TO SEVEN _ (7) , . INCLUSVIE, AND LOTS TWENTY-ONE.(21) TO TWENTY-SEVEN (27), INCLUSVIE, IN. BLOCK ELEVEN (11) OF THE FIRST ADDITION TO THE NORTH ADDITION TO THE CITY OF.BEAUMONT,.TEXAS;:THAT PORTION.OF COTTONWOOD STREET LYING BETWEEN LOTS TWENTY-ONE (21) TO TWENTY-SEVEN (27). INCLUSIVE, IN BLOCK ELEVEN (11) OF THE FIRST ADDITION TO THE NORTH ADDITION, AND LOTS FIVE (5) TO ELEVEN (11) OF THE STAITI ADDITION,.TO.THE CITY.OF BEAUMONT, TEXAS; AND THAT..PORTION OF MUELLER STREET LYING BETWEEN LOT ELEVEN (11) AND LOT TWELVE (12) OF THE STAITI ADDI- TION TO THE CITY OF BEAUMONT, TEXAS; RESERVING, HOW- EVER_THE RIGHT OF THE CITY OF.BEAUMONT TO MAINTAIN AND SERVICE OR EXTEND ANY.EXISTING WATER.OR SEWER LINES THROUGH AND ALONG SAID ALLEYS AND STREETS. WHEREAS, a petition signed by the property owners of that portion of the alley lying between Lots One (1) to Seven (7), in- X clusive, and Lots Twenty-one (21) to Twenty-seven (27), inclusive, in Block Eleven (11) of the First Addition to the North Addition; that portion of Cottonwood Street lying between Lots Twenty -One (21) to Twenty-seven (27), inclusvie, in Block Eleven (11) of the First Addition to the North Addition, and Lots Five (5) to Eleven (11) of the Staiti Addition, to The City of Beaumont, Texas; that por- tion of Mueller Street lying between Lot Eleven (11) and Lot Twelve (12) of the Staiti Addition to The City of Beaumont, Texas, has been presented to the City Council of The City of Beaumonty request- ing that the above described portion of said Streets and Alleys be vacated and abandoned; and, WHEREAS, said petition has been referred to the City Plan- ning Commission for examination and approval, and the same has been approved by said Commission; and, WHEREAS, said petition has been duly canvassed and examined by the City Council and has been found to have been signed by all. of the property owners in said Blocks,.and it appearing to the City Council that the request of said property owners should be granted d" q and .that an ordinance should be enacted vacating and abandoning said portion of said alleys and streets, reserving, however, to The City of Beaumont the right to maintain and service or extend any existing water or sewer lines through and along said alleys and streets; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That that portion of the alley lying between Lots One (1) to Seven (7), inclusvie, and Lots Twenty-one (21) to Twenty-seven (27), in- clusive, in Block Eleven (11) of the First Addition to the North Addition; that portion of.Cottonwood Street lying between Lots Twenty-one (21) to Twenty-seven (27), inclusive,,in Block Eleven (11) of. the First Addition to the North -Addition., and Lots Five (5)' to Eleven (11) of the Staiti Addition, to The -City of Beaumont, Texas; and that portion of lfueller Street lying between Lot Eleven (11) and Lot Twelve (12) of'the Staiti Addition to The City of Beaumont, Texas, be, and the same.are hereby, authorized.to be va- cated and.abandoned, and that the title to�said portions of such alleys and streets should revert to.and become the property of the persons entitled thereto as provided by law; reserving, however, the right of The City of Beaumont to -maintain and service or -extend any existing water or sewer lines through and along said alleys and streets. 1953• PASSED by the City,Council.this 10,th day of February, A.D. - Mayor - "�"` � ►fir All Aor� 0� �aTkr-6-r,"-. i � i I �aTkr-6-r,"-. E. Holland that the Planning Commission recommend to the City Council that the portion of the alley lying be- tween Lots numbers One (1) ;to Seven (7) inclusive, and Lots numbers Twenty-one (21) to Twenty-seven (27) inclusive in Block number Eleven (11) of the first addition.to the North addiiion to the City of Beaumont, Jefferson County, Texas, be closed; and, that portion of Cottonwood Street lying between Lots numbers Twenty-one (21) to Twenty -:seven (27) inclusive in Block number Eleven (11) of the first addition to the Nortr. Addition to the City of, -...Beaumont, Jefferson County, Texas, and Lots numbers Five (5) to Eleven (11) of the Staiti addition to the City of Beaumont, Jefferson County, Texas, be closed; and also, that portion of Mueller Street lying between Lot number Eleven (11)'and Lot number Twelve (12) of the Staiti addition to the City of Beaumont, Jefferson County, Texas, be closed. Motion was made by Leonard Stone and seconded by Miss McCluskey that the Planning Commission recommend to the City Council that the alley in Block 116, of the Pinecrest Addition; the alley in Block 19, Jarrette Addition; and, the alley in Block 8, of the Calder Addition, be closed._ THE STATE OF TEXAS i COUNTY OF JEFFERSON I TO TEE MAYOR, CITY COUNCIL, AND CITY PLANNING C OITIISS ION OF T11; CITY OF BEAUMONT: COMES NOW The Magnolia Cemetery Company, a non- profit cemetery corporation, created. -by the Laws of the State of Texas, domiciled in Beaumont, Jefferson County, Texas, acting by - and through its duly authorized officers, and Anshe Chaim Lodge of Beaumont, a non-profit fraternal organization, acting herein by and through its duly authorized officers, and respectfully request that an order be entered closing the following described portions of streets and alleys in the City of Beaumont, Jefferson County, Texas, to -wit: That portion of the alley lying between Lots numbers One (1) to Seven (7) inclusive, and Lots numbers Twenty-one (21) to Twenty-seven (27) inclusive in Block number Eleven (11) of the first addition to the North addition to the City of Beaumont, Jefferson County, Texas; and, That portion of Cottonwood Street lying between Lots numbers Twenty-one (21) to Twenty-seven (27) inclusive in Block number Eleven (11) of the first addition to the North addition to the City of Beaumont, Jefferson County, Texas, and Lots numbers Five (5) to Eleven (11) of the Staiti addition to the City of Beau- mont, Jefferson County, Texas; and also, That portion of Mueller Street lying between Lot number Eleven (11) and Lot number Twelve (12) of the Staiti Addition to the City of Beaumont, Jefferson County, Texas. For the reason that said property and streets and alleys above described are dead-end streets and alley lying wholly within the cemeteries of your Petitioners, and are not now in use and are not practical for the development of the territory over which said streets have been dedicated. Your Petitioners are the sole and only property owners owning property within the area in which the h S") � V streets and portions thereof which are sought to be closed now lie and are the only abutting property owners thereon. 11,MREFORE, premises considered, your Petitioners pray that the above described portions of said streets and alley be vacated and ordered closed by the City of Beaumont and its govern- ing authorities.
