ENTITLED AN ORDINANCE AUTHORIZING THE MAYOR
AND THE CITY CLERK TO EXECUTE A SPECIAL WAR-
RANTY DEED CONVEYING ALL OF LOT ONE HUNDRED
AND FIFTY-THREE (153), -CALDER TERRACE ADDITION
TO THE CITY OF BEAUMONT, WITH THE EXCEPTION
OF THE NORTH ONE HUNDRED AND FORTY (140) FEET
OF SAID LOT TO BRUCE.MABREY AND WIFE, FAYE
MABREY, IN CONSIDERATION OF ONE HUNDRED AND
FIFTY DOLLARS ($150.00).
WHEREAS, The City of Beaumont is the owner of the here-
inafter described land and premises; and
WHEREAS, Bruce Mabrey and wife, Faye Mabrey, are the
owners of the remainder of said land hereinafter described and
are desirous of purchasing same from The City of Beaumont, for
the sum of One Hundred and Fifty Dollars ($150.00); and
WHEREAS, it appears to be to the best interest of The
City of Beaumont to sell said land to Bruce Mabrey and wife,
Faye Mabrey, for said consideration; the land which is to be
conveyed, as aforesaid, being more particularly described as
follows, to -wit:
Being all of Lot 153, Calder Terrace Addition to
The City of Beaumont, as the same appears on the
map or plat of said Addition on file in the office
of the County Clerk of Jefferson County, Texas;
save and except the north one hundred and forty
(14 0 ) feet of said Lot 1531 which has heretofore
been -conveyed to the American National -Bank of
Beaumont, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT:
That the Mayor be, and he is hereby, authorized to execute on
behalf of The City of Beaumont, a special warranty deed conveying
to Bruce Mabrey and wife, Faye Mabrey, the above described pro-
perty upon receipt of the sum of One Hundred and Fifty Dollars
($150.00); and the City Clerk is hereby authorized to attest to
same and to affix the official seal of The City of Beaumont
thereto.

The ordinance heretofore passed by the City Council
on November 23, 1948, authorizing the execution of a special warranty
deed to John H. Richardson, said ordinance being of record in
Volume 8, Page 331, Book of Ordinances, is hereby expressly re-
pealed.

Jefferson County, Texas, duly existing under and by virtue of
the laws of the State of_Texas,, acting herein by and through its
duly authorized Mayor and attested by its City Clerk, duly au-,
tho i zed, for ' and in, consideration of the' sum of ..One Hundred and
Fifty (150.00) Dollars to it in. -hand paid by Bruce I,Iabrey and
wife, Faye Mabrey, the .receipt of which is hereby acknowledged .
and confessed, 'has GRAN ED', SOLD and CONVEYED and by these pre-
sents does GRANT, SELL and.CONVEY unto the said Bruce l•Iabrey
and wife, Faye !vlabrey, all that certain tract or parcel of land
lying and being situated in Beaul-.qont,,Jefferson County, Texas,
subject to the reservation hereinafter set forth, said land being
more particularly described as follows, to -wit:
All of Lot 153, Calder. Terrace Addition to The
City of Beaumont, as the same appears on the map
or -olat of saidAddition on file in the of=fice
of -the County Clerk of Jefferson County, Texas;
save and except the north one hundred and forty
(140) feet of said Lot 153, which has heretofore
been conveyed.to the American National Bank of
;3eaumont, Texas.
It is expressly understood by Grantees herein that
there'is at the present 'time an abandoned septic tank on the above
described property and Grantor reserves the right to go on said
property for the purpose of filling in said septic tank and
shall nor be liable to Grantees for any damages done to said
property as a result of said operation..
TO 1HAVE AILD TO IiOLD the above described premises, to-
gether with all and singular the rights and appurtenances thereto
in anywise belonging unto the said Bruce Plabrey and vrife, Faye
llabrey, their' heirs and assigns forever; and The City of Beawnont
does hereby bind itself, its successors and assigns to WARRANT
