THS& CITY OF BEAUMONT,- WHICH IS ALSO THE EAST -LINE OF RAILROAD AVMM .AND RUNS IN A.WESTERLY DIRECTION -ACROSS RAILROAD AVENUE TO THE WEST .LINE OF RAIL ROAD AVENUE WHERE IT -ENTERS THE.NORTHEAST PORTION OF BLOCK FIFTY-FIVE.(55) OF -SAID VAN WORMER ADDITION, AS.SHOWN BY RED LINE ON_PRINT HERETO ATTACHED, MARKED EXHIBIT "A" AND MADE -A PART OF -THIS ORDINANCE; PROVIDING -FURTHER THAT SAID GULF, COLORADO AND.SANTA.FF RAILWAY COMPANY, OR ITS SUCCESSORS AND ASSIGNS, SHALL PAY.TO-THE CITY OF BEAUMONT ANNUALLY ON THE_FIRST.DAY OF -JUNE OF EACH -YEAR THE SUBS OF FIFTY DOLL ARS ($50.00) AS. RSASONABLE COMPENSATION FOR THE .PRIVIISGE _ AND_ FRANCHISE THEREBY GRANTED; AND PRO- VIDING -FURTHER THAT SAID FRANCHISE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF TIS CITY CHARTER OF.THE CITY OF BEAUMONT.. BE IT ORDAINED BY THE CITY OF BEAUMONT., Section 1 That Gulf, Colorado and Santa 3b Railway Company; its successors and, assigns, .is hereby granted the right and fran- chise to maintain and operate at its own expense, over and across Railroad Avenue in the City of Beaumont, a spur or switch track of standard gauge_'and to operate its trains and cars thereon for a period of Ten Years (10) . Said _ spur or switch track is a continuation of a track now existing in the rear. of Block Twenty-two (22) of said Van Wormer Addition which is fourteen (14) feet Northwesterly from the center line of main track of Gulf, Colorado and Santa -Fe Railway Company to the Crockett Street depot, and runs in a Westerly direction across Railroad Avenues where it enters the Northeast portion of Block Fifty-five (55) -of said 'Wormer Addition„ as shown by red line on print; hereto .attached., marked Exhibit "A" and made. a part.of this ordinance. Section 2 The spur or switch track which is to be maintained and operated under the terms and conditions of this ordinance shall be used only as an industrial track; that is, for the purpose of affording loading, unloading and switching facilities to commercial and industrial enterprises now located or hereafter to be located in the vicinity of; said track. Section 3 �.. No cars of any kind shall be allowed to stand on the portion of said switch track which is,in the public streets of' the. City of Beaumont. Section The Grantee hereunder shall keep up and maintain a crossing over said track 'satisfactory.to the City Engineer of the City of Beaumont, and upon the failure of said Grantee,at.any time to keep said crossing and said switch track in a condition satisfactory to the City Engineer, the City of Beaumont shall have the right , to remove said track from ' its streets and to collect the costs thereof from the Grantee herein. Section This ordinance is passed subject to the Charter and ordinances of the City of Beaumont, and all future charters and ordinances that may be pas sed thereunder. 2'- Section 6 = The foregoing rights and privileges are granted upon the express condition that said Grantee, its successors and assigns, shall, within thirty (30) days after the final passage of this ordinance, file with the City Secretary its written acceptance of this ordinance. Section 7 As reasonable compensation for .the rights and privileges granted by this ordinance, Gulf, Colorado and Santa 3b Railway Company agrees and obligates.itself and its successors and assigns to pay to the City of Beaumont on or before the first day of rune of each year after .the taking effect of this ordinance, the sum of Fifty Dollars ($50.00). Section 8 This ordinance shall go into effect from and after its passage, filing of the acceptance, and ,shall continue for a period of Ten Years (10), unless annulled sooner as provided in said ordinance. COMMENT: Attached hereto are three (3) renewals of franchises submitted by the Santa Fe Railway Com- pany, the location of each franchise shown on the sketch attached.
