; and WHEREAS, the Charter of the City of Beaumontfurther provides that if the ordinance be not approved by a'majority of those voting thereon, it shall be deemed repealed; otherwise, it shall remain in force and effect; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT; Section 1. That in accordance with the provisions of the City Charter of The City of Beaumont and the laws of the State of Texas, relating thereto, there shall beheld in the City of -2- , Beaumont on the second Tuesday in May, 1954, the same being the 11th day of May,_ 1954, a regular municipal election for said City for the purpose of electing a Mayor, and one Councilman from the first ward, one Councilman from the second ward, one Councilman from the third ward, and one Councilman from the fourth ward for said City. Section 2. That an election shall be held -in The City of Beaumont on the 11th day of May, 1954, in conjunction with said general election, at which election there shall be submitted to the quali- fied.' -Voters of The City of Beaumont the following proposition: Shall the ordinance passed by the City Council of The City of Beaumont on the 10th day of November, A. D., 19531 authorizing the fluori- dation of the.water supply of The City. of Beaumont be.approved? Section 3. That an election shall be held in The City of Beaumont on the 11th day of May, A. D., 1954, in conjunction with said general election, at which election there shall be submitted to the qualified voters of The City of Beaumont the following pro- position: Shall the -ordinance passed by the City Council of The City of Beaumont on the 28th day of April, 1953, regulating the keeping of dogs within The City of Beaumont, be approved? Section 4. That said election shall be held in the City of Beaumont at the following places, to -wit-: Edwards School Building; French School (Elem.') Building;,Longfellow School Building; Averill, School Building; Junker School Building; Millard School Building; County Court House Building; Geo. W. Carver School Building; Magnolia School Building; Ogden School. Building; David Crockett Jr. High -School Building; Hebert School Building; Giles School Building, L. R. Pietzsch School Building. _ -3- That all voters residing in County Voting Precincts I Nos. 1 and 2 shall vote at the Edwards School Building; that all voters residing in County Voting Precinct No.. 3 shall vote at the French School (Elem.) Building; that all voters residing in County Voting Precincts Nos. 4 and 5 shall vote at the Longfellow School Building; that all voters.residing in County Voting Precincts Nos. 6 and 7 shall vote at the Averill School Building; that all voters residing in County Voting Precinct No. 8 shall vote at the Junker School Building; that all voters residing in County Voting Precincts Nos. 9 and 10 shall vote'at the Millard School Building; that all voters residing in County Voting Pre- cinct No. 11 shall vote at the County Court House Building; that all voters..residing in County Voting Precinct No. 12 shall vote at the Geo. W. Carver School Building; that all voters residing in County Voting Precinct No. 13.shall.vote at the Magnolia School Building; that all voters residing in County Voting Precinct No. 14 shall-vot-e at the -Ogden School Building; that all voters re- siding in County Voting Precincts Nos. 151 16 and 17 shall vote at the David Crockett Jr. High School Building; that all voters residing in County Voting Precinct No. 18 shall vote at the Hebert School Building;that all voters residing in County Voting Precinct No. 19 shall vote at the Giles School Building; and that all voters -residing in County Voting Precincts No.s. 20 and 21 shall vote at the L. R. Pietzsch School Building. That there shall be printed on the ballots to be used in said election concerning the fluoridation of the City water supply, the following: AN ORDINANCE AUTHORIZING THE FLUORIDATION OF THE WATER SUPPLY OF . THE CITY OF BEAUMONT, AFTER APPROVAL -OF THE TEXAS STATE DEPARTMENT OF.HEALTH,-AND PROVIDING THAT THE COST OF - SAME SHALL BE -PROVIDED FOR IN THE ANNUAL - OPERATING -BUDGET OF THE WATER DEPARTMENT OF THE CITY OF BEAUMONT. For the Ordinance: .Against the Ordinance: Section 7. That -there shall be -print -ed on the ballots to be used in said election concerning the regulation of the keeping of dogs in the City, the following: AN ORDINANCE PROVIDING FOR LICENSING OF ALL DOGS WITHIN THE CORPORATE LIMITS OF THE CITY OF BEAUMONT, TEXAS, AND PROVIDING A FEE THEREFOR; PROVIDING THAT ALL DOGS BE VACCINATED AGAINST RABIES; PROVIDING_FOR A CITY DOG POUND,'AND PROVIDING REGULATIONS FOR.ITS.OPERATION; PRO- VIDING.FOR THE_APPOINTMENT OF A POUND'MASTER,. AND -PRESCRIBING HIS -POWERS AND DUTIES; REQUIRING THE DETEN'T'ION OF DOGS HAVING BITTEN A PERSON; PROVIDING AN OFFENSE FOR REMOVAL OF LICENSE TAG; PROVIDING AN OFFENSE FOR DOGS RUNNING AT' LARGE; REPEALING CONFLICTING ORDINANCES; PRE= SCRIBING A PENALTY FOR.THE VIOLATION THEREOF, AND PROVIDING A.SAVINGS CLAUSE. _For the Ordinance: Against the Ordinance: Section 8. Should at said election, concerning the fluoridation of the City's water supply, a majority of the qualified voters voting at the election vote against the said ordinance, then the said ordinance shall be deemed to have been repealed; other- wise, it shall remain in force. -5- Should at said election, concerning the regulation of the keeping of dogs within the City, a majority of the qualified voters voting at the election vote against the -said ordinance, then the said ordinance shall be deemed to have been repealed; otherwise, it shall remain in force. Section 9. That said election shall be held under, and the quali- fications of those voting thereat, shall be controlled by the provisions of the State laws governing elections. Section 10. A copy of this ordinance, signed by the Mayor of The City of Beaumont and attested by the City Clerk thereof, shall serve as proper and sufficient notice of said elections; and the Mayor is hereby directed to cause a copy of this ordinance, signed by himself and attested -by -the City Clerk, to be posted at each of the places herein designated for holding said elections, at least thirty (30) days prior to the date of_holding said elections.
