OF THE PENNOCK AND POTTS ADDITION IN THE CITY OF BEAUMONT, TEXAS, RESERVING, HOWEVER, THE RIGHT OF THE CITY OF BEAUMONT TO CONSTRUCT AND MAINTAIN IN SAID ALLEY SEWER.LINES, WATER LINES, AND OTHER.UTILITIES, AND RESERVING THE.RIGHT OF THE CITY OF BEAUMONT TO GRANT FRANCHISE RIGHTS TO OTHERS TO CONSTRUCT AND MAINTAIN THE UTILITIES HEREINBEFORE MENTIONED THROUGH.AND ALONG SAID AL- LEY, AND PROHIBITING THE.OBSTRUCTION OF SAME BY ANY BUILDING. OR. STRUCTURE.. CA .:'?.' 1 }' WHEREAS a petition signed by all of the property owners of Block = : +'i' of the Pennock and Potts Addition to The City of Beaumont has-been presented to the City Council of The City of Beaumont, requesting that the alley in said Block be vacated and abandoned; and, WHEREAS, said petition has been referred to the City Planning Commission for examination and approval, and the same has been approved by said Commission; and, WHEREAS, said petition has been duly canvassed and exam- ined by the City Council and has been found to have been signed by all of the property owners in said Block, and it appearing to the City Council that the request of said property owners should be granted and that an ordinance should be enacted vacating and abandoning said alley, reserving, however, to The City of Beaumont the right to construct and maintain all necessary public utili- ties in said alley, or to grant franchises for the construction and maintenance of such utilities in said alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAU- MONT.,-TEXAS: EAU- MONT,_TEXAS: That the alley running through Block "'I". of the Pennock and Potts Addition to the City of Beaumont be, and the same is hereby, authorized to be vacated and abandoned, and that the title to such alley should revert to and become the property of the persons entitled thereto, as provided by law; provided, however, that the vacating and abandoning of said alley shall in no way affect the right of The City of Beaumont to place and maintain therein sewer, gas, and water lines,.telephone, telegraph, and electric wires, poles, and cables, or any other public utility service. Neither shall the vacating and abandoning of said alley affect the right of The City of Beaumont to grant franchises to any person, firm, or corporation authorizing the placing and maintaining in said alley of such sewer, gas, or water line, telephone, telegraph, or electric lines, or other public utility service, all of which rights are hereby expressly reserved. And the vacating and aban- doning of said alley shall not be construed as authorizing or permitting any person, party, corporation, or legal entity what- soever to erect, construct, build, move onto, or place any build- ing or structure therein without permission of the City Council to do so is hereby prohibited. 1953. �61A'Iltl z -)Y PASSED by the City Council this 5th day of May., A. D. - Mayor - SPECIAL SESSION OF THE CITY PLANNING & ZONING COMMISSION HELD APRIL 29, 1953 BE IT REMEMBERED that the City Planning & Zoning Commission of the City of Beaumont, Texas, met in special session on the 29th day' of April, 1953, with the following present: C. B. Holland, Chairman Russell Phelps Leonard Stone Mrs. Willie J. Brockman Absent: C. E. Holland P. G. Matthews J. D. Southwell Others Present: J. D. Martin, City Engineer George Schaumburg Carl Kohler Mr. Stebbins Hardy Akin L. V. Norris Minutes of the special session held April 8, 1953, were approved on motion made by Mr. Stone and seconded by Mr. Phelps. .I. Chairman Holland told the Commission it was necessary to appoint a secretary of the Commission. --He suggested that Mrs. Brockman be appointed secretary of the Commission so that the City Administration would always have information from the Commission available. Mr. Holland said he had checked the legality of appointing the City Manager as secretary of the Commission and had found no reason why she couldn't serve as their secretary. Motion was made by Mr. Holland and seconded by Mr. - Phelps that Mrs. Brockman be appointed secretary *of the City Planning and Zoning Commission. -000- Mr. L. V. Norris requested preliminary and final approval of the South 1/2 of Block 12, Cartwright and Roberts Subdivision A in the David Brown Survey. Motion was made by Mr'. Phelps and seconded by Mr. Stone that preliminary and final approval be given to the Subdivision of the South 1/2 of Block 12; Cartwright and Roberts Subdivision A in the David Brown Survey- _000- Mr.. Schaumburg requested preliminary approval to Block 230 of the Glenwood Addition. Preliminary approval was given to the plat of Block 230 of the Glenwood Addition on motion made by Mr.. Stone and seconded by Mr. Phelps. -000- Mr. Kohler requested preliminary approval of Units 1 and 2 of Pine Island Bayou Estates, W. B.. Dyches League. He stated that this addition is outside the city limits but is within the five mile jurisdiction of the City Planning and Zoning Commission. Mr. Martin, City Engineer, told the Commission that County Commissioner Dick Scurlock had informed him that it is in their plans to have a Farm to Market Road in thi"s area and that he planned to request that an 80' right of way be left for this road, Mr. Kohler told the Commission that they would still have to get approval from the County on•tUs Addition and suggested that preliminary approval be given by the Planning and Zoning Commission subject to Sherwood Drive being widened to 801. After further discussion, Units 1 and 2 of Pine Island Bayou Estates, W. B. Dyches League, were given preliminary approval subject to an 801 street dedication on Sherwood Drive, on motion made by Mr. Stone and seconded by Mr. Phelps. .e. The City Engineer presented a petition signed by all,property owners requesting. that the alley in Block I, Pennock & Potts Addition, be closed. 'He stated that this petition had been checked and that there was no -water line in the -alley. Motion was made by Mrs. Brockman and seconded by Mr. Phelps that the City Planning & Zoning Commission recommend to the City Council that the alley in Block 1, Pennock & Potts Addition, be closed. -000- There being no further business, the meeting was adjourned by Chairman Holland.
