Q P (d-- & 3 AN ORDINANCE ENTITLED AN ORDINANCE DEFINING CERTAIN TERMS; DECLARING RAILROAD CROSSINGS AT CERTAIN STREET INTERSECTIONS AS DANGEROUS TO PEDESTRIANS AND VEHICULAR TRAFFIC; PROHIBITING THE OPERATION OF ANY RAILROAD TRAIN ACROSS SAID DANGEROUS CROSSINGS WITHOUT TRAIN -APPROACH SIGNALS AS DE- FINED HEREIN BEING MAINTAINED AND OPERATED; PRO- VIDING FOR THE FLAGGING BY TRAIN PERSONNEL OR RAILROAD EMPLOYEES OF OTHER CROSSINGS; PRESCRIBING A PENALTY OF NOT LESS THAN $5 NOR MORE THAN $200 FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR CONTRARY THERETO. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. Definitions: By the term "railroad train" as used in this ordinance, is meant any locomotive engine, car, train or cars, or any other vehicle, by whatever means propelled, designed to move over fixed tracks or rails. By the term _"_dangerous__raiI road .crossing--='- is-mean-E.-the intersection of any railroad tracks upon and over which may be moved any railroad train, with, on, or through a public street under such circumstances that such crossing is dangerous to pedestrians or vehicular traffic using such public streets and that safety precautions are necessary to protect said pedestrians and vehicular traffic. By the term "vehicle" is meant every device in or by which any.person or property is, or may be, transported, or drawn upon a public street or thoroughfare, except devices moved only by human power or used exclusively upon stationary rails or tracks. The term "person" shall include both the singular and the plural and shall mean and include any person, individual, firm, partnership, association, trust or corporation. Section 2. The following railroad crossings at public streets or thoroughfares within the city limits of The City of Beaumont, Texas, are declared to be dangerous railroad crossings: (a) The following crossings -of public streets and thoroughfares with tracks upon which railroad trains of the Kansas City Southern Railway Company System operate: Main Underhill Pearl Neches at Easy Orleans Park Neches Lawson Trinity Pennsylvania at Flowers Archie Lyle Wall Sabine Pass College Brian Holmes Railroad at Doucette Gilbert Madison Milam Van Buren Franklin Fulton at Irving Blanchette Villiva Lane Royal Jefferson Packing Co. at Craig Chemical Co. Road Irma Spindletop Road (b) The following crossings of public streets and thoroughfares with tracks upon which railroad trains of the Missouri Pacific Lines System operate: Dowlen Road Peyton Drive Belvedere St. Kennedy Drive Calder Avenue Twenty-third Street Eleventh St. Fourth -St-.
