HomeMy WebLinkAboutORD 88-DAN ORDINANCE Entitled an "-rdinance levying -and 'assessing as,a tax upon the lots, parts of lots, blocks, or tracts of land where not divided into lots or blocks, fronting o r . abut' ing on Emma Street. from Park Street to--.Victo-ria Street. -two =thirds. -(2l3} of the cost of paving .end gutter , and.- incidental drainage, A'.nd all the : cost of curbing said Emma Street' -from Park Street to Victoria Street, apportionable t.o -the hereinafter- referred to property; and declaring- said tax a -lien'-upon said property and- a personal debt- - upon the owner or. owners _thereof -and- providing. a time when.- said tax shallbecome due and payable, providing for the collection of same and all costs incurred in collecting same and and if not paid at the 'time it becomes due and payable; and' providing the.. rate of interest 'said tax shall b ear from the time it becomes due untilpaid'; and. declaring an emergency; 'NHEREAS., pursuant to*the. requirements of sub -section- h of - -. Section 68 o -f "the Charteof the City of Beaumont, the City Commission of- the. City:of Beaumont caused to be -published, for the time and in- the maruier, required therefor by'the Gity Charter, a notice of- a resolution of said uommission, passed heretofore on the 6th day of November ; A.D. 1923, ordering a hearing to be given to the persons, firms, corporations, or estates, .their agents or attorneys owning property abutting on Emma Street from Park Street to Victoria Street; and calling upon:all persons interested in said matter..to appear; and show cause, in 4he conformity wit"h''the provisions of the 'Oharter above referred to, why the assessments in said notice should not be made aga,inst.said property and the owners thereof, which hearing was to be. held in the__voukcil: 0hamber._of_:the -c-ity -ball .of.. --I ea-umont., '!exab, .-at 7_x_30 O'Clock P.M. on the 27th, day of. november, A.D. -1923.. glTD, VHEREAS, a full. and fair hearing in conformity with the* Charter and the law in- such cases having been had .in conformity with said notice, and the- Uommission having inquired into -and determined all , facts neces.;ary 'to the adjudication . of all special benefits accruing to.such owners by means of such improvements, and said... hearing having been ,duly- closed;- -And,it.appearing that the -assessments as proposed in -"the above mentioned ,Aesolbti.on passed -on .the 6thday of NOvember , A.D. 1923, with the ".exceptions hereinafter noted -, are in all resp ects- fair and equitable, and . that there will be a full and •adequate, and. special. benefit .to the abutting property and the ovrners. thereof 'from and by reason of the proposed pavement, and improvement in excess of the amount assessed against the -.abutting property and the respective ovnzers.. thereof. That there is hereby assessed against the several owners ' o f property and against their respective property abutting upon 112ma atreet frons ,nark Street -to victoria -street, as a tax two-thirds (2/3) :of the. cost of paving .and gutter and incidental drainage, and all ti -e cost of--curbing-on said portion of said _Street. f Cl i;he lot, lots, parts of _ lots, blocks or tracts of - land on. which said tax is levied and assessed is hereinafter described;. together with the number of feet front on each lot, parts of lots, blocks or tracts of land, and name or names of the- omner or owners thereof and the proportionate amount of the cost of said paving and. gutter, and the cost of said curbing ,to be borne and paid for by such owner or wimers as shorn by the statement prepared by the city engineer of the city. -of Deaumont, vdiich said amount is hereby levied and assessed as a tax upon such lots, parts' of lot, blocks or -tracts of land as shown, to •,�i:t3— INSERT ASS.13SSMB NT 1IST ) .. SECTION 2. ':hat saidtax so -levied and assessed shall become due and payable upon completion of the paving upon the portions of said streets, _upon which -said lot., lots-, "parts-- of lots; blocks or tracts of land front and abut, and the amount of the tax hereby levied and a2oessed together. with the co --t of collecting same and seven per cent per annum from the date same is collectible until paid is hereby declared a lien against the said lot, lots; part of lots, blocks or tracts of Land,- superior to all other liens, claims or title except city, county and state taxes, and shall constitute a personal charge or claim against the ovaner or owners of the said lots, parts of lots, blocks or tracts of land. SECTION 3. :he .fact that tlhe foregoing portions of streets are in bad condition and badly in need of paYing-in order -to facilitate the heavy traffic over same creates an emergency and an imperative public necessity necessitating the suspension of the rule requiring ordinaapes to be read on three separate: meetings, said rule 'is therefore hereby suspended and this Irdinance shall take effect from and after its passage and publ cation. gassed this .� day of A.D. 19239 by the affirmative vote of ull the members of the Ochnmi,9sion• Approved this the 2 day ofU�al� ,��. i
